The original script was by Nick Cassevetes about Junior's life and based on his book detailing his life under his dad. Pesci was even cast as Ruggiero. Then it languished for years in development hell for whatever reasons until everyone good had left the project, and it was turned into a by-the-numbers biopic about his father instead. It has the rare honor of being one of the few 0% films on Rotten Tomatoes because, as I often say, it's a movie that did literally everything wrong.

Hence why the Genovese family isn't called the Luciano family among other examples. The names we use today were the bosses of each respective family when Valachi told the world.

Persico acted as his own attorney during the Commission Trial to make the argument that yes, that life exists, but it inherently isn't a crime to simply belong to an organization if the government can't prove the ones under indictment had personally committed or ordered crimes. It obviously didn't work but the judge in that case still went on the record to say that Persico was one of the smartest people he had ever observed and how it was a tragedy that he chose that life. Otherwise, RICO was a cheat code invented by the government when they couldn't get these guys with traditional criminal charges. There is a valid argument that the main facets of the law aren't Constitutional but regardless, you can't beat the government, and they certainly allow all sorts of legalized robbery and crimes when it comes to conglomerates and big business to commit them.
