I'm a Reagan Republican with a fond appreciation for Ruth Bader Ginsberg. I agree with her on many issues involving women. She is a credit to woman, and someone women should emulate. However, I strongly disagree with her about abortion. I believe the fetus is intitled to due process guaranteed to a Right to Life protected by the Constitution. I am a woman and I look at choice for women as we have a choice whether or not to conceive, rather than whether or not to abort pregnancy. However I understand there are many circumstances where in these times, with many children already without loving families, a woman will deeply desire access to safe abortions. Abortions and drugs will be done whether people like it or not. However there are those who think women who abort babies and drug addicts deserve to engage in those acts safely. This is where public discourse comes in and we exchange ideas and persuade ourselves to reason towards the right direction for the time.

She was brilliant. But, what she was not able to do was stop legislating from the bench. Our constitution provides for a way to change our laws. Constitutionally it is the roll of the legislature (house and senate) along with the the executive branch to make and carry out our laws. It is not the roll of the judiciary to make new law. The roll of the judiciary is to determine the constitutionality of each law-whether they personally like the law or not. This is the correct allocation of powers. Judges and justices need to honor that allocation of power and "stay in their lane." This will preserve our constitutional republic. If a justice wishes to legislate they should resign and become a senator or congressperson and make new laws. The judiciary should not legislate.

The constitution should be interpreted as a living document, social change cannot be bound by the shackles of constitutional constraint just because there are those who are unwilling to accept that contemporary society is not the same as it was in 1787. The same argument could be said for the interpretation of the Bible. Very few people live their lives by the laws of Leviticus because many of them are generally regarded as being outdated. Of course it guarantees the right to hold human property, while many of the founding fathers disagreed with the concept of slavery, they protected it for the security of the union. Article I, section 2 and article IV, section 2, off the top of my head. I did not say that the Bible is outdated, I said that many laws set forth by Leviticus have largely been discarded by the wider Christian community (e.g, not mixing fabrics, not planting different seeds in the same field etc). Clearly the Bible is open to different interpretations because you have so many denominations of Christianity, who is anyone to say that one is more correct than another? Why should seeing the constitution as a living document be any less valid than seeing it from an originalist perspective? Interpreting the constitution is a difficult process, on the one hand, it guarantees certain fundamental basic freedoms and yet throughout our history we have seen the second class citizenship of women, African Americans, LGBT people, Native peoples etc. Maybe it is liberal and naive of me to hope that the constitution can allow for equality but that is just my view. I called you ignorant because I interpreted your comment as you implying that I am stupid, despite the fact that I have studied politics and international relations at college for the last 5 years. Perhaps we can appreciate each others views and agree to disagree?

Most of the time there is intellectual give and take from the bench. Sometimes there are opposites that make an intriguing kind of sense. They don’t sit to make law or decide who ought to win. They decide WHO wins under the law that people have adopted. If Justices not only tolerate each other, but care and respect each other, they are able to attack ideas, not people. Like humans, they have their flaws, but overall, if they follow their heart and never compromise their principles they can do an extraordinary job for their society. How many politicians do that ???? We are headed down a very dark road. The hypocrites in power will see to it that our democracy will continue to degrade until it is nonexistent. With her gone the Supreme Court will likely take us back to 1950. I doubt the senate will hold itself to the standard they imposed on the previous president. Another Trump appointment and this country will pay an enormous price. Rest in peace RBG. A lot of the living have none now.

She warned her peers and the American people that ROE VS WADE would be overturned. They denied the case she came up with, that I can only imagine would have been stronger and constitutional if passed. To see politicians encourage people to yell, complain and cry instead of teaching them why it was overturned and how to make it an Amendment is disgraceful.
