i dont think she was being scammed becuz she knew that she was paying alot less money for the repair than either bmw or her own personal mechanic was going to charge her . i just think she complained alot more than the average person and she devoted alot of time and effort going to the powers that be in order to finally get what she wanted but i actually dont think its fair because if u are paying alot less then something usually costs , then u know u are taking a risk and u cannot justify blaming the people who tried to help u and say u want your money back if the risk doesnt work out and after all they also put time and labor into helpng u too .

I am glad she won, however, when you buy high-end vehicles such as BMW, Mercedes, Tesla etc., it is best that you always take the vehicle to the dealership who specialize in their product, and if you can't afford the upkeep I suggest you not buy these vehicles because they are high maintenance... Had to sue a mechanic for allowing some Un-licensed, back-yard-yahoo to work on my vehicle ...all the while he was telling me that HE himself was doing the work. Found out when one of his own licensed mechanics ratted him out with hidden audio/video proof. Turns out, the licensed guy was getting cheated out of pay and hours. Glad he came forward because having to take your vehicle back to the mechanic for a third time, for the same issue, is tiresome and raises red flags. This guy defendant should only repair Wagon Wheels on horse drawn carts. He gave that business a black eye. Great job presenting a solid case, plaintiff! 👏🏼👏🏼👏🏼👏🏼👏🏼

The dude patches up cars that he is selling. He did this repair on the down low for cheap- and for cash- no receipt. She wanted a deal. She could have gone to BMW- let's be real. Keep paperwork, chat records, etc. He wasn't licensed and made up a story of bringing in a mechanic. Shady all around. To her defense, she said she asked for a legit part. He also said he gave her a receipt. He flip flopped twice. He just said she asked for the OEM part, then he says she did not. The official seems shady too- maybe the owner greased him...since he was not cited. No fine paid. Judge wasn't having it. Biggest lesson here- never buy a BMW. Money pits. $1,800 is robbery. I changed my own valve cover gasket years ago on an old American car for $8. If it needed the metal cover, add another $20. Times have changed.

i do think she overpaid if the defendant hired a mobile mechanic because those guys would do the job for 250 dollars and be done in around 2 hours for that job . the problem is that he used a after market gasket instead of getting it from the dealer and thats why it leaked or it actually could have been another leak coming from another part of the motor because sometimes when u fix one leak then the oil pressure will find the next weak spot and start leaking from there .

well the dude must have patched up her car pretty damn good to last six months before she even began to complain . if a gasket or seal is not working it usually will start to have a obvious leak within one or two weeks so im thinking she had other leaks and her personal mechanic may have given her something to help her win this case and she probably had other leaks that her personal mechanic fixed and she got a refund now from the first repair . she may be a scammer .

OEM are simply made by some low bidding manufacturer, to the car companies specs, then stamped with their logo. Those parts fail too. What happened is her car was getting serviced and a mechanic commented (when she asked) that it was not OEM. She ran with it- threatening the mans livelihood- trying to severely hurt him and his family financially- so what, she can get $1,000 back- on work he did? That seems pretty low to me. She went to him to save money- to do it on the cheap. If she needed OEM, she should have had that in writing or a text. If it was not done w/OEM, she could have cancelled her CC or just not paid upon picking it up. On a new valve cover gasket and cover it should not leak. Unless the head is warped and she waited nearly a year? Something isn't right here. Dude looked like a hard working straight up guy and she dragged him through the ringer.

The defendant lost the case because he lied about installing a genuine BMW part. Having said that, as Scotty Kilmer says, many BMW original engine related parts are designed to fail, BMW is famous for being unreliable, many parts are made of plastic when they should be made of metal. So don't automatically disregard third party parts as being inferior, in fact they may be superior in some cases.

We moved to an area that has no Audi dealers. When our Audi needed a tuneup we found a mechanic with 5 stars. I spoke to them twice about authentic parts. We took our car there. Next day they called that the “ parts catalog “ they normally use told them to order the wrong parts. I am so grateful that they did the extra effort to make sure they got the correct parts. I do believe it helped that they listened to my concerns. It took two extra days to get the parts from Audi, and he would not charge me for the upgraded cost. This is the best scenario for us, and we are very grateful for this professional repair shop. Unfortunately, I don’t think this is the norm.

High priced vehicles require high maintenance. Often, people want the high “look”, but don’t want to pay for it. I get it, but is it really worth the time and trouble of litigation when it doesn’t work out the way you wanted…especially when it wasn’t the correct diagnosis/repair all along? Honestly, I think he's a good mechanic for customers who need to save up money to repair their vehicle properly. Sometimes your car breaks down when your budget is not right. I think the plaintiff had the money to fix her vehicle properly. Some people have to put a band- aid until they get paid. This is not the case with the plaintiff.

