I had one of those hair straightener guys physically wrap his hand around my upper arm while ripping my hair tie out of my hair. Some old man mall walking by had to rescue me. I’m sure while walking through the mall you you’ve stumbled upon a sign in the window of a retailer that read 50% off let’s just say you waltz in maybe you bought a few things and when you got to the counter the 50% off may have had contingencies!! And the contingencies were in small print under the 50% off print outside in the window. So you get upset because it’s not what YOU thought. Who’s at fault? The store for not making the print bigger, or yourself for not reading the entire print? Everyone has got to start taking responsibility for their own mishaps.

Such a bummer. I don't agree with the ruling. The judge kept saying you don't pay for services ahead of time. That's not true. I have paid for package deals ahead of time to get the deal at the spa and massage place I go to. Usually your credit card company will take care of it if you dispute the charge.

I had this happen once at the mall when I was in high school and I must have been at his stand for almost 30 minutes or more... I simply told him that I didn't have the money and he kept saying, "It's not about the money." He kept selling pitches and wouldn't physically let me go because he kept grabbing my hand to do more work on them. Lo and behold I walk off with a nail care kit for almost a $100. I used it for sure and it lasted a long time. But I never get near the salesman's stand after that incident and pretend I don't hear them. I was young! 😅👌

This happens every time I visit a mall as well. People outside the stores trying to sell you crap like perfume, memberships, massage packages, etc. I just keep walking right past them because there is always a catch. I don't even say "no thank you". I don't acknowledge them at all. Also whenever I make an online purchase I always read the fine print to ensure it is just a ONE TIME purchase with no recurring anything. These companies are shady like that and will get you in a trick bag of monthly payments if you are not careful.

My thought has always been I should know what a contract says because if something happens, you are going to hold me to what I signed. If I don't know, I'm screwed.

What would really get them is bringing in a bus full of homeless people, encouraging them to touch & try out all the products (can't kick people out of a public business for no real reason...well they can but they can't - that's an entirely different convo). Plus, just let the business say, they are kicking the people out because the people are homeless, poor, or dirty... them BAM, that's DISCRIMINATION". Make them give all the homeless people free facials, even if it's to 'buy the product', after. Yet, at the end, after the initial facial, when they are about to charge for the product(s), just say - "Oh sorry, we changed our minds... thanks for the free facials". After all that, turn to them & kindly explain, that if you DON'T refund back the money, more & more homeless people will be brought here, every single day.. even if it's only to stand in the halls of the mall, in front of the businesses entrance so it will me hard for anyone to just walk in. Not that many people will want to walk in, with tons of homeless people - & no one will get close enough to be bothered by the sales team. If they go to another part of the mall and bring back people, those people will immediately turn away, seeing all the homeless people in front of the store. PLUS, its NOT against the law to stand there and tell people about the experience they had with the company. You think anyone's going to go buy anything from that store. As long as the homeless people aren't hurting anyone, causing big problems for anyone (no talking about the business... telling your own story of events is not considered harassing or bothering the employees - they may not like it, but oh well, no one likes to be scammed and no one likes those idiots to approach them in the mall. So too bad, suck it up, just like the customer... otherwise just give them back their money.

That happens in the malls in Saudi Arabia. A lady walked up to me (very assertively) dragged me to a room, shoved a magnifying mirror infront of me and then began to tell me about all the problems I had with my skin. She then started on about skin care products. I asked the price. Started at 600 SAR's, (about $300 USD) I got up, took my old looking face out of that room and bought myself a new Coach Bag. LOL

There’s no way she didn’t see the price. I understand getting tricked into an $88 facial but the second you get that receipt to sign and the price is DIRECTLY above the signature line especially with how big it is you’d need to be squinting to not see it. She definitely knew what she was doing and got excited at the thought at first but after the burst of excitement wore off and she realized her mistake she tried to take it back.

I think the plaintiff thought she was signing up for the monthly facials and would therefore be making monthly payments. When she was charged for 12 facials at once she was appalled and wanted to terminate the contract completely. This is why it’s usually better to settle a dispute out of court rather than roll the dice with the judge. The plaintiff would have gotten most of her money back if she had accepted the defendant’s offer.

No, you misheard, he never offered her a refund ever. She had paid for 12 monthly sessions, in one go, he offered to change that to 12 monthly payments coming to the same amount, she refused, he offered her $600 of sessions and $400 of products, she refused. Then in court, he won but at the very end he said she could come in for her 12 sessions or again offered some sort of store credit, but he's not giving her back her money. He doesn't have to and he won't...

Defendant didn’t do anything wrong- he tried to appease a customer that had buyers remorse. He didn’t have to refund anything. He may have refunded everything , that would have been the nicest thing to do, but then he would lose out on all the profit. The next thing he did was change the payments to installment payments . She didn’t want to do that. Then he tried to offer her products, to make money from the sales . You know mall kiosks have a steep markup, so he’ll make good money on the sale. Defendant is definitely a experienced salesman , and knows how to get people to buy. His customers are women , who easily fall for the sales pitches, and spend quite freely , and may have “ beauty” complexes . If you see something in a kiosk in a mall, be sure to shop around and compare and know what prices things are going for. If you are kiosk merchant, look into opening a mall store . Rent is only $50,000 a month .

While Christmas shopping at the mall the other day a lady grabbed my arm saying I was beautiful but I couldn't use some blemish cream ($300) for my cheeks and also pointed out my dark circles under my eyes and also had cream for that ($175) as I tried to walk away she grabbed my arm again and kept talking but at this point I was pissed she kept grabbing me! I told her to not touch me again and if she believed in the product that much then she should buy that cream for her own skin! They are very pushy but I'm grown and nobody could push me into buying anything!

