However, where a trustee becomes incompetent owing to the following criteria, but does not voluntarily retire, they may be removed from office: Mental illness, or Bankrupt, or Remains out of the country for more than 12 months. This may be done by powers conferred under the trust instrument (i.e. an express provision in the trust that gives the power of removal to someone), or by the power under s.36(1) of the Trustee Act 1925 (i.e. by the trustees):

My father's will says that if my mother is unwilling to administer the trust that he and my mother set up, then I am to take over. He died. She is not providing an accounting of the trust, and sold property in the trust she had no right to sell. She is claiming that not only am I not going to get an accounting, but that she is writing me out of the trust. Is she allowed to do this?
