(b) If there was at that time in excess of 0.05 percent but less than 0.10 percent by weight of alcohol in the person’s blood, such fact shall not give rise to any presumption that the person was or was not under the influence of alcoholic beverages to the extent that his or her normal faculties were impaired, but such fact may be considered with other competent evidence in determining whether the person was under the influence of alcoholic beverages to the extent that his or her normal faculties were impaired. (c) If there was at that time 0.10 percent or more by weight of alcohol in the person’s blood, that fact shall be prima facie evidence that the person was under the influence of alcoholic beverages to the extent that his or her normal faculties were impaired.

Please keep in mind many of the law enforcement officers that find themselves confronted with these situation may be probes, rookies, relatively new officers, that may not fully understand the process when having to process and deal with one of their own. Compare it too stumbling upon someone breaking into a vehicle and you discover it is a close family member...you may be tempted to stop the act and not report the family member. I young inexperienced officer struggles with the same thing when they realize it is one of their own (family member). The other dilemma is the pressure of making sure that every decision and step taken to process the DUI is done exactly by the book! Otherwise, a good defense attorney will find a glitch and get the DUI completely thrown out!!! Much thought has to go into every minute detail when processing your own family member!

A drunk cop ran head on into another car killing the 2 young people inside. Then he had the gall to tell the investigating officer he had no idea what happened all while saying bro this, bro that, cursing & attempting to throw suspicion on the 2 DEAD young people just feet away being cut out of the mangled mess of what did not even resemble a vehicle anymore. My niece was a newly appointed constable (Australia) in a rural town and pulled over a driver for erratic driving. It was an elderly man and when asked for his drivers licence he replied "do you know who I am", she replied no, please show me your driver's licence. He responded with "I am the retired police inspector of this town", she said nice to meet you sir, please show me your licence. He threatened her job but she remained firm and then required him to blow in the tube to check his sobriety. He went well over the limit and was charged. The story made the front page of the local paper and did no harm to her employment.

There is still so much wrong with this stop. "What is your Sergeant's position on this?" What does it matter? The guy is drunk. "I'm all for looking out for law enforcement" Suggests different treatment then the general public. Allowing the female out of the vehicle as the Trooper discusses it with the DUI suspect. She should have been immediately directed back to the vehicle. Asking the subject if he appreciates the position he is putting the Trooper in. What position? Enforcing the law? Position shouldn't matter. The DUI suspect is breaking the law.

CYA by getting others involved. If a regular patrol officer is put in a tough place, run it up to the higher paid officers. This is done in any job situation where the outcome can effect careers. Its "not my pay grade to make this decision" would apply here...

I love when he said 22 years. Yeah for 22 years you been getting away with it and more than likely have been been given the professional courtesy before. Now that everyone has body cams it’s added a way higher level of accountability to the officers. I wonder if you go back through his body can footage to see how many times he let someone else go, cop or not it would be zero.

Years ago we may have had a different view on drunk driving, ya it killed lots of people, but cops used to let people go and even give people rides home and just parked their car and take the keys. Some cops even owned bars and served minors. Drinking age was 18.. Now officers MUST arrest DUI suspects,

Honestly, I think most people would use anything they thought would work to get out of a traffic stop. I've seen politicians introduce themselves by their titles, lawyers and judges mention their profession as they're handing over their licenses, many women flirt or cry, and men try humor or outright indignation. Nobody likes tickets.

Should be more irritated by the reaction of the other extortionists. It's natural to try to get out of being extorted on the side of the road. It's criminal to attempt to cover it up. Watch the video again and you'll notice the economic terrorist doesn't know what to do, it's a fellow terrorist in blue he pulled over to extort. He's making and taking multiple phone calls. What does he say when he answers the phone? Not "Hello" no he warns his fellow criminals in blue that "I'm live" over and over and over. These people have something to hide.

The fact the jeep passenger and driver were allowed to exit and enter their vehicle as they saw fit without being thrown around is astounding. This isn't just a bash at a cop given another one leeway to screw about but a real risk to officer safety. That woman already had an attitude with the traffic stop, both are inebriated, and you have no idea if there are any firearms in the car. Turns out there was and any one of them could've suffered the consequences.

