Resigning/Quitting a Job and Unemployment Benefits in California

I recently resigned from my job because I took a huge financial hit. They banished my position and offered me a very lower-paying position so I was left with no other alternative but to leave the company. I only make about $40,000 and I stood to lose about $10,000 a year if I stayed. Might not seem like a lot of money to a lot of people but somebody like me that's a lot of money that's a quarter of my yearly pay gone . I think I might qualify as good cause for leaving. I'll let you guys know how it went. This is August 13th 2020.

I had a conflict with a co-worker 15 years ago, she was fired because I had prove of discrimination. A month after she was fired our entire IT department moved to a new building. Out of an entire huge room with empty desks, my boss assigned my sit between two toilets. I sat in a cubical next to 2 toilets. He created an environment for me when I was forced to leave. I told him I'd leave" he did not just let me leave, but he made me sign a letter that stated that (I am leaving on my own will) I signed that will while crying and I was 25 years old. He escorted me out of building and also paid me for 2 weeks as if I was still working those 2 weeks. I did not have no vacation time so he just made HR pay me for 2 weeks. I still think about this ordeal. The thing with the co-worker was escalated and I was put through hell the HR sent us both to seek psychological help because I was the victim and harassed because of my nationality of origin. I never applied for unemployment but it took me a year to find a new job. I am wondering after 15 years, can I still file for unemployment benefits or sue my ex employer for wrongful termination? Thanks.

Hello, absolutely not. 15 years later all statutes of limitations for any possible claim have long expired.

Arkady, I was part of a management team, I tried many times to show my counterparts how to manage accounts and prevent working 14 hrs. a day, receiving customers complaints, running around correcting mistakes made due to incompetence, and most time working seven days a week. They ignored me and the blame rubbed on me because I was part of management. This began to be a mental ordeal because I had nothing to do with their incompetence, errors, and sloppy work ethics, all my assignments had good results. There were mornings that I dreaded coming to the office. I was mentally drained due to my counterparts negligence, one day I could not take it anymore and quit. Can I receive unemployment benefits? thank you.

+Armando Garcia Hello, Armando. I cannot tell for sure, but chances are that this did not rise to the high level of intolerable working conditions that would constitute good cause for resignation. It doesn't hurt to try and apply for unemployment anyway, but I would be (pleasantly) surprised if you ended up qualifying for benefits.

what about heart problems I had to quit because of very bad chest pains and I have doctors and lawyers to prove my condition

If you are unable to work then you may qualify for SDI - state disability benefits, but not unemployment.

my long-term boyfriend/future husband (we aren't married yet, but planning on getting married in a couple years), got a better job in Fresno 200+ miles away from where we were living in Los Angeles, so I had to quit my job in order to relocate with him. My job does not offer work from home for the position I had. Would I be eligible for unemployment in my case, even though we aren't married yet?

I won an unemployment appeal case against my former employer and got to continue receiving unemployment benefits. When my money runs out am I able to reapply or can I sue for constructive termination?

i quit as a shift lead for Walgreen's for assaults happening at night they have no security and i felt my safety was in jeopardy i was assaulted in front of that store a year prior and it was caught on Walgreen s security cam they recently fired a greeter but he was the one assaulted it also was caught on security cam. i have an appeal coming up and i am getting the police report i filed for the assault that happened the last week on the job where someone was stabbed and i called the cops do i have a chance to win this appeal? i quit by texted my boss saying i cant work there anymore.

I feel like I have no choice but to quit im instageted daily to point of me getting pissed at work they switched me to swing shift so now I never see my kids because of that I work 6 days a week drive 200 miles a week, can i get unemployment

Ok, so I resigned from Wal-Mart due to extreme stress and harassment. I wrote my 2 week notice as health reasons. They coded the resignation as career opportunities. I told the manager I am not quitting to go work for another company, I am quitting due to stress from lack of training, which has caused extreme stress, I am on high blood pressure medication. I have been harassed and denied a raise from a bad evaluation due to lack of training. Would I be eligible for unemployment benefits?

