My mother and I are co-owners of the residential flat, 50 percent each on paper. We are going to sell, Can I get receive lesser say 20 perc of sale value from the buyer and my mother get 80 perc? We both are doing with mutual understanding and from taxation perspective. Is it permitted, though, we both are 50 perc co-owners? The buyer does not have any problem.

I've a doubt, thought buyer paid all the purchase-money to the seller & seller is not giving the possession thereafter, so for that, the buyer can claim for refund for amount paid & along with that amount, interest too over such amount, So my question is, how someone can Composed that interest over paid amount, is there any particular Rate of interest to calculate the same ???

It seems, if you have not put any condition in 'Agreement to sale' prior to sale as to penal interest in case of failure of such sale to happen due to incapacity of seller, you have to depend upon the court that generally allows 9-12 percent p.a ...but it is better you seek 18 per cent (minimum) in your relief clause along with cost / harrsement etc...

It seems, law does not actually say that even if partly promised consideration is not moved at later date, the sale would remain effective..The seller can go to court for getting declaration for sale to be void, since full consideration not received by him although promised..But of course, till such declaration by court the sale would remain valid..In general, seller does not register sale deed without getting full consideration prior to registration...

If this is understood by the professors of law - Students - Lawyers and judges than why it is not understood by the lawyers and judges and most of the real people are suffering, Translate this law into local languages so a ordinary police constable can understand it and speak slowly and nicely so that public can understand. you have the knowledge but not the style