It amazes me that #1 he had a previous DUI arrest at age 20, why was he a deputy in the first place, #2 even after in handcuffs he is still crying how its everyone's fault but his and how they are ruining a 22 year career, no he ruined it, he made the decision to drive intoxicated and thought because he was law enforcement he would be treated differently, A brotherhood is based on trust, he chose to break that trust and dishonor himself and his department

He was shocked that 22 years on the force doesn’t allow him to drive drunk. That shows how screwed up policing is in this country. The cops on scene were far to accommodating and reluctant to bring him in. They did it but they sure didn’t want to. As the daughter of someone that lost a leg to a drunk driver, that really makes my blood boil.

I would have definitely set his wife straight and informed her that i’m in control of the traffic stop, not her. Second, IF any type of leniency was going to take place, its gone after he failed to keep his wife in her place, especially with him being a law enforcement officer. lastly, his badge wouldn’t save him from being arrested because of the reasons previously stated.

He did the right thing. He didn't have the training for a DUI investigation so dumped it on the Highway patrol. The fact they just blew him off waiting for the FHP means nothing. The charges could have been beaten if done the other way.

These body cameras really hold everyone accountable. You can tell on officer stops how unnatural it is for them to do the right thing in a lot of these situations. They always make sure everyone knows that the cameras are on.

So according to the info in the description of this video, they must have decided to NOT charge him with making an “illegal left turn at a red light” or being in “possession of a firearm while being legally drunk with a BAC of .25!!” This DUI conviction apparently wasn’t his first rodeo either as it says he received his first DUI at age 20!! It’s really sad when “entitled” guys like this dude tarnish the reputations of other upstanding, hard working LEO’s!!

No other government agency that has cameras on them are allowed to turn them off so why do this blue line brotherhood get to pick and choice when the cameras are on? preface for clarity: the final outcome is as it should be. Drunk driving is a matter of life and death, I’m thankful the officers on scene fulfilled their duty. That said, it’s worth noting that all of us in the comment section are compelled to applaud the officer simply for doing his job and applying the law to a fellow officer as it would be to anyone else. This tells us that we all understand the law is not applied evenly, and officers are held to a different standard than the rest of us at times. Despite the positive outcome here, there are several instances of behaviors that would be viewed differently if not for the driver’s status as a Sargent. 3:59 passenger exits, approaches officers and says “are you almost done?” 6:49 driver refuses to exit the car when asked by officer. 15:53 driver exits car and approaches officers asking “what are we doing?” 19:49 driver exits vehicle to urinate on the side of the road. In our world where insufficient deference from some civilians is perceived as threatening, these actions would not be tolerated if it were you or me being pulled over. Again, the final outcome is correct and this isn’t criticism as much as it is observation that points to a truth of our multi-tiered application of the law.

This is why I'm for the body cameras. For straight accountability. This is like the 20th video I've seen where the criminal (police officer - drunk driving, or driving under the influence) tries to use "courtesy" to get out of the stop. It seems like this was "standard procedure" to allow fellow police officers to disregard the law. The camera also just documents the whole encounter, and provides a record for both the suspect and police (for an excessive force complaint or other such scenario). It is win/win for everyone.

