(I wish the judge didn't admonish the man for walking his dog and minding his business. He had no obligation to answer the Judges stupid question. It is her job to adjudicate the case not teach him her morals.

I totally agree. I know everyone's all pissy about the defendant. She just wanted him to stop in that moment of even after when she found him to have some civility. But he's not a monster, she's just not that super great of a pet parent. Hole one size and pompoms are fluffy and some times yappy and nippy. Her fault.

Yeah. He probably could have apologized for the severity of the injury, which was unintentional. Wouldn't have stopped that negligent dog owner from suing him. But would have looked better on him to apologize. These days though, people are afraid of lawyers getting involved and trying to twist an apology into a "confession" of "guilt". I'm sorry Hitler killed six million Jewish people. That does not mean I loaded the Cyklon-B pellets. But, disingenuous people can twist words.

Even WITH a leashed dog your dog can still give you a heart attack. My family's dog has a full harness for when she goes outside and she somehow got herself out of it the other day. Loosening it somehow I guess. She then scared the hell out of my mother and I we were so scared that she'd just take off. Luckily for us she decided to play tug of war with her harness and her leash rather than just dropping it and running. It gave us the chance to formulate a strategy and grab her.

Judge was completely out of line in attacking the defendant. It was all on plantiff for not keeping her dog contained. And her being dismissive of his disability was ignorant. I have arthritis and bursitis in my hips and sometimes I can walk pretty normally but sometimes (especially after walking awhile or standing awhile or just because it acts up) i have a really hard time walking.

He's lying out his teeth. His 55lb Beagle would've easily handled a yappy 5lb Pomeranian. He loves to swing his cane at dogs. I've owned miniature Pomeranians. None are nija enough to fly through the air yo attack the neck of a large beagle.

It was the plaintiff's failure to retain her dog that got him hurt. The defendant had no responsibility to go and apologize to her! The nerve of the judge to make him apologize like that when the plaintiff is in the wrong! She's lucky he didn't run into the street and get run over by a car! Control your animal lady and he won't get hurt!

Saying “I’m sorry” doesn’t have to be the same as saying you did something wrong. It’s about having compassion toward a fellow dog lover and neighbor whose dog was seriously injured in an incident with you. “I’m so sorry this happened.” “I wish I could have avoided it.” “I’m checking to see how Sasha’s surgery went.” All of these are good starts. This is definitely the kind of world I want to live in, but reading the comment section-I feel like I’m in the minority.

Is she still responsible for her dog? Yes, but she wasn’t being blatantly negligent. This was all an accident. So to try and compare it to a home invader that gets shot is disingenuous.

The defendant has absolutely nothing to feel guilty about. The lady let her dog out, she knew there was a hole in the fence, in my opinion it's her fault. The dog got hurt. Not to mention the dog could have heard itself when it was crawling out of the hole on the fence. Did anybody consider that?

If that Pomeranian had been a pit bull and escaped enclosure, Judge Milian would never make the defendant apologize. The focus should be on the responsibility of the dog owner, not the breed/size of the dog.

JM gets carried away with her drama. The defendant has nothing to apologize for. The plaintiff's dog came at him and his dog. It's the plaintiff's job to contain the dog, with a fence (that it slipped through) or on a leash. JM goes off on a tirade because the defendant wasn't sympathetic. He doesn't have to be.

If I were the man I would of apologized to the dog for having an owner that didn't take care of him. If your dog gets out unleashed, you are responsible for any damage that dog causes, even to itself. Did plaintiff apologize for putting the defendant in this situation? Her dog is still alive, makes no matter that it is missing an eye, people adopt animals with disabilities or a defect all the time. My friend had a German shepherd that as a puppy had to have its front leg amputated and that dog lived to 15 years old with that disability. She should be glad her pet is alive, well and adjusting.

This case was over at 1:43 - after the Plaintiff said her dog escaped her fenced area through a hole. I mean, I understand the desire to want to blame someone else for stuff like this, but blame really falls 100% at the Plaintiff's feet here. Her dog, under her control, escaped under her watch. She needs to top thinking shes the victim here and take responsibility for what happened otherwise its very likely to happen again.

Any of us that have been walking their dog on a leash and have another dog, big or small, run up and bark and yap and even try to bite you or your dog, knows what an absolute fubar'd situation it can turn into on the spot. The plaintiff is delusional if she thinks the defendant did anything wrong. If she would have plugged the hole in the fence her dog wouldn't have gotten out and gotten injured. Her defense? It's a rental. So another case of 'I did nothing to help myself, why isn't the other party responsible?'

