Good info Rubeauti, I think a lot of the responses below do not reflect an understanding of the information you were giving... I've been going to the Philippines for the last 30 years... as that is how long I have been married to my pinya girl. We have had several properties for years and I still keep my looking for the good deals on property. The Philippines is a magical place with the mountains rolling down into the sea.. You are a great example of the beauty of the people. Keep up the great work. .... and thank you

Are you a Philippines citizen or do you buy land in your wife's name or her family name. Farangs aren't allowed to own land in the Philippines, ask a lawyer or listen to the ones on the Filipina pea channel.

From a legal perspective, this is probably a gray area at best. Opens up the possibility of putting yourself in danger. Maybe one day the Philippines will make its laws a little less hostile to immigrants, but until then you should avoid investing there.

There is another way to protect yourself. This is how I did it. I created a corp my wife created a corp . She took 60 I took 40. My corp loaned the money to her corp. after 3 non payments I put the loan in default. Then my corp got a judgement against her corp where the land was collateral. Now my corp holds full judgement first position of the land. She can’t sell it as the loan is worth more than the value of the land n dwelling as it accrues penalties n interest. This way my interest is covered in perpetuity.

The only mistake I see here is that you cannot open a company with 100% of the shares in the name of a foreigner. Are you both (you and your wife) in both companies? Or if not, who is the other Filipino who owns 51% of the shares of your company?

None of these various schemes will stand up in court against the Anti-Dummy Law. Continue deluding yourself. When and if you wife (or any heirs or beneficiaries) has an incentive to go after you, then you will lose. You have achieved nothing. All the Filipino has to do is file a case and the foreigner is not only going to not have any control, but he is also not potentially going to be prosecuted and go to jail. You and your wife are attempting to subvert the law and I would if I were you unwind that situation to avert criminal liability. You should consult with better counsel immediately.

interesting but that is skirting the law. the effect is that your corp has a lien on her corp. that's it. let's look at the worst case scenario. you separate. she gets the property. the loan is just a loan. it can be paid. her corp can sell it and pay the debt to you. she can also prove that there was no loan at all (unless of course, you did deposit the loan in her corp.'s account and not just on paper). we have a surfeit of cases previously decided by the supreme court about foreigners owning real properties. the best protection is actually to love your wife and be loyal to her. sometimes, that is enough. btw. condos are not "real properties", ok? foreigners can own them

No way as a foreigner would i buy property and put it in someone elses name. GREED has ruined many friendships and families. That is a recipe for disaster. Also, anyone who has been in the PI knows that the court system may get around to your case in 10 years or so. This means if someone has sold the property do you really think the filipino will have your money in 10 years lol. They won't have a peso left of it in 30 days. You can't get, what they don't have!

People have this urge to own real estate, a home, especially if it is much more affordable than their native country. But it really is not a good idea if you don't have the right to own in your name and/or legal protections, etc. are less than fully robust. Resist the urge. Renting gives you ultimate flexibility and freedom in an uncertain world.

I'm a retired real estate Broker and have lived in the Philippines since March 2020. A foreigner CANNOT OWN (Fee Simple) in the Philippines. Real Estate Law IS very similar to the real estate law in the Philippines except that foreigners are explicitly denied to OWN real estate (including the land beneath the home) in the Philippines. However, since Condos are defined as the interior surface of the Condo dwelling, (excluding exterior and ground beneath) it IS legal for foreigners to own Condos. Do NOT attempt to "own" any real estate in the Philippines. Any scheme to have "ownership" will at the very least, require you to have a very good attorney. You CAN also lease up to 25 years.

No, not possible for lands, only for buildings. Its against our Constitution. Please do not be fooled by sellers! This is not a good advice to foreigners. Options: 1) Dual citizenship for former natural born Filipino citizens - they can own lands of course. 2) Form a Corporation with majority shares owned by Filipinos 3) Lease agreement for 25 years + extension is possible - better option and safer in my opinion.

forming a corporation: how secure is the land? let's say you have 40% other guy has 60%. will all things you paid for belong to you then? I pay for the land, he is "responsible for other things". him having 60% of the company how can I have control over the land?

