Grace, the notice period is not a retrenchment benefit. It is a mutual obligation between the employer and employee enshrined in your employment contract. If you resign, you serve notice period for them to find a replacement. If they terminate you, they give you notice period in advance of the termination unless it is a summary dismissal with valid reasons. Waiver of notice period is possible with mutual consent, usually via salary in lieu of notice. Appalling how the notice period has been packaged and sold as a retrenchment benefit and "you get to serve the notice period"? This is gaslighting. You should have asked to leave immediately and get the notice period in cash if there is no retrenchment benefit. No point staying.

She did not have awareness in advance to counter this "abuse" nor have a proper guidance from anyone to take her side. I bet 99% of employee do not know their rights.

I'm 53 this year. Last year, my superior at IRAS told me that I have to consider quitting or moving to another department because the department do not need junior staff who only has Polytechnic diploma. It was a department I had been working at for almost 2 decades and suddenly they found me unqualified. When I asked if Singapore Polytechnic diploma is no longer a recognized qualification, my superior changed the topic and said because I'm a mother of 3 and had to take leave for the family when my children were sick (to be clear, every year I have outstanding leave that is not taken because I have been very committed to work). Imagine that a government agency looks down on Singapore Polytechnic diploma and women who have 3 children - why do polytechnics still exist? Why does the government want women to have more children? I told my children that they can consider migrating and don't look back. This country has become an elitist society where greedy, scandalous and hypocritical politicians governing a tiny country is paid many times more than those governing countries that are thousands of times bigger, and scholars running stat boards have no idea what the people out there are facing. How can Singapore sustain when it is so top heavy, and scholar executives at stat boards are only good at using tax monies without the ability to earn income from outside Singapore? Where is Singapore's future? Very sad and depressed.

Clarity, yes. Comfort? Cold. It's really appalling how Singapore's labour laws lag way behind even Thailand's!! Some of the guidelines can be easily hardcoded into law, such as advanced notification. Why even that is not instituted speaks volumes of the government's penchant to protect employers and not employees. I absolutely hate it when people say upskill or reskill. At a certain age, our minds simply are not at the dexterity level to absorb and process very technical information at such a fast pace. There will be a time when returns from upskilling and reskilling diminishes. Having that top up in Skillsfuture credits is just the government's way of throwing money at the problem, not solving it. It's another way of saying "sorry, you're on your own" to local employees...sad life of a SG farmer.

Honestly, there is nothing wrong to reskill or upskill to learn something new. BUT the main problem is even after finishing lot of courses, there are no jobs at all for you even though you tried your best to search and plus those tiring long processes for interviews there and here. They are NOT solving the root cause of the problems. Is all about Bandage Solution only!

If there's anything I ever learnt about working in corporate, that is loyalty means nothing. Business is business. There is no personal feeling. After 3 times of redundancy due to outsourcing, I got used to it and put all the redundancy package in a good use! I actually look forward to it, if I'm being honest. I still keep in touch with everyone in the company, leaving with good notes and again, nothing personal. Nobody's fault. That's just the current economy culture. We are no longer Boomers generation so seeing people working more than 10 years in the same company is quite a surprise to us tbh.

Layoffs is a reality that everyone should acknowledge. I used to be part of the management team of a global company and I had the difficult responsibility of overseeing staff reductions as we relocated regional operations to Malaysia as well as back to their home countries to reduce costs. It is obvious that individual who got layoff first performance worst than their peers, result them to be the first to go. Regarding reskilling or upskilling. While a short-term course in data science may provide valuable skills, employers often prioritize candidates with more extensive education, such as a four-year bachelor's degree in computer science. Many would not even get pass the resume screening stage. Skill future may benefit a few that were lucky enough, but certainly not that useful for many in job search. Let's be realistic, nobody (from a business perspective) going to hire someone who is older, less skilled and more expensive. Make sure you save and invest early. Financial freedom is the key.

