Supreme Court Appointment: Just so we're all clear here, the Constitution gives the President absolute power to "nominate, and by and with the Advice and Consent of the Senate...appoint Judges of the Supreme Court" regardless of when the next election is. "But Merrick Garland!" is not actually a valid argument. The Constitution gives the Senate the authority to "advise and consent." It did not consent to Garland's nomination, so Garland did not get a vote. The Senate back then followed the so-called "Biden Rule"--named for, ironically enough, Joe Biden, who in 1992 said that when a vacancy arises in an election year and the White House and Senate are CONTROLLED BY DIFFERENT PARTIES, then the vacancy should not be filled until after the election so the people essentially have the final say. Here, Republicans control both the Presidency and the Senate, so the Biden Rule does not apply as it did when Antonin Scalia died in 2016. There is no valid argument--Constitutional, legal, moral, or otherwise--for not filling this Supreme Court vacancy immediately. Whether it is politically wise, is open to debate, but it is absolutely lawful and proper to do so." Infamous Democrat quotes regarding filling the Supreme court vacancy: "When there is a vacancy on the SCOTUS, the President is to nominate someone, the Senate is to consider that nomination... There's no unwritten law that says that it can only be done on off-years. That's not in the Constitution text." - Obama in 2016 "I'm going to do my job. I'm going to nominate somebody... It's not as if the Senate calendar is so full that we do not have time to get this done." - Obama in 2016 "In my 36-year tenure in the United States Senate - nearly half of it as chairman or ranking Democrat on the Judiciary Committee - I presided or helped preside over nine nominees to the Supreme Court, from both Republican and Democratic presidents. That’s more than anyone else alive today. In every instance we adhered to the process explicitly laid out in the Constitution: The president has the constitutional duty to nominate; the Senate has the constitutional obligation to provide advice and consent. It is written plainly in the Constitution that both presidents and senators swear an oath to uphold and defend. That’s why I was so surprised and saddened to see Republican leaders tell President Obama and me that they would not even consider a Supreme Court nominee this year. No meetings. No hearings. No votes. Nothing. It is an unprecedented act of obstruction. And it risks a stain on the legacy of all those complicit in carrying out this plan. I would ask my friends and colleagues - and all those who love the Senate - to think long and hard before going down this road." - Joe Biden 2016 “I would go forward with a confirmation process as chairman, even a few months before a presidential election, if the nominee were chosen with the advice, and not merely the consent, of the Senate, just as the Constitution requires.” - Joe Biden 2016

@@freelightway right, so ending the lives of the unborn is the answer. Sick leftist mindset. It is infanticide. Juan El Bean, honest, curious, non-snippy question: what are your thoughts on in vitro fertilization? Around the world, countless ‘backup’ embryos are frozen - never given the chance to be born. Edit: and of course cases like the Octomom are rare enough to merit a TV show. Typically the doctor will implant many, assuming nearly all will miscarry. That seems pretty heartless - why don’t conservatives advocate against IVF? Honest question.

As a liberal I liked her but as someone who loves to practice, her comments about wanting to ensure a Democratic president guarantees her replacement, is a complete lack of respect for the system. She's a judge not a politician. Remember a REPUBLICAN put the first woman in the chair not a Democrat.
@DownhillAllTheWay2 жыл бұрын
She must have realised that she might not live for the next four years, but like all people, it seems, who hold some high office, they will cling onto it till the bitter end - and well beyond the bitter end in Trump's case. But she didn't live for the next four years, so she was replaced under the auspices of Donald Trump. It would have been much more patriotic of her to go when her replacement would have been more predictably advantageous to the country. At 9:30, she says "I don't think that a Justice should have uppermost in her mind, 'a democratic president appointed me, so I must leave to ensure that another democratic president can appoint my successor" That worked out well, didn't it! Republican-heavy SCOTUS, Roe v Wade overturned - and what else to come? But Ruth hung on till the end. Sheesh!

Ginsberg played weekend at Bernies throughout the Trump presidency so he does deserves to pick a Justice since she was playing around like that, with all due respect, she just couldnt fight death. With that said he did respect her memory by saying a lot of nice things about her. But a new justice is well overdue, he should replace her.
