We had a security guard at my old job that had to be about 400 pounds. A coworker was robbed at gunpoint in the parking lot early one morning, and not only did it take him several minutes to get outside to help her, but he called his security company instead of 911 because he didn't know how to handle the situation. Whenever I see videos of officers like this one who couldn't control any situation without getting out of breath, I always remember that incident.

@@dannyfergusson3243 Scissors are not inherently dangerous most of the time... unless you 'run with them'... The guy in this video is a straight-up KAREN. Security guards seem like buffoons, too. But the guy is obviously his own worst, uninformed enemy. And the way he jumped in the first cop's face demanding 'NAME AND BADGE NUMBER!' made him look really stupid. Every time his opened his yap, he stuck his foot in. No sympathy from me. He's neither a 'journalist' nor an 'auditor'. He's just an loud-mouthed imbecile.

The two clowns just wanted to make the call "spicier" for optics. They knew they were in the wrong and didn't care if they put the cameraman's life in danger. Their $12/hr worth more than someone's life. Disgusting.

Yeah, providing an account of the situation before the cops got there likely would've set a better tone for the encounter. I can agree with the cops grade, but I think 'auditor' should've had a matching grade for his demeanor, incorrect citing of detention v arrest, when a detention is justified, and failure to know his state's LEO identification policy

James acted like a cross between former LEO - wannabe cop - nothing guy (laughably) trying to convert a mall cop badge into respect and a license to bully/assault (not gonna happen). He should have tried to file changes and filed a suit against the mall/James. The other guard mimicked the actions a LEO takes when he throws up the blue wall to protect another LEO - he looked like he knew the other guard went over the line, but is going to protect him anyway. He should have lost his job just for being stupid enough to do this.

If yoo want to say there was reason for the cops to handcuff that guy & hold onto his weapons, there may be some argument there, but he had been assaulted by the security guards who were armed with the weapons they assaulted him with (and the cops WERE informed of this), but the cops neither handcuffed them nor confiscated their weapons. The security guards were at least as much of a threat as he was - if not more - yet they were treated better than he was.

I mean getting assaulted with pepper spray and then the cops showing up ready to draw on you then threaten to take you to the ground and detain you for a truly unreasonable amount of time after they're aware of all facts just because they can is a bit upsetting and I don't blame him for his attitude. Could he have acted better? sure, but literally having the cops gang up on you after you got assaulted is ridiculous.

@@CheddahSlammer and like I said, kept him detained after they had all the facts... it goes from reasonable to unreasonable real quick. My comment is more on the fact that I understand why he is upset and it's hard to control your emotions when you got assaulted and held against your will until a supervisor shows up. As for weapons, as far as I can tell he never reached, brandished or threatened anyone with them so why does it matter? They only added that information to escalate the call.

How you treat people matters. You can stand up for your rights and be nice at the same time. And not for nothing. The more anger involved,the more likely it is to devolve into a competition,with nobody willing to shift their stance because they don't want to lose.. It is the difference between "name and badge number!" and "hey man,can i get your name and badge number?" It's the same question,except one is oozing with contempt. Again,it is about getting the change we all want. The government is a bureaucratic,unyielding,emotionless,detached nightmare but it is comprised of people. And people can sometimes be reasoned with but if they hate you they are more likely to continue down an illogical path because we are an emotional species..

I've seen too many cops and gov't functionaries being asked nicely with sugar on top and blatantly refusing to do identify themselves anyway to believe all that. They really do need to be cussed at. They also accuse Citizens of threatening them for mere criticism, or holding a camera (always "in my face") and try to get them shut down or locked up. Eff 'em.

I worked in security for 2.5 year in oklahoma. Company never gave me or my 4 coworkers any formal training, glad i was never dumb enough to assault anyone, and lucky enough to never needed contact with leo's while working since i had no guard card

They were called for a disturbance and the cop got out of his car immediately demanding compliance from the victim. No investigation, not one question, nothing. Just immediately assumed because the security guys called the man with the camera must be at fault.

@jeffcuzzort4399 they were called for a disturbance with a guy with weapons, and the caller implied that he may have been attempting to use them. The cops had no way to know the caller was exaggerating. The cop acted appropriately and the guy refused to calm down long enough to explain what had happened

@@mikecrain2076 The cop was aggressive from the time he got out of the car. The proper way for the cop to act when he arrived is to introduce himself and let the guy know that a call came in that he had a weapon and once he secured the weapon then start an investigation. Now if the guy then got aggressive and refused a weapons search, then that would’ve been an appropriate response by the cop.

@mikedougherty2243 that's just not true. The caller implied that he attempted to use the weapon. At that point tge cop has to treat him as a suspect with a deadly weapon. And the first interaction is the suspect walking up to him in an aggressive manner and yelling at him.

In the state of Texas they are. The law states we are acting as public servants and an assault on a public servant is committed when you assault a security officer. Many places play fast and lose with the laws and it makes it difficult for those of us trying to hold to a higher standard.

@@theb.s.d.4707 That's interesting. I assumed the same as OP but I looked this up after your comment and read more about it. Pretty weird how they handle it in Texas, imo - it seems like private security is also restricted a lot even though they're called officers. Lots of downside risk there.