@@jpjay1584 You have to do it the right way, a company can be structured in different ways, the formula would be 51% of "Filipino" shares (it does not have to be just one, it can be for example two Filipinos with 25% and 26% of the company) and you have 49% of "foreign" shares, but with the difference that your 49% must be common shares and 51% of Philippine shares must be "preferred" shares.. this way your 49% has more decision-making power in the company than that 51%... although 51% would have other privileges that you would not have, such as, for example, if the company goes into bankruptcy, they would be the first to collect (assuming that they had actually put the capital as a result of that 51% of shares that they own when the company was formed

I have a filipino buddy here in Canada who owns a resort in Palawan, he has told me that if you do the company process your company can own property, but I wasn't entirely sure how the realistic company structure broke down.

a foregner cannot OWN a property in the Phillipi9nes....if the deed is not in YOUR own name you do NOT own it.;...even a condo a foreigner can only own 49 percent....so that is NOT true and you need to stop telling people that. There have even been cases where the foreigner paid for the property but because they cannot own it only the filipina they put the property in their name built a house on it and then kicked the foreigher out only to end up homeless and broke on the streets....bad advice!!! go on to the filipina pea channel and lookup the episoded of attorney gracie over there telling us foreigners about this....and also the realtor over there she interviewed as well.....and renting or leasing if not married to a filipina means nothing..

Unfortunately, it may not be enough to trust the person (spouse, friend or other) who will hold the legal title to your land. You will also need to trust the people who are likely to inherit the land, if your trusted person unexpectedly dies before you do. Inheritance laws, particularly with respect to land ownership, in any country, are always complicated and too frequently result in disputes - and legal contracts, incl. lease agreements, may or may not survive the death of the original party on the contract. Just something perhaps to be aware of, when asking questions of a lawyer.

Step 1 - research local lawyers that you are considering to help you with this land acquisition Step 2 - hire another lawyer from a different province/island to do a background check on the local attorney you're considering to retain Step 3 - if the local attorney checks out, proceed with finding property with clear title Step 4 - get married to Rebeauti and put everything in her name........I'm sure it will be fine, just fine 🤞

you might consider a lifetime dowry for yourself, with a wife as secondary dowry holder and your first born child as the deed holder , its how my family has transfer property one generation to the next for around a century here in Kentucky , its away of keeping small family farm from being sold off quickly as it does lock deed up for long periods (also prevents any leans), and any piece that gets sold off has been considered for over 20 years before its becomes possible .

I like that law that land and houses cannot be sold to foreigners. This is something my friends here in Australia complain about that our houses and land are sold to rich foreigners and this skyrockets the price for us locals. Permanent residents in Philippines can obtain citizenship after 5 - 10 years. Problem solved. Drawing up a lease agreement that gives you sole right as long as you live has the problem that someone in the titleholders family could be tempted to shorten your life. Otherwise just long term lease an established place or get a condominium as specified under the law.

To be honest, no matter how hostile this is to foreigners like me, I have to agree - if the Philippines and other similar Asian countries didn't do this the property prices would be most likely insane for locals. For example Rubi mentioned that that small area on the beach costs 4M pesos... It sounded like a lot, then I googled it and saw that it's 65K EUR. Even I could just buy it without a loan, even though I'm not a rich person by any means.

My understanding is that it’s very difficult to obtain Filipino citizenship if you are not ethnically/racially Filipino. Furthermore you need to renounce any/all previous citizenships which for some is problematic to say the least.

Gentlemen, NEVER buy property in someone else's name! Don't be stupid; there are too many horror stories. This goes for the Philippines, Bali/Indonesia, Thailand.... Just don't do it. Either legally buy a condo in your own name or via a company fully in your name, or lease. Don't buy anything you don't retain complete control over, because you're always leaving yourself open to being defrauded by the other party. You don't need to search very much to find lots of examples of men going bankrupt because of this...

We live half time in Valencia and half time in Enrique Villanueva Siquijor. Sometimes we go to San Juan or Salagdoong Bch in Maria or Paliiton BCH in SJ for lunch or dinner and for picnics and swimming etc... Both places are beautiful...check out Valencia some time.

The government should just sell licences to foreigners so the land still belongs to the Philippines, the foreigner has his house. That way it would stop foreigners being ripped off and is a way for the Philippines to make money.

Why do you think they have this rule? Licenses for foreigners ? Might as well abolish the rule. Look at the USA and or Canada. Foreign speculators have ruined large portions of the many cities. If they abolish foreigners will but up huge lots and never move there. Investment speculators

None of those options sit well with me. All I see is a high risk opportunity with an average reward. One of my uncles has been married to his filipina for decades and they built a house out there. It worked out for them, but I think we're in different times now.

