In a criminal trial when you plead the fifth guilt cannot be inferred from the lack of testimony. That is not true in civil cases. In a civil case claiming the fifth guilt can be implied. I learn this by watching commentaries on some of the trump court activities.

Just wanted to comment that it is correct that a negative inference may be taken against a Defendant in a civil case who refuses to testify while not so in a criminal matter. Also, in addition to Little Davey wanting to stall the case in general, maybe they wanted 30 days to figure out who incoming counsel is for fair game purposes! Love to you! ❤

Career criminals tend to resort to delaying for as long as possible. Scientology has already been taken to court because they can't settle, so it's rediculous to ask for a delay due to a "change of council" Edit: you keep saying they make no case for why scientology needs this delay. They are essentially complaining that they dont have any lawyers to harass in an attempt to delay the ongoing legal proceedings.

I have only seen tactics like this a handful of times. Was this filed in CA or FL? I thought CA, in LA County. If so, CA is the most loosey goosey state when it comes to anything law related. Most judges put up with a ton of crap because it is just so normalized in CA. If in FL, it would depend on the county. I love when you read this stuff because I am able to get a little more information than what you point out just by reading the suit.

IIRC the pleading the fifth thing came up in a conversation with your lawyer friend Zac. Part of why civil trials tend to happen after the criminal trial has a verdict is the issue around pleading the fifth, since if found guilty on a criminal charge then they would not have the same argument about incriminating themselves, as the prosecutor had already resolved the only chance it had to make a case on those charges.
