the reason the dentist knew he would win is because of the unfair consent form they tell everybody to sign or else they wont get treatment. it should be illegal for dentists to get away with this especially at the prices they charge . the consent forms basically get them off the hook even if they ruin or pull every single tooth in your mouth and i will never sign one . the rest of society has to take responsibility so why not dentists also . this dentist caused the pain because he over drilled and over filled into the plainiffs jaw .

You do understand than any major or minor operations can result in death or major injury or even failure right? 💀💀 you literally sign consent forms when you’re at the Dr’s office there can be a easy small operation but there can still be like a 5% chance or failure, death, or injury 💀💀 the only nightmare here is you thinking every operation you do is 100% success rate 💀💀💀 it’s sad that there’s adults like you who think like this 💀💀💀😭😭😂

That's why, when my dentist gave me the option between a root canal and pulling the tooth, I said "pull it!". It was the tooth furthest back in my mouth anyway😆😉. it was 10 x cheaper and faster😆.

I knew they didn't have a case. I worked in dental for years and it's unfortunate that damage occurred during the root canal, but there's always a risk during dental & medical treatment. There's a reason his general dentist doesn't do root canals and referred him out. What's even more unfortunate is the ridiculous cost of dental & healthcare which is out-of-freaking control, I get why people are flocking to Mexico & Colombia for dental treatment!

well if endodontists are root canal specialists then they should not get to be off the hook if they screw up the job . it was not caused by a complication out of the doctor's control but it was caused by the endodontist who drilled and filled way too far into the patient jaw and that is malpractice but the consent forms , which should be revised and not legal as they currently are , is the problem .

I went last month to get a tooth pulled. Worse experience ever. I was in excruciating pain, my tooth didn't numb. Dentist tried to yank it. I felt it all. Worse pain ever. I cried. But she broke my two front teeth in the failed attempt to pull the tooth.

A root canal re-treat is horrible! i've had one done. i can't imagine suing the dentist because it had to be done again, or you needed a new crown for it. That's why it's a dental "practice", nothing is for certain. all they can do is the best of their medical knowledge and sometimes things happen.

Keep your oral health together so that you don’t end up needing repairs that are risky and could cause more issues. The plaintiff wants to go around the fact that he didnt take care of his teeth causing him to need a risky oral surgical procedure. These procedures are risky and wouldnt have to be done if people took care of their health. Good going for the doctor for having the waiver. Endodontics, dentists, and other doctors dont generally set out to harm people. They do their best with the tools and knowledge they have to repair you.

Chemo and radiation treatments Destroyed my teeth! I suffered through 14 root canals and spent in the neighborhood of $25,000 on trying to save my teeth over a 9 year period. I paid every penny out of pocket and had dentist not worked with me, I'd have spent Thousands more. I lived in severe chronic tooth pain that entire time. Before I was 30 I had a dentist pull 11 teeth and fit me with partials. Right before I turned 40 I Finally found a Fantastic dentist in Michigan of all places, who agreed to having ALL my remaining teeth pulled and fit me for full dentures. At that time I had 17 of my original teeth left, NONE of them had been root canaled. It cost me $5,000 to have an oral surgeon remove the remaining teeth and have a full set of dentures made. I HAVE NEVER BEEN HAPPIER! Dentists want to "save" teeth because that's how they make their money, period. As a cancer patient you'd have thought they'd have been honest with me instead of treating me like a cash cow.

I had the same situation. Chemo destroyed my teeth. There is Zero dental aid for people who are sick, or hurting. That is a shame. I ended up with partials. I am still paying....for the rest of my life

My teeth are ruined by a bacteria that also stopped any growth of my vertebrae which were broken plus the years of heavy medication during this period. I am NOW finally getting started with taking all of these extreme painful suckers out and finally getting dentures. I am scared like crazy, but focusing on the end result: no more pain and being able to smile openly again!!

I've had multiple root canals including two that failed, if they fail because of fracture I have been told by more than one dentist they would never retreat it with another root canal

My sister had to have like 3 root canals done and then finally have the tooth removed. She had three roots in that one tooth. It took over a year and thousands of dollars of care for them to finally say, "oh hey, we need to remove this tooth." I had said six months beforehand that they needed to remove the tooth. No one listened. I'll NEVER get a root canal in my life because of the risk of failure. I'd rather get partials before a canal. But that's just me though. I've also had a sucky general dentist who didn't completely fill my cavity properly. I was 12. He didn't use anesthesia either....

