School Sues Parent Over Special Education Testing | Special Education Teacher

A Texas school sues parent over special education testing in an attempt to provide what they are calling comprehensive testing to best determine the child's suspected disability. As a special education teacher, who works with students with all types of learning disabilities (Math disorder, Dyslexia, Dyscalculia) as well as Autism, I found this lawsuit to be very interesting. It's not often where school sues parent over special education testing. But a Texas IDS school sues parent is exactly what happened.

I’m in college and had to go get another autism evaluation. Turns out I need more accommodations but my school refuses to accommodate.

If it’s stated in your evaluation, they can’t deny you accommodations. Get a lawyer.

I think you’re on point. I didn’t get the impression from the small news clip that the mother would feel ashamed if he was diagnosed with autism (as some commenters have mentioned) but rather that she authentically doesn’t believe he’s on the spectrum and doesn’t want him receiving the wrong diagnosis. On the other hand, I wonder how familiar she is between educational diagnosis and medical diagnosis. Just because the school may determine that in the educational environment he shows signs of autism, thats not the same as an official medical diagnosis. At the same time, IDEA says that all areas of suspected disabilities should be evaluated.

Good point! I am not that familiar between a medical diagnosis and educational one myself. I have heard of it.

Awww...thanks! I am def an advocate for special education...education in general, but I also have to be a voice of reason. Can’t wait to see you this summer! New area, still same positive impact.

Is it because they dont receive the $$ for autism diagnosis? why specifically autisim, I saw another video on news on yt where a district in TX received a huge amount just for children with autism..in that video they’re saying many more kids getting diagnosed with autism

I think one can infer that based on what she did say, but it’s not exactly what I was saying. She stated that she didn’t want him tested for autism because according her he didn’t have any symptoms. However, the school feels otherwise, that is why they are suing her. Because they don’t want to test a few areas and without testing everything. So what I am saying is the school has a right to test. She can’t be sure he doesn’t have unless it is ruled out. What she doesn’t want to test for it.

Wow! What an interesting case. I haven’t heard about this before. I agree with both sides of the case but do agree the school is being a bit petty.