When I bought my car brand new from the dealership, one thing I was told very clearly by the sales representative was to always take the car to the dealership for maintenance and repairs because otherwise, it may affect the warranty whenever it would be needed. Well, 7 months ago my engine stopped working. My car is 3 months shy of 10 years and very close to the 100,000 mile warranty. Because I had taken the car to Hyundai all these years, they were able to see the maintenance and upkeep of the car right from their own system and everything was fully paid for including the rental car.

Most people don't realize that just about every shop - from the manufacturer's dealers to used car lots to independent shops including Firestone and Goodyear - have accounts with AutoZone, O' Reilly, NAPA , etc. If she wanted BMW parts, why she didn't take it to the BMW dealer? Newer BMWs don't have oil dipsticks and they are hard cars to fix. After the original warranty expires, most German cars ( BMW, Mercedes, Volkswagen, Audi etc.) they are up for sale. As for emotional support animals, people start bringing mini horses pigs, ducks, peacocks and other exotic animals aboard and most people don't understand that the animal body waste can rot aircraft metals and what if the animal is out of control in a tube at 30,000 feet? U.S. airlines began looking like Russian and small South American airlines back in the fifties.

The mechanics hate German cars; especially the later models, they are headaches. Out family friend, who has a large used car business, tries to buy more American, Japanese and Korean made cars. The majority of German cars in his inventory you can count on one hand. As for parts, the regional warehouses for the auto manufacturers are closed on the weekends and holidays; shops are open on Saturdays and need access to parts. As for the emotional support animals, it's been all over the news about the abuse by passengers bringing animals other than dogs and cats. Just look at a Jetliners during a D check ( taking the jet apart, inspecting each part and put it back together); most parts are replaced around the restrooms.

If we’re talking about the actual valve cover then I would always use factory parts. If we’re talking about just a valve cover gasket then it doesn’t matter. A lot of aftermarket gaskets are higher quality then the factory.

If the defendant told the truth he needs to go after the mobile mechanic because he admitted she specifically requested bmw parts. But I have a sneaking suspicion the mobile mechanic is a family member or friend. He is trying to protect them. It’s surprising that he doesn’t realize the error on his part. I think the plaintiff should go back to the regulatory agency and submit her credit card bill as proof the business acted as a automotive repair dealer to the public. He needs to feel the pain so he can stop making excuses and take accountability. Then he won’t make this mistake again.

I have no problem with emotional support animals. It's just way too easy to get their pet certified as one that people that want to take their everywhere are getting pet certified as that or at least are saying that their pet is one. They're usually are untrained and aren't behaving well in public like a trained pet/dog would. So it sucks for the people that can't afford to get a service dog or don't have the insurance that will cover the cost. They used to be able to go the cheaper route and get a dog as an emotional support dog. It's so bad that there are different ads that run on KZbin saying if a person wants to take dog everywhere, then all they have to do is get them certified as an emotional support dog. It's also bad enough that most people aren't even going the extra mile anymore to have their dog wear an emotional support vest like how a service dog has to wear a vest.

Aftermarket parts are not necessarily a bad thing. Millions are sold every day and work fine. I've used many aftermarket parts with no problem The judge should not preside over these cases when she knows absolutely nothing about the workings of a car. The dealership may have told her what they did because they wanted the money. They could have been lying just to get the job.

She’s flat wrong. After market parts work fine. The dealership will always tell you to use their parts because they want you to have them do it. Btw, German cars rate low on maintenance issues so don’t think just because it’s a BMW you won’t have problems with BMW parts.

This one is kinda bad. The guy believes or at least wants people to believe that she just wanted a cheaper price. The after market part didn't save her much money anyway. She asked for BMW parts only (which this guy agrees that she said that). Also with the having to say "I only want BMW parts" is kinda dumb to me. If a certain vehicle or company of vehicles only work with that company's parts, then after market/3rd party parts shouldn't even be an option. A mechanic should know this and only use what will work with a vehicle even if there's a tiny chance the after market/3rd party part(s) will work 'cause it most likely won't work. Then the customer has to pay someone else to put in the correct parts. Which is a loss of a lot of money. The customer pretty much just overpays on a part/on parts. Then pays for the real parts and labor cost. Plus the other mechanic just wastes their own time. That's if they get sued since most people aren't gonna take the time and spend the money to sue someone (since it costs money to file for a lawsuit).

She won't go to the BMW dealer because they charge 3 times as much for labour. Well that's because they are specifically trained to do the job and specialise in BMW vehicles. She wanted cheap and got it. I put a clutch in my BMW and it was significantly more expensive than other cars I have owned over the years but it came with owning a BMW. Just having a part supplied by BMW doesn't guarantee good workmanship. I think she should sell the car now and quit the ghetto fabulous lifestyle before the car dies and she can't fix it at all.
