My commercial burglary got dropped to trespass and than dismissed and expunged from doj record but when I live scan the original charge comes up on fbi record how do I change it so it matches my doj

You can contact the DOJ’s Bureau of Criminal Information and Analysis and ask them to send the FBI the updated information.

Man I was convicted of a non violent felony little over 20-25 years ago. Had it expunged or reduced to a Misdemeanor. Moved out of Cali to Colorado 4 years ago. I’m intimidated and clueless on where to go and what to do and who to see 🤦🏽‍♂️. At times I’m thinking there’s no hope on fully restoring my gun rights

The best thing to do would be to contact a defense attorney in CO to see if your rights were restored by the reduction. In CA it’s tricky, but perhaps in CO you’ll be able to.

@@josephherrera645 My process was quite simple. Being that I had my charges dropped and expunged 20 years ago and completing the stuff I was sentenced to. What was holding me up was the CA DOJ NEVER updating my file or records. Which requires basically going back to the courts and requesting certified records on what was done and reduced and dropped. Mail those certified records to the CA DOJ and a few weeks later no longer than 3 months they updated my files and records. Before I was trying to buy a firearm and my stuff was always denied. After doing all that legwork and requests for file amendments and changes. I’m approved and can purchase a firearm.

I'm having the Public Defenders office submit the pc 17b(3) and 1203.4 under the fresh start program. First Felony has been reduced and dismissed, waiting on the 2md one.

Thank you! There’s not a time limit. You should file the motion along with an expungement petition. Include as much positive information as possible to increase the likelihood of the judge granting the motion. It’d be best to have a solid attorney assist you. I hope everything works out!

I practice in CA, and every state is different. I have heard that in TX they do not allow for this. Your best bet would be to reach out to a local attorney, as this should be a relatively easy question to answer. I hope everything works out. I’m happy you were able to turn everything around. I have a felony that happened in 2012. Well they basically forced me into Drug Court, knowing I'm an addict. Anyways, long story short, I failed out of drug court after jumping through ALL of the courts IMPOSSIBLE hoops!!! Smh. I ended being sentenced in 2015 to 10 months in the penitentiary. So technically, my felony happened in 2015... Smh I need help!! I literally have put in about 8 applications A DAY!!!! And have gotten the jobs.... Then BAM! "Sorry, your offer has been rescinded due to your background check" 🙄👍🏼 I Cannot even get a job at Dollar General!! It's ruined my life. I have been clean and sober for going on 10 Years now! I have 2 children, a boyfriend of 9 years that is emotionally and financially abusive.... I NEED a job SO bad!! I have no clue where to bring to get my record sealed, they won't expunge anymore in Ohio.... 🙄👍🏼 But I have the 1 Felony 3 non violent charge, and a few misdemeanor thefts from at least 9 years ago. 😔

Sounds like a case from out of state. I only practice in California fellas. What I will say, is that if you have no criminal history, and it’s a first offense, there’s a lot that can be done for you. You’ve gotta find a solid attorney in your city who can tell your story to get you the best possible result. In some circumstances, it could even be a dismissal. I hope everything works out for both of you!

First of all, that’s great that you’re committed to making your life better! It’d definitely be worth filing a motion to reduce. You would want to get the letter from the recruiter and any other positive info you can get together to show why you deserve it. If you can hire an attorney to help you, that would be best.

At the felony business office of the courthouse in which you were convicted. You have to serve a copy on the DA as well. Be sure to include as much positive information as you can to show how the offense was in your past and how much you’ve changed. Include education and employment info, awards, and letters of support as well. Granting the motion is at the court’s discretion, so you want to give the judge all the reasons why they should reduce the felony. I hope it works out, and best of luck in your new future!

Usually it’s going to be part of the plea deal to reduce to a misdemeanor. However, there is the opportunity to request a reduction at sentencing or even after sentencing. However, he doesn’t have a right to a reduction. He needs to provide all the positive information he can to show why he deserves to be granted a reduction.
