Just because the people you're writing up have been coming here long enough to "know better" doesn't mean you don't have to close the trail. If they didn't want people to go through a trail after 4pm, then just put up the sign at 3:45pm.

They didn't post it, its pre usual close time, they still havent posted it and are continuing to harass the skiers they are misleading by not putting up a sign. Im sure the people making big bucks from the resort would love to know these guys are standing at the top of a closed run not marking it and pulling passes, really looks good and encourages more guests.
@jp4431

@Potato Salad with eggs maybe your local hills operate differently. If that trail is "closed after 4pm", that means they were open before that and thus people are allowed to go through the woods. If they're not allowed at all, either barricade those areas as all ski resorts do, or put up clearly visible signs that explicitly prohibit tree skiing. Every ski resort I've been to operate in this way.

Friendly advice from an attorney: In any situation with ski patrol, DO NOT give up your pass, but tell them you’re going home. They’ll try to stop you, but do NOT give up your pass. Ski to the parking lot, walk to your car, and leave. Come back 30 minutes later and keep skiing. They have absolutely, positively no legal authority to stop you unless you commit a crime, and no way of identifying you (unless you give them your pass). On the off chance they hassle you when you come back, tell them you have no idea what they’re talking about. If they push it, demand that they call the resort GM down and prove their accusation in front of him/her. No positive ID means no proof. Then raise hell with the GM for hiring such complete morons. But it almost certainly won’t come to that.

Definitely expecting some douche bags in Colorado though. Only experienced 1 or 2 the past 3 years I’ve gone to utah. In Iowa it’s a much smaller mountain, I’ve experienced a ton of douches there. I'm so glad I'm old. When I was young enough to do things that angered the ski patrol, very few people were carrying cameras at all, and digital cameras, much less integrated digital cameras in cell phones everyone has on them at all times, were things of the distant future. This meant the ski patrol could only clip your ticket/pass if they actually caught you, and they usually would not follow me into the trees. Tree skiing is fun, and ski patrollers are (contrary to some people's opinion) not terrific rough terrain/ungroomed snow skiers. Never got my ticket clipped once, even when a ski patrol duo saw me jump over the 'no jumping' sign at the compression bowl between Powder Bowl and Lucky Shot at Crystal Mountain, a favorite thing to do in my crowd. Me and my friends used to make fun of people who managed to get caught.

Water safety on a lake I worked was the same. Used to be a reputable organization then the richest boat rental place took them over. They enforce their own authority on the lake harassing everyone meanwhile I had to call the county sheriff to get their party boat out of my mooring lines at the summer camp I ran the waterfront for. They were drinking and jumping off the boat at dusk. Local police wouldn’t respond because their boat patrol office was closed and said to call water safety, who are literally on that boat partying. Just one of a dozen stories like that, don’t even get me started on their tourist mail boat. Gage Marine on Lake Geneva.

I used to work for Vail Corp. After getting stopped once for "going to fast", which was 5 mph faster than the people around me I understood these guys were pretty much just acting out their dreams of having power over peoples lives. The next time one of them tried to stop me I just ignored him following me and talking to me and rode all the way to the parking lot, unstrapped, and walked away. He followed me for a good mile on foot while calling security but once I hit the main road and was off the property they finally stopped. The best moment was when security pulled up next to me and asked what was going on. I politely responded that I wasn't sure, but there was a man following me for quite some time and it was pretty weird of him. The looks on the two security guys faces was pure gold as they tried to figure out if I was a complete psychopath or just an asshole. Worked there for three years after that and ended up running an entire department. Good times.

@@Scientist_Salarian Ok counselor. What is the burden of proof that would be needed to take your pass? Preponderance? Reasonable suspicion? PC? Are you entitled to a hearing. Passes are expensive. They wouldn't be taking mine without irod clad proof that I deserved to have it taken. In this case, where was the trail closure marked? Did the skiers sign a document stating that they understood trees were closed at dusk? Even in some fake ski resort court, they keep their pass.
@Scientist_Salarian
@Scientist_Salarian 3 жыл бұрын
@@unleash_the_fury A season pass is a physical item which you legally purchased from the resort. It is your sole property under the law. No employee of the ownership company- security guard, GM, whoever- has the authority to seize your personal property. Even a law enforcement officer would need reasonable suspicion at a bare minimum, and since your pass isn’t a legally prohibited possession or stolen, they’d have a hard time legally justifying confiscating it from you. Now, the service that is provided to pass holders is under control of the resort. Simply having a pass doesn’t necessarily entitle someone to service. *IF* the resort could learn who you were without taking your pass (i.e. scan it from outside your jacket or something), they could blacklist your pass in their system. At that point, you’d have to hire a lawyer to get it reversed. The burden of proof in civil court is far lower than in criminal court, so you’d have an uphill battle to fight for a denial of service claim. They’d simply say you were behaving badly, and they had reasonable evidence to suggest they know it was you. Honestly, it could go all sorts of different ways depending on which local, state, and federal jurisdiction you live in, and how much money you (and they) are willing to pour into the fight. I hope that answers your questions a bit.

I had my season pass taken once. I had to do ski patrol training for the rescue dog (Jade). They made us dig holes to get into and the Jade, who was at the top of the lift, hauled ass down and found everyone else first, I was first to go into a hole, all others were found first. She finally found me…..they wanted us to do it 2 more times……I didn’t sleep for 3 days. Being trapped in a dark hole for 20 minutes messed my head up. I know it’s only 20 minutes…….there is very limited air in these holes…..years later I returned to the ski resort…….Jade smelled me and ran right up to me and was happy to see me again. There was probably 40 people around, she ran right up to me. I got my pass back and my snow stick too after only doing one run of training for Jade. Sucked but those turns were like wow!

