Who Is a Person with a Disability?
Federal nondiscrimination laws define a person with a disability to include any (1) individual with a physical or mental impairment that substantially limits one or more major life activities; (2) individual with a record of such impairment; or (3) individual who is regarded as having such an impairment.

In general, a physical or mental impairment includes, but is not limited to, examples of conditions such as orthopedic, visual, speech and hearing impairments, cerebral palsy, autism, epilepsy, muscular dystrophy, multiple sclerosis, cancer, heart disease, diabetes, Human Immunodeficiency Virus (HIV), developmental disabilities, mental illness, drug addiction, and alcoholism.
Some impairments are readily observable, while others may be invisible. Observable impairments may include, but are not limited to, blindness or low vision, deafness or being hard of hearing, mobility limitations, and other types of impairments with observable symptoms or effects, such as intellectual impairments (including some types of autism), neurological impairments (e.g., stroke, Parkinson’s disease, cerebral palsy, epilepsy, or brain injury), mental illness, or other diseases or conditions that affect major life activities or bodily functions.
The term “major life activities” includes those activities that are important to daily life. Major life activities include, for example, walking, speaking, hearing, seeing, breathing, working, learning, performing manual tasks, and caring for oneself. There are other major life activities that are not on this list. Major life activities also include the operation of major bodily activities, such as the functions of the immune system, special sense organs and skin, normal cell growth, and digestive, genitourinary, bowel, bladder, neurological, brain, respiratory, circulatory, cardiovascular, endocrine, hemic, lymphatic, musculoskeletal, and reproductive systems.

Reasonable Accommodations
A reasonable accommodation is a change, exception, or adjustment to a rule, policy, practice, or service that may be necessary for a person with disabilities to have an equal opportunity to use and enjoy a dwelling, including public and common use spaces, or to fulfill their program obligations. Please note that the ADA often refers to these types of accommodations as “modifications.”
Reasonable Modifications
Under the Fair Housing Act, a reasonable modification is a structural change made to existing premises, occupied or to be occupied by a person with a disability, in order to afford such person full enjoyment of the premises. Reasonable modifications can include structural changes to interiors and exteriors of dwellings and to common and public use areas. Examples include the installation of a ramp into a building, lowering the entry threshold of a unit, or the installation of grab bars in a bathroom. Under the Fair Housing Act, prohibited discrimination includes a refusal to permit, at the expense of the person with a disability, reasonable modifications of existing premises occupied or to be occupied by such person if such modifications may be necessary to afford such person full enjoyment of the premises.
Under Section 504, a housing provider is required to provide and pay for the structural modification as a reasonable accommodation unless it amounts to an undue financial and administrative burden or a fundamental alteration of the program. If an undue burden or fundamental alteration exists, the recipient is still required to provide any other reasonable accommodation up to the point that would not result in an undue financial and administrative burden on the particular recipient and/or constitute a fundamental alteration of the program.

You are 100% the EPITOME of TRUTH... I'm a recent DV survivor, homeless & disabled. I was told yesterday that because I put my abuser in JAIL ( exercised my civil rts) that I can't be taken into the YWCA because my risk of imminent danger is not high enough because I put him in jail. I was also told that I'm going to have to go out of County to just get shelter because everything's full. #homeless&disabled

I ran into the same situation. All avenues of relief are either out of funding or overextended. Some listings are even closed but don't bother to put that in their ads . I have paid or walked (once 9.5 miles) to these places only to find chains on the doors. I am also disabled . Although I have been judged so by our government and am receiving disability benefits it doesn't make a difference in how I've been treated. I guess this shows the damage done by people who are not disabled claiming that they are. I have a request. Do you know if there are transportation options for those who can't afford it? My old landlord stole my car. So now I'm unable to get groceries or take advantage of any offers that would improve my situation because I can't afford to get there. After my long hike I was in tremendous pain for days. It tends to dissuade me from attempting to access the opportunities that are available. I have rheumatoid arthritis and it's not a kind taskmaster. Lol . I also am a dv surviver and suffer with ptsd. Many fears come into play when I have to leave the familiar to get to places that demand in-person appointments. Bottom line is I need help but it's unavailable or there are demands that make it almost impossible for someone in my condition to take advantage of the opportunities. (yes, the bastard is in jail). One more quick request: are there any programs that help with cleaning/hygiene products? I spend more than a bit on these things and a little of help would be greatly appreciated. Roaches are quite adept at invading homes in Florida. Pest control would help but I can't afford it so my only option is to keep my home spotless and free of anything they like to snack on. Yes, I seal all food items and even the garbage can is free of food particles. So you see how these things are needed and reasonable for the disabled and everyone else to have access to without having to starve themselves to stay clean and bug free? Let me know if you have any suggestions. I appreciate what you're doing for us, and I especially appreciate the laughter and validation you provide. Hey, if you can laugh you can handle it. Keep it coming, I'm grateful.

