It unfortunately doesn’t qualify as fair use. It could definitely serve as a substitute for the original episode - the same way putting weird marker tags and stuff on a bootleg version of a movie doesn’t transform it enough for it to be legally viable. You could almostttt call this fair use if you got someone to recreate the voices and stuff too (see Shrek: Retold). That being said, I completely agree that Viacom would be *way way WAY* better off just monetizing this video instead of trying to take it down constantly. This is a testament to how much people - and especially animators - love this show, and have reimagined it spectacularly. The fact that they keep trying to take this down is a spit in a precious subset of their audience’s faces.

For those wondering, the track played at the end of the video, the one after Sweet Victory, is Flutes Of Chi by Ween, one of Stephen Hillenburg's favorite bands. Their album The Mollusk was actually part of the inspiration for SpongeBob, and they ended up writing the song Loop De Loop, which appeared in the show. It could definitely serve as a substitute for the original episode - the same way putting weird marker tags and stuff on a bootleg version of a movie doesn’t transform it enough for it to be legally viable. You could almostttt call this fair use if you got someone to recreate the voices and stuff too (see Shrek: Retold). That being said, I completely agree with most commenters here that Viacom would be *way way WAY* better off just monetizing this video instead of trying to take it down constantly. This is a testament to how much people - and especially animators - love this show, and have reimagined it spectacularly. The fact that they keep trying to take this down is a spit in a precious subset of their audience’s faces.