MOM shd make more guidelines to protect the employees. Besides guideline on amount of severence pay, MOM shd enforce guideline on the minimum number of days that the employers inform the affected staff before the retrenchment day so as to give them time to prepare, and number of days the affected employees given time to sign retrechment documents like NDA etc.

Foreigners are getting all the jobs. MOM doesn't do anything. Even public service is temporary fixed term contract. No more job security and contract or hire till project funds deplete. Employees have no compensation and there will be more retrenchments to come. Middle aged and senior workers are all losing their jobs or asked to step down with pay cut. The reskills or upskills are not recognized even if government is topping up the skill future. Not just age or experience are not considered but qualifications and cheap labor. Ever got hinted by boss that his foreign workers are not only cheaper but efficient as compared to Singaporean.

SNEF president said hard-coding the amount of retrenchment benefits might have negative effect on employees a company can retain is akin to saying one should not give out too harsh punishment on parents who abuse one of the their child as the parents might not be able to take care of the rest of their children. It is very hard to believe the companies are unaware of their legal requirements. Many banks are doing or are thinking of retrenchment but they know if less than 5 people in any period, no need to reporr. Some of these NDAs and non compete are not enforceable but companies still try to push onto employees

Those employers who used to criticize the current generation workforce lacking in will and determination when it comes to work, this is how they treat their employees, chew and spit you out. Our generation these days work longer hours than any older generations with lacking job security like what the older generations enjoyed, not to mention stagnant wages if not lower. Instead of cutting their own fat salary, they cut employees with minimum wages in larger numbers and short notice.

*Overtime should be voluntary, and should not be mandatory. In the security industry, OT is voluntary in Theory but mandatory in Practice. People are made to work 12 hours, 5.5 days without any work life balance. People stay single because they have no social life and those who are married goes through divorce. Because of the absence of parents at home most part of the week, children grow up with lack of parental guidance. They either don't study well or just turn to petty crimes. MOM should make OT strictly voluntary in the Security Industry, if not don't WAYANG about the safeguards. I only work part time in the industry as a relief officer, but i have seen too much to keep zipped!* 🤦🤦🤦

I work in legal where we have advised companies near bankruptcy. Retrenchment occurs when the company or global economy performs badly, nothing to do with worker performance. Workers should stop gaslighting themselves by thinking it’s their fault / feel ashamed when they get retrenched. Sometimes companies can use “shame” against you so that they don’t have to pay retrenchment benefits or make you keep quiet. Of course there are genuinely kind bosses but mostly it’s just business and numbers (which the company ultimately relies on to stay afloat). Also beware of lawyers representing the companies; their job (and arguably ethical obligation) is to help the company (their client) get the best deal not the worker. This is clear from the contracts drafted where lawyers are given large discretion to draft clauses favouring the company.

Good job at Diana for raising the valid points firmly and fairly. Inviting different involved parties and getting reaffirmation round the table is certainly a good way to challenge the topic. Social media is a powerful tool to putting pressure for singapore unions’ parties to tighten the laws and to protect the employees. Sure, we can always look into upskilling, but there is no guarantee of employment for job hunting just becos you took a course that is the most popular industry. Finding the right fit in the employers’ market with so many applicants option for those who are employed snd unemployed remains a competition for those who needs a job , getting older with huge pay cut and have financial commitments. Laying off especially for companies during the year end and holidays have very little to no excuses. I was once layoff but fortunately after that over the next 20 years I never have to deal with that. However, I had witnessed my coworkers got laid off during the Covid time, and recession times. And companies made it worst by laying them off during holiday sessions especially around Christmas. On the other hand, a handful of people that they want to "keep" was given bonuses! We were supposed to keep quiet. They did it not once but two times in a roll. I quit after the second round of layoff. I called that a BS. Today, I am in charge of hiring for my department. I have this rule, unless it is absolutely necessary I will hire. My rules for layoff is the same... if it is absolutely necessary too. This is responsible hiring. Period. Company knows what they are doing and is rarely unpredictable other than Covid. Recession btw is not unpredictable. They are hogging talent so that the rest could not get them. I saw it with my own eyes that companies want to choke out competitions, so they will intentionally over hire.

