The only things required were that the executors had to sign the papers to transfer the title over to me, and I had to go to the DMV a pay a $40 fee to process the paperwork. It wasn’t that hard, it took the executors about 5 minutes to fill in the paperwork, and it cost me $40 and time waiting in line at the DMV, and this was 20 years ago.

The defendant is lucky that the judge did not just rule for the plaintiff when the defendant kept interrupting her. Let's say that the defendant was telling the truth and that he did not know that there was a lien on the truck. He still is responsible for selling a truck that is not even supposed to be sold. I do not think that you are allowed to sell a vehicle for parts when there is a lien on it because legally, it is not yours. But when you sell something, you are responsible for knowing about that item and if you are even legally allowed to sell it. The defendant was lucky that the truck was not stolen. @stevebutler8122 жыл бұрын
You cannot legally sell a car you do not own- The Lienholder owns it. Its a "voidable" sale because its illegal. Often you sell with a Bill of Sale and you can take this risk. But, the Lien may simply need to be cleared if it was paid off. For example: Tow Yards, Estate Sales, etc, can sell a vehicle but DMV fees can be owed before it can be registered.