The real issue is the "accountability" part and it is largely missing nationwide. These types always either get to go to rehab for 30 days or get rehired in a year once their DL is good again and they can be hired. Most States make it difficult to find data on misconduct. The other enormous issue I see that body-camera's will never fix, is the over-use and ABUSE of encryption. You have city cops who make $45,000 a year driving $100,000 cars and carrying $8,000 a piece Motorola APX 8000 "Military grade" encrypted radios. Even dispatched calls are encrypted, and many fire departments have also gone encrypted as well, and they carry the same $8,000 radios and $1200+ a piece body armor/plate carriers now that mass shootings are so prevalent...Fire departments are acting like they need all of this. As a photojournalist who covers an area that is completely encrypted (law enforcement, fire, ambulance) I can tell you this allows them to hide 90% of the crime. Since media can't hear anything that's going on, unless it's a large wildfire and on analog or non-encrypted frequencies. So our county as small as it is has nearly 4 million people, yet our Sheriff's Department is just now getting bodycam's and they have a few KZbin videos, one or two OIS so far captured on body-cam. Yet the much smaller Polk County Sheriff's department in Florida has hundreds or thousands. Sheriff Grady Judd exposes and tells all, so the community is aware of what is actually happening. Now even though are local Sheriff's department is like the second largest in the Nation and our population is much higher. This leads me to believe my Sheriff's department is doing the complete opposite and is doing everything in their power to hide crime. They believe it lowers property values or they just don't want to admit how bad things really are? Any expert in warfare will tell you, you win wars by listening and or watching/surveilling. This is how we were able to capture/kill so many top terrorists and stop many attacks before they occurred. Listening. When the media and community can't hear anything and rarely see's anything, it's almost as if it does not exist, yet we all know it does exist. I can understand law enforcement and fire departments feeling the need and actually I agree law enforcement does have a need for encryption. For example, SWAT, SIU or Narcotics type sensitive activities should be allowed to use encrypted frequencies. A larger fire department like Cal Fire in California have their own law enforcement and I wouldn't have an issue with them using encryption or NOT using body-cams as they investigate arson and deal with C.I.'s or informants. But to encrypt dispatch and regular old medical or fire calls is ridiculous! Plus it's not like we get to see ALL body-cams and they can MUTE or turn them off, so it's better than nothing, but were far from true or full "transparency!" If that little Polk County has that much crime going on, I can't imagine what's being hidden in my major/huge population county.

I've said it before and I'll say it again. Law Enforcement Officers should face double consequences for breaking the law that citizens do. They are tasked with upholding the law and should be held to a higher standard when they break it.

If we can have special penalties for laws against officers (assault on an officer is a greater charge than regular assault in most jurisdictions), then we should be able to have special penalties for police officers.

When she walks up and tells him to "Hurry up" should've been handled the same way as a civilian would've been handled. But, WAY more importantly, him refusing to follow the officers commands to step out should have REALLY been an issue. I wouldn't get away with that.

The original arresting officer was weak and afraid to make a move. The entire stop he was looking and hoping someone else would make decisions for him. He failed to take control over the situation

I've never been a cop, so I guess I don't understand the exact pressure to let fellow officers go. But I imagine it's the same as any other situation where there's pressure to do the wrong thing. I can't imagine essentially admitting on camera that if the camera was off, I'd be letting the guy go. There should be no tolerance for even saying something like that.

It's not about right or wrong, it's about defending their own jobs. If they wrongfully arrest an officer it's exceptionally more likely they get in trouble than if they arrest a random guy because the officer is backed by his entire department. Is that fair? No.. of course not, every citizen should be given the same allowances and treatment, but you can't blame the individual officer for fearing for his job by arresting the wrong guy and checking with his manager on how to proceed.

I love every time a cop gets caught up breaking the law, its always about how long they were a cop and how horrible the other cops are for doing their job. Imagine all the non recorded traffic stops, that cops have let cops off for crimes, a normal citizen would have to fight in court.

I am absolutely livid at the way he flashed his badge and thought, "This will cover it." His wife was just as bad with her comment about hurrying it up. The fact he is or was law enforcement doesn't make a rat's ass. He has no special privileges than any other person caught drunk behind the wheel. I'm also a little peeved at the FHP officer for his statement of "If I take this traffic stop over...", that seemed a little like , "If you tell me to leave, you can handle it the way you want." Law enforcement must be held to a higher standard of conduct, him driving drunk put the public at risk as much as if he were randomly firing his weapon in public.

