I read the OP Ed by Alan Dershowitz. While he disputes the arguement of the court with regards to guliani's first amendment rights as a citizen, technically there was due process. The ruling was issued through the new York appeals court. As per Dershowitz: "The court citied a rule allowing disbarment for conduct, including speech that "adversely reflects on the lawyer's fitness as a lawyer." As per the court: Giuliani "communicated demonstrably false and misleading statements to courts, lawmakers and the public at large"
