We spoke by phone and I sent her a copy of the video to view in advance. It has her blessing. But what if I hadn't been able to get in touch with her? Or if she had said no. What then? One consideration is the content of the call itself, and whether it might be protected as "private facts" about which the victim had a reasonable expectation of privacy. Based on the content of the call, that doesn't appear to be a concern here.(1) The bigger potential issue is the distribution of a recording that was made without the knowledge and consent of all parties. Florida makes it a crime to intercept or record a "wire, oral, or electronic communication" unless all parties to the communication consent. See Fla. Stat. ch. 934.03. The crime is serious, too. Dewitte is facing felony charges for this recording. And the statute? It doesn't end there. Guess what's also a crime? "...(c) Intentionally discloses, or endeavors to disclose, to any other person the contents of any wire, oral, or electronic communication, knowing or having reason to know that the information was obtained through the interception of a wire, oral, or electronic communication in violation of this subsection." Doesn't sound too promising, right? Well, the United States Supreme Court tackled this issue head-on in a 2001 case captioned Bartnicki v. Vopper. *BARTNICKI et al. v. VOPPER, aka WILLIAMS, et al.* ON WRITS OF CERTIORARI TO THE UNITED STATES COURT OF APPEALS FOR THE THIRD CIRCUIT [May 21, 2001] (Recommended: Hear Justice Sandra Day O'Connor announce the opinion of the court. Click tiny.cc/oconnor then click the "opinion announcement" button on the left.) "Justice Stevens delivered the opinion of the Court. These cases raise an important question concerning what degree of protection, if any, the First Amendment provides to speech that discloses the contents of an illegally intercepted communication. That question is both novel and narrow. Despite the fact that federal law has prohibited such disclosures since 1934, this is the first time that we have confronted such an issue. The suit at hand involves the repeated intentional disclosure of an illegally intercepted cellular telephone conversation about a public issue. The persons who made the disclosures did not participate in the interception, but they did know-or at least had reason to know-that the interception was unlawful. Accordingly, these cases present a conflict between interests of the highest order-on the one hand, the interest in the full and free dissemination of information concerning public issues, and, on the other hand, the interest in individual privacy and, more specifically, in fostering private speech. The Framers of the First Amendment surely did not foresee the advances in science that produced the conversation, the interception, or the conflict that gave rise to this action. It is therefore not surprising that Circuit judges, as well as the Members of this Court, have come to differing conclusions about the First Amendment’s application to this issue. Nevertheless, having considered the interests at stake, we are firmly convinced that the disclosures made by respondents in this suit are protected by the First Amendment." *The Attorney General of Florida has written in agreement* "The First Amendment takes priority over wiretap laws to protect a person who discloses the content of a telephone conversation that was illegally intercepted and taped by someone else, the U.S. Supreme Court held. In a 6-3 ruling, the court said First Amendment protections prevent a Pennsylvania radio host from being held liable for broadcasting a recording of a cellular telephone conversation. The host received a copy of the conversation between a labor union president and his chief negotiator, but did not know who intercepted the conversation or recorded it. The union negotiator sued, claiming radio stations that broadcast the conversation violated state and federal laws, but the broadcasters said they were protected by the First Amendment. The Supreme Court agreed that when a media outlet obtains the information legally - even though the information was gathered illegally by someone else - it may not be punished for broadcasting or publishing the information concerning a matter of public concern. “(A) stranger’s illegal conduct does not suffice to remove the First Amendment shield from speech about a matter of public concern,” Justice Stevens wrote for the court. “In this case, privacy concerns give way when balanced against the interest in publishing matters of public importance. ... One of the costs associated with participation in public affairs is an attendant loss of privacy.” Good news! 👍(2) ~~~ (1) Publication of private facts is something all journalists need to be very careful about, as in most states, you can be sued for publishing private facts about another person, *even if those facts are true.* The term "private facts" refers to information about someone's personal life that has not previously been revealed to the public, that is not of legitimate public concern, and the publication of which would be offensive to a reasonable person. For example, writing about a person's HIV status, sexual orientation, or financial troubles could lead to liability for publication of private facts. However, the law protects you when you publish information that is *newsworthy,* regardless of whether someone else would like you to keep that information private. In addition, the law protects you if you publish information already exposed to the public eye and particularly so if that material was obtained from publicly available court records. (Despite the law's substantial protections for legitimate reporting on matters of public interest, it is a good practice to obtain consent before publishing sensitive private information about someone.) In Illinois it's legal to record a conversation without consent and I use ACR call recorder on my phone. Due to recent changes in laws the app has to conform to stricter guidelines. The only major change implemented was, the phone number the call was with wouldn't be saved. So you would need to manually save the number with the audio. My only question about this is that when you call almost any business the calls are recorded. If he was doing this under the guise of his business does that change anything? I think that the state is reaching with some of these charges though.

For some background, the police made this guy rich. They worked with him for a decade and enabled his shenanigans. What you're watching is the failure of the local police because they 100% enabled this guy's behavior. He has his own KZbin channel in which you can see him interacting and being hired by the cops. Police would hire him to do community patrol in which they would take over neighborhoods like Marines do in Afghanistan. He became very wealthy from this which is how he became the owner of an entire fleet of cars. This isn't a police impersonator. It's a police lackey that they allowed to wreak havoc on the community for a decade.