One major problem I have had; is getting apartment complexes here in Columbus, Ohio to understand that they have to follow Federal Law where it says in section 504 that a reasonable accommodation is getting the due date of your rent changed, if you rely on your disability to pay your rent every month. I do rely on my SSDI to pay my rent every month and when the apartment complex I live in was sold; I had to fight them for six months about section 504. I was told that didn't exist. I printed it out and took it into the office, was told they would send it to their attorney to find out. A whole six months of fighting and the involvement of the regional HUD office in Chicago, where I filed a discrimination complaint. In the meantime; while I was fighting my apartment complex about it; I was also looking for another place to live (expecting the worst outcome). Every apartment complex I went to didn't know what section 504 was when I inquired as to whether they abided by Federal Law or not and when I showed it to them, they said absolutely not; the rent was due on the 5th and a late fee would be charged ($100 or more). This was every single apartment complex in Columbus, Ohio. As I said; I rely on my SSDI to pay my bills every month and I get my check the 2nd Wednesday of every month. I tried explaining to them that was my only source of income and that I cannot call up Social Security and tell them they have to pay me the first of the month so I can pay my rent on time. Nobody here seems to care. What finally happened at my apartment complex; is that I refused to pay rent and forced them to file eviction. Then I went into the office and threatened the office that I would be presenting the Section 504 to the eviction judge and that I would be countersuing for discrimination. Rather quickly; their attorney told them they had to approve my accommodation request; because it is Federal Law. The eviction is still on my record; even though I did pay in full without seeing the judge and being evicted. Is there any way I can get that removed from my record; so another landlord is not able to see it? Also; I had a squadron brother tell me I needed to apply for section 8; that as a Vet and disabled, I would be put at the head of the voucher line. Unfortunately; I had to apply on line because of Covid. I checked the box saying yes I am a Veteran and yes I am disabled. It was only a really quick application with just a few questions. At the end; it told me "Congradulations, you are now in the lottery to be put on the waiting list". I guess I need to actually go into the Housing Authority to talk to them?

I'm on section 8 in Texas I was told if I did not get rid of my service animal. Within 3 days I would be evicted. I gave her all the information on my service dog including her shot records. And my medical records with a few things blacked out. And she was insisting that I tell her what was blacked out and I refused. I am now moving.

I just wanna say thank you for all this information it would be wise too take notes and actually go read up on the laws and learn how to advocate for ourselves. My grandfather always said the easiest way to hide something from someone is to write it down. Let’s not forget the majority of people using these services that don’t actually need it. I’m very grateful for the insight that I have gained from this channel.

@Luis Figueroa You lost your voucher for section8 didn't you cause the only time you get it transferred if it's already activated and even then they only give you 4 month it use to be 6 months to find a place that only prove after awhile they didn't want to many people getting it again. I don't know why these site sometime don't let the public read comments sooner cause maybe you could have gotten section 8 consulting to help had I seen it earlier. God bless

Ceiling collapsed- nothing. It was finally fixed after two months. No water for a month. Heat didn’t work etc. I complained to authority and manager. Was told just work with management… so? Unbelievably right. Nope. Then when a maintenance guy came in to fix my countertop- he brought nothing so I asked where’s your stuff? He freaks out on my yelling etc I get past him get to the office he chases me in his truck gets there to continued to yell at me now in front of them- I put my hands up in the air and say see… he then lunges at me the office women hold him back. Then office lady asks me to wait outside so I do, he freaks on them and quits. I’d made a sandwich for the guy.. because I was happy to finally get my counter fixed. So gee that was a shock. It was explained he was just stressed over worked etc. they hired him back a few weeks later. I wanted to move but no proof it happened. So.. yeah not exactly compfortable accomodations .

Our apartment complex was sold to new owners I'm 71 new owner or present owner contacted housing authorities of any changes nor can housing get in touch with them it's a senior apt complex we all in the dark as to what's going on here and expected to pay rent on the first of apreal no checks under there instructions. Love this guy! So true. After telling my housing authority I am allowed federally to request accommodations ( household composition 4) one autistic adult- my son 20 my daughter 15 asd/ adhd. And my 18 year old daughter.then myself. She told me no ma’am. Two bedroom for 4 people. Regardless of family composition. ??? So I share a room with my autistic adult son? My son has asd adhd major depressive disorder and legit ptsd. I have deteriorated discs in my back and still took an upstairs unit. I’m not unreasonable but? Then I was told there is no self sufficiency program. ?? On your prompt it mentions it? I could go on and on.

I have been homebound for 4 years because I cannot get in and out of my apartment by myself. I had asked my landlord for a ramp and he refused. I decided I was going to call for help to be rehabilitated and I'm back again without a ramp. Can you tell me as my landlord the one that I should be requesting the ramp to be put on?

No a landlord don't have to do that cause it cost him to pay the cost. You need to apply to an apt building that have that convenience for tenants if you have section 8 go to legal aid to help assisted and you should also call on your senators don't have attitude they won't respond ahead of time because they did for me that's God I even recieved responds from president Obama when he was in office that's god always have been always will . If you short of food send someone to open door 999 greene ave between patches & broadway on Saturday hours 8-10am God bless

Hello,,i am learning so much! , i am a renter with a bridges voucher thru Minnesota hud. I am disabled and receive permanent disability I am being over billed and treated like a pieces of crap, i need help. My disability is mental health and traumatic brain injury and they count on me being a shut in and i can't always articulate my words, i exposed a couple work orders for repairs that were never done,, i said well,, someone got paid to repair something in my unit, and it's simply bogus.,, now she's retaliation because the maintenance gyy is heR BOYFRIEND ..

I feel on this housing am at damaged my back had surgery and am disabled because of water that stays in the area then humiliated by managing wants to through me out, am living there for 7yrs the water is contaminated with lead and others mold in my apartment. Cursed by the mentenance guy. Report to housing my rent it's going up mentanace is poor. I have mold in my blood from lab work. You don't have access to public areas where you live it is so stress, the building has so much violation and is business as usual.