My situation i meet and married a filipina in usa. When i retired we bought several pieces of land .4 lots total approx 7000 sqm my house was on 2000sqm. After 21yrs of marriage my wife became sick with cancer and passed away. Her children from a prior marriage who i supported all those years wanted me to just leave so they could have all. I already gave them 2/3 of land approximately 5000 sqm. But wanted my house and lot. All the titles had my wife as owner and me as spouse. They even took it a lot further tried to kill me when i was getting in car. Still have bullet hole in driver's seat. I got lucky. A foreigner can't own land. You can lease it, and own the building you put onto that land (although at the end of the lease, maybe the building reverts to the landowner)

I like the lease idea. If you get a chance, please talk about taxes on leased land, and things like bad weather issues. No place is perfect, but some are closer to perfect than others. Also, I looked up the USD to PHILIPPINE Pesos. It's amazing the USD is still worth anything. I keep thinking the USD will implode any day.

This issue is real. As a dual citizen in Canada from Jamaica, I can see the problem from both sides. First world countries are more liberal with selling their land because their laws are robust and economy strong. It is highly likely that most of the land will be bought up by nationalists, or those about to become nationalists. On the other hand, the non-nationalists buying land generally only end up boosting the economy with almost zero ability to foster harm. Developing countries on the other hand, generally see the opposite result. I've seen it time after time when I lived in Jamaica. Whole swathes of land being owned by foreigners that promise to boost the economy. Some do, but most don't. Right now there are way too many empty plots of land just sitting there doing absolutely nothing but appreciate in value. The locals can't touch them, but the demand for land keeps skyrocketing every year. Even the beaches and highways are being owned by foreigners. I am 100% sure this is happening all over the world in developing countries. Of course the investors aren't at fault, as opportunities are meant to be taken. It's the lawmakers and government that allowed foreigners to basically own the entire country, because they were too stupid and didn't set a limit or restrictions. Unfortunately these are things that happen in reality, everywhere. So I can definitely see the horror and reason that the PH government is concerned about. Of course, the laws could be slightly tweaked to be less hostile to foreigners who are looking to settle. Nobody wants to wait 5-10 years to own the land that they built their homes on. Most people also don't want to give up their citizenship either. Although I'm not liking the direction Canada is headed, I definitely wouldn't give up my citizenship. At most I'd move elsewhere and stop being a Canadian tax resident. I can't see allowing foreigners to purchase limited amounts of land for the sole purpose of building a home or a local business to be a bad thing. Leasing or buying through an intermediary sounds good and all, but it doesn't eliminate the underlying danger to the foreigners spending their hard-earned money. This situation doesn't have to be as painful as what has happened in Jamaica. A balance without infringing on the government's control could be achieved with a little brainpower and less hostility towards foreigners from the government's perspective.

Try to transfer the title to your name and you will see that you can not get the owner as a foreigner. Do not let them fool you. There is only one condition a foreigner can get the legal owner of a property including title. If you are married to a filipina , she owns the property and she dies. Then you can get the legal owner on parts of it. How big the part is depends on a testament, if you have childs etc.

I don’t think she said to marry just to buy land. She said if you are married the best person to have the land title in it would be your spouse. Of course. Then you draw up a lease where she leases the land and house to you for 50 years or so Then, if you have a problem together, you stay in your house It’s a pretty simple process, and a lot of people do it in the Philippines

You really do not own the house either as the lessor can essentially force you off the property. Really foreigners should not be getting themselves involved in such quagmires. Do not do it. Only if you are married to a pinay and realize that some Filipina wives have poisoned their foreigner husbands so they could take control of the assets. I knew one who did this.

@@kenamaro actually it was not always that way. Some foreigners own land on an island off the coast of Southern Mindanao as they were grandfathered in from when Americans used to be able to own land in the Philippines. I think it was before WWII or something like that.

Thru succession is the only way for a foreigner to get land and I'm pretty sure you have to sell it as there's a time limit if your non Philippines born. a Philippines born can own land 1000 sqm in manila 1 hectare in a province but if your in a foreign country you must declare it on your pension income etc. in that country .

And in that case can still never be the majority owner and suffers the risk of losing the property entirely if divorce ever occurs. And divorce is extremely difficult in the Philippines as it is not legal for a citizen to divorce. The Foreigner has to go get the divorce in his or her country and then have it approved by the Philippines. Quite the process. Also if you're living in the Philippines it might be difficult to divorce back in your home country if your spouse is not willing to travel back there. Very complicated.