As an attorney, this is actually very sound advice. Ski patrol aren’t law enforcement officers. They have absolutely no legal authority to detain you, nor lay hands on you or your property unless you commit a crime (in which case any average person can detain you under citizens’ arrest, not just ski patrol). The only thing they can legally do is escort you off the mountain. So, if you get stopped by ski patrol, tell them you’re going home, but do NOT surrender your pass. If they can’t identify you, they can’t prevent you from coming back a few minutes after you drive away.

@@hobmarg I have never had any complaints with the ski patrol at W/B. Very professional. I have been yelled at, lied about and generally find the yellow jackets to be a bunch of wanna be security guards. I don’t race through congested areas. I may be carrying more speed than the average skier but I’m 100% in control and always on my edges. I’ve been yelled at on ZIg Zag, Cruiser DM down hill at coaches corner Crab Apple, Olympic with nobody near me. if I come across congestion I slow and stay near the edges. I’ve skied Whistler since 1973 never been involved in any incident involving other skiers. On the other hand I see people going half the speed I am and are out of control but are not bothered at all. Speed isn’t dangerous but being out of control is. I ski exact same way at SilverStar, Revelstoke and Golden and have never heard a thing. One more thing the yellow jackets aren’t the only reason I left. Since Vail (Vial) resorts took over service and on mountain experience has changed for the worse. 10,000 signatures and counting on the Vail, Make Whistler Great Again petition speaks volumes.

I used to race so I know how to ski fast, but on ski outs I just go the speed of traffic and if you ski WB a lot you know where they are posted up (it's always the same spots) so you slow down before the pitches coming into those choke points. Or just park Creekside and never see them. Honestly they are needed because there are so many clueless gapers riding out of control, trying to hit side hits etc. and WB is an inverted triangle so everyone funnels onto the same 2 ski out runs.

Ski patrol does not have the legal authority to detain you, or demand your information. You can ignore them, remain silent, and leave their patroll area. Because a lot of them are like us and want everyone to enjoy their ride and pass it on to the generations below us and so on. Ski patrol like this encourage first timers to never come back. That’s not only bad for business but it’s a shitty attitude to have. It reminds me of the rich entitled skiers who think the resort of only for the rich and entitled. This clearly isn’t a safety issue at all, they probably thought these kids were doing something they shouldn’t and didn’t catch them doing anything so they just assumed they were. After working at a resort for a few years (not patrol) I’d have said “let’s go to the bottom and talk to your manager and explain the situation, there’s no signs or ropes the run is closed and it’s not fair to take our passes and cut a corner because we didn’t know an open run was now closed when it’s not yet dark” guaranteed if you offered to meet them at the bottom with a manager where these discussions should be had in the first place these kids would have been told to make sure a runs open and that’s that. Verbal warning because the run wasn’t roped off. The real bitching would probably have been patrol for not doing their jobs. If a runs closed you actually have to close it first.

Hey. Former SJCI Ski Bus Alum here and member of the National Ski Patrol, so this was a cool video to come up in my feed today. To be clear, that was the HV Mountain Host Safety Team that pulled your pass, not HV's Ski Patrol. The Mountain Host Safety Team wears yellow jackets and badges that say "Safety Team" which is clearly visible at the 1:56 mark of your footage. They focus mainly assisting customers and enforcing management rules at the area. In fairness, based on what I saw and my experience, this interaction was perhaps overaggressive, and probably why management, when reviewing the footage gave your passes back. HV's National Ski Patrol members wear red parkas with white crosses, each with over a year of initial training and then trains annually every year after. Our focus is stabilizing and transporting skiers/riders when they might get injured. It's a whole other level of commitment for sure. It's that commitment and pride that drew me to comment today to clarify with you the title and captions found in the video reflecting "ski patrol" are simply not accurate. Do Ski Patrollers get overzealous from time to time? Sure. Are those bad experiences with Ski Patrollers captured by customers on video and posted on youtube and insta? For sure. I'm not a skier but I am an avid hiker. Even I know the yellow jackets didn't do their job properly. If they wanted a trail closed they needed to mark it or barricade it with SOMETHING. That way there's at least SOME indication that people aren't allowed in that area. Even if it's a sign for the trailhead saying "Happy Trail closed from 4pm to 8am skiing beyond this point after 4pm will result in having your season pass temporarily revoked"

Why not just ski away from these guys. Just keep skiing and at the bottom say “I didn’t hear you” 🤷‍♂️

Been doing exactly that here for years. They don't chase.

With new blue tooth beats pro.. etc.. you can't. You can be just straight up jamming and you aren't gonna hear some dude yelling.

Wow big credit to you guys for keeping your cool! I definitely would not have been that calm or compliant, although I think it was best in the situation given how much of a hardass he was

I would have stuck to the “if its not posted closed its open.” I literally never learn ski run names

I've been a Ski Patroller for almost 30 years. Anyone who responded as courteous as y'all did would have only received a verbal warning from me. I'd let you return to the open trail and go on your way. This would also tell me the trail closed sign location was inadequate and more needed to be done by the patrol to demonstrate a closed area. I also don't waste my time with the really lippy and send them off to management.

Next time hold on to your pass and walk with them down to main office. These guys were on a power trip

Should have just given you guys a simple warning and let you go your way. Totally uncalled for but you took it well.