On one hand, laying people off during Christmas and on the other hand, paying bonuses to those selected handful of individuals on the "to keep" list. Quitting for another gainful role is different from getting let go by the way. Jumping jobs benefits both sides. Employers can just hire another. When someone can switch jobs easily, market is buoyant. When someone is let go suddenly and sometimes unfairly, that's a whole different game and a loss situation for the employee not to mention if the person is old. Leaders should try their absolute best to protect every employees rice bowl, and be happy if employees find another better role. That said, unfortunately there are many faux leaders sitting in orgs.

Singapore labor law does not provide retrenchment benefits. Luckily my previous American MNC do gave us Retrenchment benefits according to the parent company country law. One month salary for every year service. Some long service personnel get as much as $70K plus 2 months bonus.

At the beginning of the video, Grace said she was part of the retrenchment. But from 11:20 to 11:30 she literally said she chose to resign instead of retrenched. No wonder she didn't get the retrenchment benefits. I also found it weird that she's very apologetic towards her ex-company and defending the reason why her company fired her. If I were her, I would be furious instead of being apologetic. If she said she's "resigned", the company will interpret it as she's volunteering to leave the company. If she fought to be "retrenched", it will be interpreted that the company is the one who's laying her off, thus she's entitled to other benefits. Where I come from, these two things have very different meaning. Never agree to say that you're resigning when you're in the middle of a retrenchment!

retrenchment is indeed usually the last resort. savvy companies just set unrealistic targets. so they never need to retrench. but keep hiring non-locals, never need to train or nurture locals, locals will always never feel optimistic with the economy. and like the conclusion of this video - either take a pay cut or start their own business.

I can attest to this. Many of my colleagues from Singapore have been retrenched while the company is expanding in Malaysia. Not just that, they only hired fresh graduates this time around. Basically, they just have to pay RM3,000, which is equivalent to 900 SGD for the same roles.

perhaps, every responsible operating business should consider providing compensation for every staff. This can start whenever new staff are onboarded. If need to, employer can consider buying staff compensation insurance considered?.

Retrenchment is like striking lottery. Got money to take one. Best if you can ask the company for assistance on career coaching matters. For every person out there working for a company, loyalty = no value. Imagine you 10 years do same role, never upskill , never move department but up pay. You become a cost factor that has a bigger target board for senior managers to aim you only. You can bring in their biggest clients for the company and score big wins. When come to cost cutting they don't care just whack you only. So as workers what we do , we are responsible for milking them as much as possible before we have no value. Then we move on to milk another place and repeat the same thing. End of day whether company around or not we don't care , because they also won't care about our lively hoods as we are their tools for their objectives. And is true this kind of exercise you can see how rotten the company really is or how humane they are.

It’s a scary process and hard on both employers and employees. Regardless of duration worked, business is business. Employees will need to constantly up skill and stay relevant just to protect themselves.

Then they fire you lo. EA says employer not obligated to give a reason so long they fulfill contractual obligations of compensation. It happened, employer didn't like someone, made life difficult, yet he hung on. He was eventually fired but given his 2 months pay. A foreigner came to take his place.

The proper question needs to be "How Singaporeans should be protected from Retrenchment". I wanna puke hearing Grace's remarks cos its blatantly obvious she is there to say politically correct things. No wonder she chose not to hide her face. Come on, if your company valued you, they wouldn't have asked you to go !! And you are still there kissing up to them? Are you fking kidding me? The corporate guests were also there to make all kinds of convenient excuses for companies laying off people. It is particularly lame and sickening for the SNEF guest to repeatedly regurgitate on so called "Tripatite Guidelines" when those do absolutely nothing to protect the interests of employees. End of the day, what people are asked to do is the constant government useless narrative of "upskilling". As if doing some course is magically going to land you a job that pays you the same rate.

a "guideline" stay as a guideline because it enable decision to go either way. The company in question that provides better economical gain will have decision in their favor while a smaller company that doesn't really count much will see the retrenched employee coming ahead. In a society like SG, this is how it is.
