The “no data collection for under 13s” is a really dumb rules since there’s no way to know whether or not a user is actually 13 without first collecting their data. It also runs into issues with voluntary rating agencies such as ESRP. If a game is rated “M”, that does not mean it cannot be sold to or used by 13 year olds. That means there is a recommendation in place that it not get sold to or used by 13 year olds. It’s like when you go to the movies. There’s really no reason a ticket seller cannot sell a 13 year old a ticket for an “R” rated movie. It’s not a legally binding system. The irony is that because it is a voluntary system, the theatre cannot also ask you for ID. However when it comes to the internet this suddenly becomes a catch 22, because what has been criminalized is the attempt to determine identity as well as the selling of the ticket.
