I am getting flat which is not registered, seller has got possession 2 years back but never registered it. Builder will be taking 3 lakhs to do agreement of transfer to transfer the property on my name. Banks also asked to bring agreement of transfer for the loan sanction. Seller also have a loan which I will be paying by applying my home loan to same bank and getting the payment transfer from my loan account to them. Seller took loan using sale agreement which I think not registered. Please suggest is it safe to proceed with this transaction?

Secondly once builder hands over the society you can get the registry done with the help of a lawyer . Builders are not suppose to charge you any transfer fees for that .

There are 4 cases 1. it's a new launch, there is nothing on site, project is rera registered, developer is big brand and they are taking money in respective escrow account also the launch is on EOI modle or application modle then you can give a cheque if you are familiar with the location if not then visit the site first. 2. Project is under construction and rera registered then they should have a site office, in this case you should visit first check status of construction - cross check with rera update and then give token. 3. Project is non rera registered don't give any money 4. Project is ready then first visit the site and then give token. In this case asking money before site visit can be a scam as well. Any refund will take 30 - 60 working days.
