In addition, the conduct demonstrated by the police officers is probably supported by some stupid local police policy to be used legally in certain cases. Every officer of the government has to uphold the constitution and court cases have been overturned due to this. You could say you are right today but what about tomorrow. LEO were at one time allowed to arrest slaves just for walking about if they suspected them of escaping because of democratic mob mentality of the times, but today they are evil people. All started back in the 90s when a woman went to the cops to report her 3 daughters kidnapped by her ex-husband. He had made threats before but the cops did nothing. A few hours later he showed up at the police station with a gun and died by cop. In his truck they found all 3 girls dead. She sued the cops and it went all the way to the Supreme Court which made that BS ruling. It was used in a case a few years back in NYC when a guy on the subway defended himself again a knife-weilding maniac. Another case of “Defund The Police, BY THE POLICE”. Failure to stop at a stop sign IS NOT an offense for which one can be arrested for. The officer has state reasonable, articulable suspicion as to why they fear for their safety and or the safety of others to order the driver out of the car therefore, police cannot order a driver out of the car for ANY reason. Not presenting an license is not an offense which you can be arrested for; Failure to provide identification IN THE ABSENCE IF YOUR LICENSE DURING A TRAFFIC STOP is an offense for which you can be arrested. Not presenting your license but stating your identification by name,date of birth, etc is called “Failure to present license upon demand by a police officer”, a citation only offense.

I work with members within law enforcement community (State Prosecutors, Police, deputy sheriff’s, etc) and in unanimity ALL have said that minus a safety concern, MIMMS doesn’t apply. I beseech that you converse with members of the law enforcement community and not lean on your own interpretation of MIMMS. Additionally, each states respective driver’s license governing authority takes a facial photo of YOU when a driver’s license is issued to you. Along with the photo, your physical descriptive characteristics (Ethnicity, height, weight, date of birth, eye color, etc) are also on the license. If a motor vehicle operator for whatever reason is operating a motor vehicle on a public roadway without their physical license on their possession and is stopped for a traffic violation, NOT producing your license is “Failure to produce license upon demand” (citation only, non arrest offense); ITIS NKT DRIVING WITHOUT A LICENSE. Driving without a license means either you’ve never had a driver’s license or your current driving privileges are either suspended and or revoked. The police officer then asks driver for their full name, date of birth as IT APPEARS ON THEIR LICENSE and the issuing state of the driver’s license. When the officer validates the info that was provided by the driver, the driver’s photo and other descriptors are presented to the officer on the officer’s computer screen. If the photo and physical descriptors don’t match, then the driver is subject to arrest for more than just the initial traffic infraction. If the driver’s info is validated then again, a citation / warning is issued for the “Failure to present driver’s license upon demand” is issued along with a citation / warning for the probable cause for the traffic stop. Minus a safety concern or an impending arrest, a compliant driver with no issues other than the non arrest traffic offense CANNOT be ordered out of their car. Again, I beseech that you converse with members of law enforcement community and or members of your states bar association regarding this subject. A police officer and the respective department will have a much larger issue if they order the driver out of the car just because they want them out of the car.

Retired police officer here . They do not show the entire contact on video , but you do hear the subject say, what’s your probable cause to the officers. The windows are rolled up and it appears the subject is not cooperating . If he violated the ca vehicle code by running a stop sign, then the police have probable cause to detain the subject . While detained they are able to obtain the subjects drivers license by askant him . If he does not comply he is now in violation of the law and it becomes a misdemeanor and subject to arrest . If he refuses to provide the id and does not make an attempt follow the orders of the officers , they have every right to break the window. For those criticizing the officers just take a look at the video . Anytime there appears to be missing footage like the first half of the encounter , that should raise red flag on the truth of the story . All police are not bad , in fact most are good !
