Those before and after pics were extreme - it's not just a few patches of dead grass - all the grass was missing! When the plaintiff saw the grass was dying because of his "quick fix" (turning off the sprinklers) he should have communicated better with the defendant as to what to do, because the gardener wasn't fixing it either. I am surprised however, the landlords didn't come and inspect the property every now and again - just driving by they would have seen it.

Given the pay people who don’t even tell them their lawn is DYING they’re probably being tripped off by lots of people who coast by for an easy paycheck since clearly the defendants aren’t around to monitor the work.

All parties involved dropped the ball on the lawn. The tenant should have been more vocal about the issue, the gardeners should have addressed the issue, and the landlords should have done routine inspections on the property.

the whole point of being a renter is that u are NOT responsible for things like the lawn , the roof , the plumbing , etc. so many landlords just want other people to pay for their investment , NO WAY !

@@marleonetti7 that’s definitely not true. I rented a property where the landlord took care of the lawn services. I have also rented property where I was responsible for the lawn services. All leases are different.

I can tell you right now the reason he let the lawn die off. It's because that home is in California and the water rations we have here if we go over the amount your allotted the city will fine you. And it's not cheap. Believe me I know from experience of living in California my entire life.

@@michelleray8428 I know this is old but as a fellow Californian in the area of the vineyards, what happens is we all get rationed and then the vineyards continue to water like normal and reduce rations more which means you aren't legally allowed to do things like shower on certain days. They also recently started doing on purpose blackouts "to prevent wildfires" so you lose AC in 110+ degree weather for days at a time including fridges and freezers unless you hook up a generator or have solar. You have to go to a tent shelter for wifi and electronics plug ins and cool air during the summer. It is horrible tbh. I left the state because of it. I would always get sick during blackouts due to low heat tolerance.

Looks like they did intend to fix the sprinklers; they just wanted to use the tenant's money to do it. Look at the invoice they're suing/trying to keep the deposit for, it's for an entirely new sprinkler system. Also, if the sprinklers are broken/flooding, how is it the tenant's responsibility to be forced to overpay on his water bill because the sprinklers are wasting water by flooding and/or not even using water on the grass (spraying in wrong directions)? In fact, that kind of water wasting would be considered a huge violation if done somewhere like California. If the lawn dying is an issue, the gardener they pay can spend a few minutes using a hose and nozzle to water the grass until the sprinklers are fixed. Then on top of the fact that nothing is itemized in the bill, and their repair guy just put a list of stuff that he slapped a huge price tag on, seems kind of like they were trying just to get a free pay-out at the tenant's expense.

The plaintiff's bla bla at the end is ridiculous, he says the gardeners would just come to mow the lawn, WHAT LAWN? There was no lawn left and even if the sprinklers didn't turn on, there's nothing wrong with buying a hose and setting something else up. He was deliberately neglectful and I don't think he deserved to get anything back on his deposit...

Malfunctioning sprinklers? Any water, ANY water would have prevented the lawn from completely disintegrating. Even water that was spraying the driveway and side of the house. Id fire the gardener too. How could a gardener allow the yard to get like that. At this point what are you paying the gardener to “garden”? Rocks?

When The Beverly Hillbillies lived in TN , their little cabin looked nicer than the way he left that property. He probably feels that over $200,000 in rent entitles him to do what he wants. The owners should have been driving by now and then also. It's not all Eduardo's fault .

It depends. Not all property owners that rent out live near their rentals and have the ability to do that. It is his fault. The renter is an adult and knows what responsibility is. There are steps to take to remediate these kinds of issues. He just didn't care. You can tell by the before and after photos. That is ridiculous. There is a rental directly behind me and the owners never drive by and had zero clue the grass was waist high until the city sent them a letter. Granted, these landlords don't care because it's still waist high but that's another discussion...

This plaintiff had an excuse for everything. You could tell that he just absolutely didn't care. It wasn't his house so it wasn't his problem. I feel bad for the defendants in this case. That yard was beautiful when they rented it out. It takes 5 seconds to correct a sprinkler head that's facing the wrong way. He was clearly just cheap and didn't feel like spending the money on water, even though it was his responsibility and on the rental agreement.

I can’t believe the tenant had to pay for the grass. The owner said their gardener was on top of it, and the judge didn’t catch it. The owners didn’t inspect the property, even remotely, so it’s completely their fault. Six years of good tenancy saves a property owner more money than the cost of a few kitchen tiles, a door jam and lawn maintenance, which was the responsibility of a contractor. I would’ve returned their full security.

the whole idea that a renter of a house is responsible for the lawn or landscaping of the property is ridiculous . the property owner should have a gardening service to handle that and make sure all the sprinklers are working properly and not put that on people who do not even own the damn property .

@@Fater4511 they were not working properly and they were damaging the paint and the glass on their vehicles. sprinklers can damage paint and glass because of all the minerals in the hard water that is usually used in sprinkler systems . plaintiffs should have sued for new paint jobs and glass replacement .

What a horrible tenant!!! Takes no pride in where he lives. I can’t stand people like that. It’s just laziness. He says it’s not his responsibility, which is true as far as fixing sprinklers, but it is his responsibility to let his landlord know when something is not working correctly. I am a renter myself, and I had asked my landlord to get rid of the landscapers, because I enjoy trimming the plants and mowing the lawn. I take pride in it. My landlord and neighbors say that the house has never looked better than it does now. When a sprinkler breaks, I buy a new one and replace it. I have bought soil to level out the yard and I have bought grass seed several times to to fill in the bare spots. I have repainted the interior and exterior with the landlords permission of course, as well as doing any and every other repair that comes up, including remodeling the bathrooms. The landlord has paid for pricier items, such as vanities and shower doors, but I pay for things as well, and they ask me what they owe me for the labor and I refuse payment. The fact that they let me do things to the house to make it more comfortable for me and my family is worth a lot to me. I just recently removed the ugly fluorescent light fixture from the kitchen and replaced it with 5 recessed light fixtures. The landlord gave me permission and they love it. They wanted to pay for the material and labor, however it was my idea to do it, so I declined payment. They have recently lowered my rent by $200 a month, and I believe it is their way of making me accept payment lol. I have a great relationship with them, and I know they never want me to move out, but they know I will one day as my family grows and I need more space. I don’t expect every renter to do what I do, but at least take some pride in where you live and communicate with your landlord.

When we moved into our rent house the landlord had laid sod within the first 2 weeks of us being there. Within 1 month the sod was dying out in patches, the landlord accused us of not watering enough, we watered regularly over the next 4 months, even showing her how much our water bill had spiked, and by the 6 month all the grass was dead. We really tried hard to maintain the lawn, and then we found out that the landlord's son never even tilled the soil before laying the sod, and they put in a grass that doesn't grow well in the shade. So eventually she just let it go because it wasn't obtainable at that point. Lol! We've been there now 8 yrs, and have put in a rock garden and planted many plants and a ton of seasonal flowers. 🪴 😃