You are unlikely to qualify for unemployment benefits, but it's not impossible. An employee who resigns is not qualified for benefits unless there was "compelling, substantial" reason for resignation. Typical issues at work, such as lack of training, bad evaluations, denial of raise are not considered such reasons. Therefore, getting benefits under these circumstances will be an uphill battle.

Hi, this March my history of work going to be 2 years experience for full time job and my employer want me go for part time and I don’t want it can I apply for unemployment???

I was going to college and working and I had five classes and a lab class. It was getting too hard to work and go to school and I was afraid I wasn't gonna to pass my finals so I quit my job. I was getting financial aid so I didn't need money from employment at the time, but now that I have been denied financial aid I tried to get unemployment benefits and they denied me. they said I quit my job to go to school and that's why I'm getting denied, but it's not true technically I was already in school and I quit my job to get through it. Is that still considered quitting your job to go to school even if you already attending? I decided to go back to work while I'm going to school because it's not as heavy as a load this semester but they can only give me two days of week. can I apply for an unemployment again?

great helpful tips, I was recently discharged from work Ive been working at this job for only about a month, am I able to collect unemployment from this job and other jobs I've had within one year ?

Thanks for your kind words. Whether you qualify for unemployment depends on the reasons for your termination and also on whether you worked enough hours to qualify for unemployment.

Arkady Itkin i’m just wondering because I’m a quit my job I just have a week ther they just rally mad because I was 2 two minutes late and they just give us 10 minutes on break but I am employment already prove do you think it’s a problem if I quit and get an employment ???

I have a telephone interview coming up because I stated I quit my job. It was due to harassment and inappropriate behavior from administration. How do I prove that during the interview process. I feel as though it would be my word against theirs.

It will indeed be your word against the employers'. You should just answer the questions openly and honestly and try to give details, i.e. instead of simply referring to actoins as "harassment" be specific and describe what exactly was done to you that lead you to resign.

I am a manager at a busy restaurant, normally we have a management of 6 people. 2 people got hurt from the team and one quit leaving a team of only 3 people and a who lot of work. corporate is aware of the problem and has been for 2 months. I am on salary and the last two weeks I worked 160 hours when I'm only contracted to work 50 per week. would I be eligible because of work conditions or health and safety? ?

It really depends on other circumstances that are not mentioned in your question. You should discuss this with an attorney before making a decision on whether to quit or not.

Can I quit and get unemployment to take care of my disabled mother, to then look for work closer to her? She is moving in with me and I currently commute.

+francesgum This depends on other more specific circumstances, including whether you explored other options before resigning, such as taking time off, having someone else look after your mom, etc... You should discuss your options with an experienced attorney before resigning.

Am I eligible if I've been working at a company for a few years full time, I asked for part time just for a few weeks so I can attend school, I would come back full time, but the job declined as it is full time. I had no choice but to leave?

Arkady I quit my job 11/09/16 I was working the load of 3 nurses and we where understaffed my employer knew this but management did nothing about it I have real bad back pain and I was on my feet most of the day keep in mind this is a very busy office . The receptionists would make many mistakes in the patients charts and I would constantly on the daily get yelled at by the doctors I used to work front office which was easier on my back but then got moved to back office and I didn't mind until one of the nurses went in maternity leave and the other one on a stress leave. The doctor would constantly call me out of my name fue example heffa or bitch I found that very rude and unprofessional this job caused me to loose my hair because if all the stress so I asked my manager to please talk to the doctor about his misconduct with me and she never did. I really need a job am a single mother but my mental and physical health where declining. Do you think I qualify for unemployment?

Hello, Karla. Sorry to about your issues at work. I am not sure at all whether you would qualify for unemployment and whether you had "good cause' for resignation as defined by law. I would venture to guess that you do not based on what you described, especially if you didn't explore other options before resigning (i.e. complaining to hr, trying to transfer, etc...), but it can't hurt to try to apply and then if you are denied to appeal and present your side of the story to the hearing officer.