I'm way, way more livid at Uvalde than you'll ever be. I lost almost all respect for law enforcement, that dark day, recently. That's sort of like the slogan "To Protect and Serve" or whatever crap you see on the side of Police vehicle's. It's just a slogan and the courts have ruled over and over again, law enforcement has NO duty or obligation to do anything. Law enforcement does not have to protect you and they can't be forced to enforce all laws, there is discretion and their is free will, to do good or evil. Look at Uvalde and tell me about some law enforcement slogan or bullshit stickers and T-shirts these pussies wear or place on their big lifted cop trucks. Got punisher and AR-15 sticker's and hats, yet just stand there while little kids get slaughtered down the hallway, begging for help. Meanwhile they are pointing their guns at the ground, each other, checking phones, getting hand-sanitizer and doing FUCKING NOTHING! I was one of the few people who still supported and almost always took the side of the cops, I even used to want to be a cop. Now after watching Uvalde (with audio)....FUCK COPS! Bunch of macho assholes who THINK they are tough. Most cops are either former bullies or were the victims of bullying and so they want power. Either way, it's a toxic workplace and they all either have PTSD, marriage issues, drinking issues, etc., etc. Were all just people. I'm far from perfect and I'll be the first to jump in and help or protect a cop if I saw one in need. In fact I've already done that quite a few times, since I cover breaking news and I'm always around them or even arriving before them. I have nothing but respect for the "real deal" men and women who wear the badge. They are an impressive and inspiring bunch of people and should be looked up to, but man Uvalde...changed my worldview. How could it not? They were arresting the parents and keeping the parents from saving their own kids, and by the way a "barricaded" suspect is like a bank robber or Liquor store robbery that went bad, police showed up while you were still inside and the suspect holds the adult clerk hostage, or whatever. It's not a barricade when a crazy man (wearing body armor and all black) runs into an elementary school with guns a blazing. That is called a massacre or mass shooter and we've been training law enforcement Nationwide since Columbine to end the threat, Violence of Action, once you get a second or preferably 3-4 officers, you make a quick plan and GO IN! Your fat old ass or a 7 year old little girl, whose scared to death. It's so despicable....it makes me so mad. They just fucking stood there, they should've gotten outta the way and let the momma bears tear his ass apart. The kinds of little twerps or weirdo's who shoot up schools are the weakest, bitch ass little skinny kids and they were terrified of him? That little bitch who is so tough he shoots innocent little kids, that is who scares you? All of those bitch ass cops in Texas should turn in their fucking badges! Pussies! You made all of American law enforcement, no scratch that, you made American's look like weaklings to the world.

I get what you are saying, but my take on it was….he wanted to go ahead with the fst’s, and was told “no”, he tried to continue with the stop and was told “he is fhp and go easy on her”, then he was told “no” when he asked the officer to come back to his car. At that point anything he knew to do, was trained to do, he was being told “NO”, so maybe he gave up? Clearly they need to have a class on WHAT to do when you pull over a fellow cop, no matter what branch or what rank!!!

I dealt with drunk, rude, and ignorant adults as a bartender for many years, and now I teach 6-year-olds. While teaching young kids presents many various challenges, I have so much more patience for kids than adults (especially the super douche canoe ones), hands down.

There should be no officer discretion on these stops. Every law enforcement officer should know the exact consequences for drinking & driving, which should be automatic termination of their job and badge. They know it’s illegal before they get behind the wheel so thinking they are above the law is a dangerous mentality.

BECAUSE of that, I would absolutely treat them the same as anyone else drunk driving, and then, when we can talk privately, show compassion. No way would I treat them differently. And I would expect them as my family to understand why this is absolutely what I have to do when anyone I pull over is over the limit! There would be no empathy - I do not drink and drive so I’d be incapable of having empathy.

Honestly, of all people who have seen the damages done by DWI, these people really know better. What if he had hit another vehicle with a family inside? No cop wants to arrest another cop, but kudos to those involved for doing what they would have done to any regular Joe. Shame on this officer for drinking and driving. And to his wife, you think because your husband is a LEO that give you the right to hop out and tell the officer to hurry up? Shame on you, too.

Did you see the sheriff that was pulled over and he was trying to get out of a DUI? The arresting officer and his boss both stood on the side of the road for a looooong time and went back and forth but the good guys stuck to doing the right thing. Give these guys a break...we all have a devil and an angel on our shoulders.