Can confirm "security officer" is a thing, it's the actual state licensing term for it in my state. My license literally says "Commissioned Security Officer" on it. But I absolutely hate being referred to as "officer". Because I don't hold, nor am I sanctioned by, a federal, state, county, or municipal government office. I'm a private contractor who carries a firearm.

To be fair, the amber and purple lights are not his choice, it's what's legally prescribed for funeral escort vehicles. Though as mentioned in the arrest warrant, the statute that allows these lights says amber OR purple, and they have multiple of both, plus red lenses on some of the vehicles.

They can't to ths degree, hence the charges. I advise you to read the arrest documents at the end of the video. They are NOT allowed to use sirens, they did. They are only allowed to use an amber OR purple light. They used multiple strobes of both colours at the same time. Read the documents. They write him up on everything he's doing. The 'uniforms', the paint schemes of the cars, they call his staff out for wearing guns and/or tazers, badges, police style logos. Busted!!!!

the law also give NO AUTHORITY to direct traffic, act as a traffic control device, or break ANY traffic laws for such a service. Basically all they are supposed to do is drive at the front of the procession. He was going ballistic over people ignoring him and trying to order cars out of line or running them off and making them stay on the side of the road as "punishment" for cutting in line or ignoring his orders. He literally chased people down and held them on the side of the road while the procession passed, when there were multiple lanes of travel in one direction.

I hear his cohorts in the background supporting this lunacy... Will they be charged as well in this dispute? As it seems that this "private company" has no discrepancy for the actual laws in place, or is he the only one going down for this?

Tyler LaRowe I think you’re not fully understanding this situation. He found out that lady called his supervisor via wiretap and then proceeded to call her. There was a video a few weeks ago on this man pretty much taking his job way to far and pulling people over because they were in the way of the funeral traffic. They can legally block traffic for the funeral traffic.. which I’m sure you know that if you’ve been to one. This guy does more things on the side and actually pulls people over. No one else in that company does it but him.

They have a decent semblance of the law, they wouldn't be doing funeral processions or had this company for this long. They just let their ego take over and started to let the cars and uniforms go to their heads.

@JayDee That's actually not true. His employees have been hit with charges recently as well. Randall Brocius was arrested for openly carrying a firearm -and- -false- -personation,- -and- -Victor- -Lopez- -was- -arrested- -for- -false- -personation.- On top of that, Metro State is currently the defendant in an eviction lawsuit. Doesn't look like they'll be doing much funeral escorting anymore. Whomever was protecting them isn't any longer. *UPDATE* Victor Lopez contacted me to inform me that he and Brocius had not been arrested for false personation. I don't know if he is aware, but it appears that Lopez and Brocius only narrowly avoided arrest themselves (assuming that charges are not still coming). I don't usually get things wrong, and I owe you an explanation as to why I believed that they had been arrested. I could have been more thorough, but I believe that my conclusion was reasonable. Document excerpts that explain it are in a Google Drive folder at tiny.cc/personation (I intend to contact OCSO to find out why Lopez is listed as a "defendant" with a false personation charge and bond amount.) In investigating my error I came across some other information: On 11/19/19 Brocius was arrested while driving an unregistered Metro-State ambulance. Yes, you read that right. (The ambulance had tags from another vehicle on it, and Brocius' driver's license had been suspended for failure to pay child support.) On 11/24/19 Brocius received a citation for driving a vehicle with unauthorized red/blue lights. Lopez's history isn't squeaky clean, either. In 2014 he pleaded no contest to charges of theft by fraud, accepting a plea deal wherein he paid $2,700 restitution, and was sentenced to 2 days jail with credit for 2 days served, followed by 18 months probation with early termination possible after 9 months. Lopez was also required to complete 100 community service hours, take an impulse control class, and pay court costs. He had been working at a RaceTrac and was caught on video conducting fraudulent refunds of large amounts of 5 Hour Energy drinks. The details: "I then spoke to Alexis Rivera, the manager of Store RT90, who stated Victor was an associate at store RT90 for approximately five weeks and worked with Alexis approximately two to three days a week. On August 22, 2014, Alexis took inventory and observed 830 to 840 "5 Hour Energy" shots were missing. He received an e-mail from Wendell on the same day advising of suspicious refund activity at his store. After printing the reports, Alexis observed Victor had the highest and most number of refunds. Alexis then looked at surveillance footage based on the dates of the suspicious refunds and observed Victor creating fraudulent refunds and stealing money from the register. Alexis observed Victor reach over the counter to grab the 5 Hour Energy shot, refund the money, put the money aside on the drawer, bend down to make a "drop" and place some of the money in the left pocket of his pants. On August 26, 2014, he and Wendell confronted Victor about the incidents. Victor verbally admitted to both Wendell and Alexis about the fraudulent refunds and stealing of money. Victor advised to both men he did not know why he did it, but that a voice inside his head was telling him to take the money. Victor then disclosed he still had approximately $1,700 in cash left and the rest he had used to buy merchandise like a watch for $500, movies, and food for homeless people. Alexis provided a sworn written statement. He is willing to testify in court."
