To protect the landlord, it's always a good idea to have everything down in writing with the tenant. Making sure that the tenant knows what they can and cannot do as far as rental goes. A good video for the times we live in. 😊

This is happening all over Ireland. 1 head tenant rents a house and rents out rooms to otters at a higher rent and he/she lives rent free and more than likely is making a living out of it.

Happening all over the country. Sub letting . Could write a book on it. Don’t be a landlord. Nightmare. So many dishonest and corrupt tenants out there. Making a fortune.

Exactly as I expected. I have a four bed house let as a shared house. One or other tenant moves outfrom time to time, and is replaced. One of my tenants decided that she was only renting a room in the house. Of course, this was not correct, since her bedroom was not a self-contained unit. She was actually sharing the whole house, with 3 others. 😂🎉🎉

Can you explain a little more what happened here? What was the tenants aim in “deciding she was only renting a room”? She wanted to pay less rent because she supposedly wasn’t using the rest of the house?

@@brenfaltermeyer I don't want to get into too much detail. But, in essence, she didn't want to pay the full rent. ☘️

The Words Land Lord and Tennant and Eviction are as strong now as They were in hard times here before the State was formed it’s a Sad 2024 that a Hard worker on a basic wage can’t even call his home his castle fair play Co.Councils 26 County wide those workers on small salaries Contribute it’s To be Remembered. God Bless them.

Terry, so many adults are living with their parents now. If they are not renters do they have any legal rights? I know of cases where parents cannot get their adult kids out and the kids cry foul and claim they have rights because it’s the family home. But surely that holds no water?

Terry, hello. Further to my other comment, which caused a lot of distress . When a tenant is replacing another tenant in a shared house, should that individual sign a contract. When there is, already, a contract in place for the original tenants. When no new tenancy is being created . 🎉😂

If they are wise, they will perhaps stick with licencee status for 6 months and then directly request tenant status after 6 months; as Terry explained. Walking in off the street, they have no right to demand to be a tenant. The tenant remaining on the lease is the licensor and they may become the licensee. If the property lease explicitly forbids subletting, then thats between the existing tenant and the landlord but none of the prospective licensee's business. Most landlords don't care once the money keeps rolling. If they did, governance would dictate that they would be notified of a tenant coming off the lease and another coming on. Bottom line, they DON'T care. Existing tenant is in a bind as they're giving an unknown quantity equal rights. Why should they?? 6 months in, the licensee acquires a better stake at the table. Yet can walk away scotfree before that. A licencee agreement protects deposits and other T&Cs. Sign that.

What stops a landlord to issue a licence agreement for a single self contained unit instead of typical tenancy instead; therefore contract is outside Tenancy Act?

Subletting in most cases is illegal, why is nobody doing anything about it? Its like wild west in Dublin rental scene.

When writing a lease, it is important to state that the property is for the named tenants, sole use. They they cannot sublet. 🎉

Not in most cases. It either is or it isn't. With small landlords, typically yes there's clauses to prevent it. From what I've seen with REITS, they dont care once the money flows as agreed. Why should an existing tenant hand over equal rights to an unknown quantity? F*ck that. Everything in life must be earned.