True story, a young girl selling $50 a jar skin cream in the mall came at me with the most aggressive, pushy and obnoxious sales pitch ever, and she pushed for a long time but it didn't work. I just told her that as a man, skin cream wasn't high on my list of priorities and I'd sooner spend the money on pizza and beer, and walked away. Maybe 6 months later they were selling the same " Dead Sea Minerals " face cream in the ' Dollar or More ' store for 3 dollars a jar. In theory, buying one jar of skin cream at the dollar store would have saved me $47 off the " in the mall " price. When it comes to saving money, It's all about where and how you shop. If someone tries to bully you into buying anything, that's your clue to cut and run. Don't be pushed.

These people are VERY predatory, I worked at Verizon and they used to stop my customers and come up to our kiosk harassing the customers. Verizon got fed up with the customer complaints and told the mall's management company that they'd cancel their contract and move out, they moved those type businesses to the other wing pretty much the next day. They disgust me. I've been to malls across the country and when I say no once, that's what I mean I'll just keep walking. The judge was wrong on this one, once he said full refund in that message, that was it, I don't care if English isn't his first language.

That wouldn’t have worked. She signed the receipt agreeing to the charge. She just didn’t read it carefully. The bank does an investigation when you ask for a charge to be reversed and if they discover that you actually did make the purchase they charge your account again for that amount. The defendant offered to give her the money back minus the cost for the one facial that she planned to have anyway. The defendant refused that deal so the judge had to enforce the contract as is.

If I went though even 20 minutes of that sales pitch that the plaintiff describe, I would be iffin mad to be putting up with so much strong arming. I've been there only once before over the phone when I was making hotel reservations and I was transferred to someone trying to sell me time share. Ticked me off. I don't utterly agree with the Judge's ruling. That one sentence of letting someone go and it not saying "per facial" doesn't show defendent in good light. I don't accept that English isn't his first language excuse cause he did very well in court and he is in business so he must make himself clear, or he's going to have more problems like this in the future.

I was shopping at an upscale mall and this guy corralled me about trying a sample of Egyptian soap scrub on my hand. Yes it felt great and from there, I was pressured into spending $185.00 on bath products instead of the $45 for soap scrub. these people r pros at manipulation. I was with a friend and she keep trying to pull me away, but the guy keep pushing her away. Now I avoid any and all mall people at kiosks.

Stopping 5:36 in to say my manicurist, hair stylist, dog groomer and so many others take my credit card as deposit or 1/2 down payment upfront before any service starts. Sometimes I have issues trying to pay in cash and they want to bill the balance to the card on file. Not saying that this woman did that but I ca. See paying upfront for services because if you're a no show, the provider is out the $ and time scheduled for appointment. 🤷🏼♀️

I remember when I was younger my local mall had the stands with the slick sales people grouped together in one section of the mall. I’m not a mean person so at first I would be nice and stop to hear their pitch. After breaking out in a rash due to a very uncomfortable hand massage from a slick salesman with cream that I was told was hypoallergenic I decided never again. After that incident I would make zero eye contact and just walk by them.

Legal question. Yes, if you sign a receipt that says "No Refund", that clause has to be kept. But, just curious, what if one signs such receipt and then, sees the receipt that says "No Refund", and changed one's mind at that moment. What do you do? Is the no refund still binding?

Yikes! I had the same experience and I was asked after a point for ID such as license to military ID (which I have) I continued to say NOT INTERESTED. He was attempting to get another product and I told the ladies standing there that I have taking a photo snap shot in the clear each of them and ask to ensure that none of my information is in the files, terminal to charge. See I showed my military ID thinking verification for discount, which still I was not doing. He had in fact went to the back and wrote my social security number. I advise him of a federal crime to use any information that now we were on a video sharing together. I asked for the entire pad he wrote on an then went to the Mall Security filed a complaint. Returned to the shop to inform the ladies of the report and will report to the State Attorney’s Office and Better Business Bureau. Look at this he is still trying to sell ot the Judge! Are you insane.

The problem with this whole ruling is that the defendant admitted to exactly what the plaintiff claimed happened in a text and to the BBB and that they suspended the staff member responsible for overcharging the plaintiff and other clients. Moreover, the judge is holding the plaintiff and the defendant to two different standards: for the judge, the plaintiff can be presumed she knew what she was signing because she has had facials before, but the judge doesn't hold the defendant accountable for writing up a resolution agreement in a text message that the plaintiff agreed to like the defendant was some kind of incompetent person that had no idea what he was writing. What's good for the goose is good for the gander, if she was too knowledgeable to be fooled into paying $1000 in facials, shouldn't he be too knowledgeable to have miswritten the resolution agreement?

The only thing that would work in what you propose is NOT SIGNING. Your credit card company would uphold the charges because your signature shows you agreed to it.

Some states have a 3-day clause to guard against predatory marketing if the purchase is over a certain amount. If you change your mind within the 72 hour period, you can cancel the sale. Hmmm...

I know exactly the store. It goes under different names but claims to have diamonds and gold in their products. They always say whatever they need to get you in the store, and the prices magically drop from thousands to a couple of hundred when you show hesitation. I know them cause I worked in a store next to it, but I heard before that they had a kiosk where EVERY EMPLOYEE WAS ARRESTED on the spot because they were all here illegally from Israel. Do yourself a favor and get your skincare products at the drug store, they are just as good as anything else.