As much as the defendant was expected to apologize to the negligent woman, she owes him a bigger apology for putting him in the situation, he had to defend his dog and then had to defend himself in court. Doesn’t matter how small a Pom is; they have sharp teeth & can do serious damage. It would have been nice for him to go check on the Pom but he was the victim in this situation. What other situations do we expect the victim to go check and see if the aggressor is okay after they attacked us?? If anything, SHE should have been asking HIM if he and his dog were okay after they were attacked by her loose dog.

That man used excessive force. You can easily keep a dog that tiny away from you just by shoving it away with your foot. There's no way that dog's eye was popped out of the socket by him trying to separate the dogs. He swung with max force , guaranteed. Then, showing aggression to the dog that's still on the other side of the fence by swinging the cane at that one , too? This man has serious problems. He would wake up every day of his life to flat tires on his car, a cut break line , etc, if he ever did that to my dog. That being said , her dog got out of the yard. There are psychos out there that will do the worst things to animals, so people need to make sure their pets are locked up SECURELY . So unfortunate. That poor dog.

He’s an older man and his balance may not be good. He could have been put off balance during the tussle and fallen and been hurt.

It doesn't require any kind of excessive force to prolapse a dog's eye, just a rightly applied force to the right spot.

Especially dogs that were bred to kill everything, aka pitbulls and all who fall under that umbrella name. Gářbagë breed for ģarbagë people. Also applies to all large breeds. All dogs are unpredictable and dangerous.

Plaintiff is not a happy camper. Too bad, so sad. I am sorry Sasha got so seriously injured, and I am sorry the Defendant did not contact her and apologize for the unintentional injury. But he has every right to protect himself. However, him banging on the fences with dogs on the other side speaks to him being a little free and overly violent with that cane. He should offer to pay for half. Morally, that would be fair. Legally, no, morally yes.

When I was young, I used to see some of the older men in the neighborhood walking around carrying a golf club over their shoulder. Took me asking the "grandfather" across the street to find out that it was for protection in case of a stray/loose dog attack.

He might be right to defend himself. But he acts really dumb like he doesn’t have a conscience that her dog got hurt. He was acting like he didn’t care much at all! Not even an apology is gross on his part.

I feel bad for the dog, but i don't blame the guy one bit. I had a stroke and was learning to walk again and walking around the block with my cane. This dude let's his dog out and it is trying to attack me by trying snarling and biting at me. I'm swing my cane but I have no balance and I fall in the ditch and kicking my feet. The guy runs out and gets his dog never apologizes. 2 weeks later I get in front of the house the the dog is in the driveway no one around. She looks at me and I look at her I raise my cane like if you come I'm smack you. She didn't. 2 weeks later I turn the corner and his dog is loose again sitting in the middle of the road. We stare at each other for about 10 seconds and suddenly she comes charging When she gets right on me I smack her in the head with my cane. She takes off running home and I hear the guy saying, "Ginger, Ginger what's wrong" I just kept walking. About 1 month later, I turn the corner and look down the road and there she is. I say, "Ginger let's not do this" Suddenly she starts wagging her tail and runs up to me wagging her tail. I couldn't believe it. I even petted her and now she's walking with me. When we pass her house she keeps walking after about 50 yards I finally tell her go home, go home and she does After that never saw Ginger again Moral of the story, it a dog is attacking and you have a cane, USE IT. This one is on the owner.

I don’t think the judge was wrong for what she said to the defendant. She was attempting to teach him something that everyone should know, and that’s human decency! He wasn’t wrong to defend himself/his dog, but he seriously injured someone else’s dog so he should at least feel bad for the owner’s feelings.

I really think the judge needed to put more emphasis on the fault that falls on the plaintiff. She left that courtroom still believing it was 100% the defendant’s fault. The only thing the defendant was guilty of was being a pretty crappy person.

apologizing could be interpreted as accepting fault, so it's completely understandable that he wouldn't do it. i love how the plaintiff said the guy was a monster for defending himself from an unleashed dog that was attacking his. maybe if she were a better dog parent, this would not have happened.

The fact she thinks he's a monster for protecting himself from her dog biting him shows you her character. Accidents happen but be a responsible pet owner Make sure there's no holes in the fence before you let your dog out. For some reason this stuff is lost in modern society. People think their dogs belong everywhere they go. They don't give any thought or care over people's allergies or prior trauma from dog attacks or anything.