It would be wonderful if oral surgeons had live x-rays that would help prevent the occurrence of tooth breakage and other issues, but they don't, and sadly, that would hike prices up way more than they already are.

@@TooLooze and one last thing too: WHO you have for insurance affects your care as well (although they try to claim that's not true). My incident happened while I was on Medicaid, and my sister was covered by one of those share insurance types. When my hubby was on traditional insurance, we nearly got charged $1,000 for four fillings and general anethesia. He only needed one tooth taken care of, and local anesthetics. We paid just over $100 after insurance reimbursements. 🤦♀️🤷♀️

I had this done. An infected tooth is the worst pain I've ever had. Wanted to rip my head off. Old filling broke off. Got a crown. Got a cleaning. Got infected. They drilled through the crown to do the root canal. All done. I wish they had done the root canal at the same time as the crown.

Those papers that they have you sign quickly that is just full of words always absolves them of any issues. If you don’t sign them they won’t do the procedure so nobody really has a choice. You either suffer in pain or possibly die or you sign that they’re not responsible for anything wrong.

NO, you don't have to have your crown removed because I had it done with the crown INTACT. The endodontist just drills through the crown and does the root canal. Then the dentist refills the crown. If I hadn't had it done I wouldn't know this.

I've done a rootcanal twice after a failed rootcanal... it had to be opened up by drilling, and it was horrible... we had to check 3 differen teeth because they didn't know it could be an already finished rootfilled tooth...because you couldn't tell by x-ray... the doctor her did nothing wrong

those risk waivers that you have to sign in order to get work done should be illegal as they now are worded. There should be other options. You're in pain at the reception desk . . . you desperately need to get the work done. Once you sign that . . . the Dr can be as careless as he wants. That's just not fair to the patient.

A waiver isn't so that the Dr can be as 'careless as he wants' but so that he will try his best at doing what he is supposed to do. But there is a risk of failure and/or further treatment to get to the same goal...

The question that was asked to the judge's at the end was interesting. I had always thought if you did work for someone you buy all the supplies and items needed for said job, then do all the labor, why can't you destroy it? If you purchased the supplies then it should be yours to do what you want with.

He should've been professional enough to document everything and let the court system handle it. Also if he didn't wanna go through this hassle he could've made the person sign a contract to pay a certain amount upfront for materials and then the rest when it was time to do labor.

Dentist well most of them I’ve encountered suck. I’m so tired of paying dentist to mess my teeth up only to have to pay another dentist to fix. Dentist offices have become like a fast food chain. Bought up by corporate offices to get rid of self ownership.

I like the judges commentary at the end. On this one, though, she said you go to court, sue and get your money. No, you get a judgement. Then a collection agency may get involved, etc. It's a long process.

Many of these doctors no matter the field are horrible. They don't give a shit about the patient but more so about billing the insurance companies to fill their own pockets. This is why many don't trust them at all.

I had a root canal done years ago. Not enough insurance. Worked and got enough to pay for it. After it was done it hurt ,kept swelling and kept being told by doctor to give it more time. Money eas catalyst for this .They even stopped appointments .I saved enough to go to oral surgeon and there was a visible nerve left in face and right side of face turned black. Then my original dentist though he might need to reevaluate and said he missed it. Pain is real and some physicians try to convince you it' s not. There are a lot of excellent physicians. *

"You should know what the waiver says before you have the work done" maybe if documents were in English that people could understand instead of legal jargon then people wouldn't just sign without reading it...it's sucks to read through like 10+ pages of word vomit and be completely clueless as to what it's saying~

Interesting that American English and British English used to be the same thing, now our accent is much different, we don't sound British anymore ,,, except for ONE word. Aunt. The British pronounce it as ONT and so do we, but why ,,, why preserve the British pronunciation of ONE WORD and to hell with all the rest ,,, why ONT?

It's been my experience that the people in the area I grew up with said ant, I've only heard it pronounced as ONT on American and British television.