He was aggressive and confrontational from the onset and immediately used force to restrain a citizen before gathering even the most basic facts or giving any time to comply with his orders, and never had a reasonable fear for his safety in order to justify the restraint. @@seeya205 No, he didn't. He was, at most, agitated when he approached the officer, not aggressive. The possession of weapons is not, in and of itself reasonably frightening, and they could have simply disarmed him without restraining him, which could have easily been voluntarily achieved had he approached the situation calmly and rationally instead of fearfully and aggressively. Also, the guy approached the officer obviously filming, which is not characteristic of people about to commit a violent crime, further weakening the constitutionally required fear for safety necessary to justify the physical restraints placed on a private citizen. I've worked security for Allied Universal. They will literally sit down through the security test and talk to some people like they are 5 year olds to ensure they pass. Most of them dont fully understand how limited their authority really is. At most you are an agent of the property. Other than that, you're just a normal civilian.

If after learning the security guards lied about him, the subject had chosen to calmly explain to officers that it wasn't true, and be wished to press charges as HE is the true complainant here, he probably would have been released much sooner and the outcome would have been different. I hope to hear an update that the security guard was charged. You can't pepper spray someone just for having an attitude.

He heard the security guard make allegedly false claims about his actions and demeanour as well which makes his initial response to the arrival of police even more ridiculous. The cop leaping out and being aggressive is a direct reaction to the security guard calling up and saying that he has weapons. That immediately puts the situation into something it shouldn’t be. We all know that the "journalist" or was he a photographer that day, rushed up on that security guy like a rabid dog and got sprayed. He then tried to give us a completely different narrative. He was so pissed and probably pissed off at the world, that he went back for some more pepper spray, this time he wanted to get on camera in his favor. Mr. Stone is fooling nobody. He needs to go see someone about his problem. It would be better and his first step towards recovery if he gives us the real story, then goes and apologizes to the mall security.

The handcuffs don't automatically in and of themselves transform a detention into an arrest. But it's a very significant factor, and coupled with the fact that he was also searched and had some of his property seized it's clear that in this case this was clearly a custodial arrest.

Anyone is allowed to defend themselves if they fear for their life and safety. Without the altercation being on video we have no idea what led up to the pepper spray. Depends on state licensing and laws, but unless they asked him to leave and he refused (not shown in video), they had no basis to cuff him.

Some tips for the photographer: 1. The guy admitted that he approached the guard, not the other way around. If you have words with someone, do not move toward them. 2. If someone pepper-sprays you, don't confront them, be FIRST to call police, and tell them you've been assaulted. 3. Whenever dealing with cops you need to KEEP YOUR COOL. The on-screen text says the 1st officer was "combative", but that's not what I saw. Police had been told (See #2) a civilian had a weapon and was creating a disturbance, and when they arrive, they find the photographer mad and yelling. The police reacted to that. If he had kept his cool, they probably wouldn't have even cuffed him.

ATA you contridicted yourself! Claiming that he's being held too long, then moments later stating that they have the right to keep him in cuffs do to hear-say!! Besides there's a differance between having enough to run an investigation & having RAS for handcuffs!

I have mixed feelings about this. While the photographer seemed agitated after he was assaulted we haven't seen his behavior prior. I can't assume he is in the right or at fault without evidence beyond his anecdote. The security guards lied on camera to the police to escalate the situation so i am more prone to believe the photographer's side of the story. The entire thing is silly though.

As the pepper sprayed victim is the complainant asking for medical help and not the mall cops he should never have been "detained" or "cuffed" and had his property illegally seized as per the mall cops "he didn't use those on us." Because it was all on camera.

The cops were called for an alleged aggressive person armed with a weapon and who was willing to use it. When they arrived a man approached them who was clearly agitated and refused to listen to them when they requested him to stop and turn around. In that situation it's totally reasonable to stop and retain that person until you can figure out what's going on. It was the guy's own demeanour that got himself into that situation.

The APD cop admitted he was going to keep the man in handcuffs while awaiting a Supervisor arrives, after already admitting there was no assault, no apparent crime…yikes!

I once worked as a security officer for Securitas in California. We were trained only to observe and report. We were forbidden to intervene or pursue suspects. That being said without the beginning of the encounter I cannot say what if any actions the security officers were appropriate or not. But on video, I didn't see them do anything inappropriate. As for Mr. Stone, I don't know what happened in the beginning but judging by his action on film I am guessing he intervene on behalf of the boy on the bicycle basically sticking his nose in something not his business. His lack of understanding of police procedures and laws rubs me the wrong way and his antagonistic tone towards the officers made things harder than it had to be. The officers were professional and show patience with Mr. Stone. And yes they kept him in handcuffs throughout the encounter for good reason. He was armed and they had a call he was causing a disturbance. He was legally detain and there is no time limit on how long handcuffs can stay on someone. It is based on reasonableness. I again advise ATA to do a ride along with his local police department to participate in the local citizen police academy if they still exists. Security Guards: A. Officers A. Mr. Stone: F. ATA: B

the first officer got out & literally starting yelling don’t resist & never once told dude he was being detained or anything so a person isn’t resisting if they were never told they were being cuffed or detained

Did you even bother to watch the video before posting this fucking horseshit? Officer got out and stood there calmly for a full 3 seconds while this guy approached him screaming while brandishing a concealed knife that they knew about on the 911 call before deciding to detain him. What the fuck do you want the officers to do? Wait until some crazy lunatic they've never met before literally stabbed him? What the fuck is wrong with you. Officer came in LITERALLY as patient as he could have possibly been. The crazy cameraman did this to himself.
