I'm so glad that she was willing to listen. A lot of people seem to refuse to admit when they don't know what the rules are regarding service dogs. I've seen a video where a guy was demanding service dog papers from a handler and the guy told him they can't legally do that. The guy's response really baffled me, "There's no such thing as a constitution when it comes to a private business. Your rights aren't really valid, we can ask you to leave anytime you have no right to be here."

They can ask you to leave and even have police trespass you from the location. You in turn should get the police to document that it was because you had a service dog so you can sue them later for discrimination.

Also they can’t ask those questions if it’s obvious. I have a Guide Dog in training. She behaves exactly the way she is supposed to unless people bother her and distracting her. She also has a hard time with being distracted by other dogs mostly looking but the other owners dog was barking at Angel and that’s why she was looking. This happens in my building where I live. The neighbours always accuse my Guide Dog of things that she does not have anything to do with her.

This is for Texas....not sure if that's what state your in, but here are the rules, laws, guidelines of that state as every state has their own.... Service Animals in Training A service animal in training shall not be denied admittance to any public facility when accompanied by an approved trainer who is an agent of an organization generally recognized by agencies involved in the rehabilitation of persons who are disabled as reputable and competent to provide training for assistance animals, and/or their handlers. Human Resources Code Section 121.003(i) Allowable Inquiries About Service Animals by Staff A person is not entitled to make demands or inquiries relating to the qualifications or certifications of a service animal for purposes of admittance to a public facility except to determine the basic type of assistance provided by the service animal to a person with a disability. Human Resources Code 121.003(l)(1)-(2) I'm not sure that it's against the law as you say, but that they're really not entitled to that knowledge. 😉 This is all with the assumption that Texas is the state your in...if not there's a whole listing of each state with all the info.

In the USA it is not required for a service dog to be trained by a specialty facility, or to have documentation stating that it is a service dog and has been trained. No one shall ask for proof of documentation, because it does not exist. Here is the FEDERAL ADA website for more information www.ada.gov/service_animals_2010.htm "Staff cannot ask about the person’s disability, require medical documentation, require a special identification card or training documentation for the dog, or ask that the dog demonstrate its ability to perform the work or task." www.ada.gov/regs2010/service_animal_qa.html Q17. Does the ADA require that service animals be certified as service animals? A. No. Covered entities may not require documentation, such as proof that the animal has been certified, trained, or licensed as a service animal, as a condition for entry. There are individuals and organizations that sell service animal certification or registration documents online. *These documents do not convey any rights under the ADA and the Department of Justice does not recognize them as proof that the dog is a service animal.*
@foxbiscuit
@foxbiscuit 6 жыл бұрын
The certificate from the trainer is basically a diploma saying "hey! I passed my training! :D" It's not required for anything, and is really just to hang on your wall.
@aaliyahsarge432
@aaliyahsarge432 6 жыл бұрын
If the dog is trained through a program which specializes in training dog's to be a service dog , the owner's are sometimes given a certificate at the end of the dog's training, just to be like " Hey, my dog completed training to be a service dog ". Almost as if someone won a Certificate for winning in a science fair, that doesn't mean that they are a trained scientist. If you do get a certificate from the program that your dog was trained at, it doesn't count as legal paperwork, because the ADA does NOT recognize service dog's as having an ID, license, etc.

So even if you don't have a vest on your dog that states the dog is a service dog, it would be illegal to say hi puppy/distract when you walk by? Or do you have to have the vest on for it to become a legal issue?

i have a legit question for anyone willing to be kind and answer! if i adopted a dog to train as my emotional support/service dog for my severe anxiety and ptsd, and i went through a website, the dog isn’t actually ok to be in stores and work? i was told it was ok by a mental health professional so i went ahead and did it, i spent a lot of money on it and the dog is extremely smart and helps me. she isn’t vicious and gives me cues letting me know to calm down.
@cielonehellofaservicedog4648

No, those papers are worthless. So many health professionals and doctors have zero clue about service dogs. An emotional support dog or ESA are not service animals either. ESAs lack task training, as well as public access training (obedience such as heeling and ignoring distractions). What makes a service dog or service mini horse (the only two species allowed under federal law the ADA) is the task training. Tasks are specific actions or work the animal preforms to mitigate your disability. Join the community on facebook! 😁 Plenty of groups out there, some toxic some awesome, but regardless you will learn a lot! Here is the laws and resources for you! Also, a doctor note will be required for housing or airline travel, but not for public accomodation access (grocery, bank, hotels, etc). Using papers or even ur doctors note for public access sets up teams to fail, such as u can see in this video. I reccomend that your dog be able to pass the Public Access Test (PAT) or the CGC (the AKC administers them at petcos), but they are not required. Also, if you have to go tp court for any reason it is important to have training logs and vlogs to show obedience AND tasks. Good luck! For state laws: www.animallaw.info/topic/table-state-assistance-animal-laws (May have some holes in information, but very comprehensive! and cited well) For employment: www.dol.gov/general/topic/disability/ada For Schooling: www2.ed.gov/about/offices/list/ocr/504faq.html (This overlaps with the ADA and FHA some, so make sure to read Title 2 of the ADA FAQ and the FHA on service animals above) For housing: www.hud.gov/sites/dfiles/PA/documents/HUDAsstAnimalNC1-28-2020.pdf For Air Travel: www.transportation.gov/individuals/aviation-consumer-protection/service-animals-including-emotional-support-animals For public access to public accomodations: www.ada.gov/service_animals_2010.ht www.ada.gov/regs2010/service_animal_qa.html Finally, a great rescourse to learn about the various laws that may protect your right to use an ESA and/or service animal: adata.org/factsheet/service-animals

With passing out' seizures, low/high blood sugars/blood pressure things like that. There are chemicals that change they can smell the changes. Example my blood sugar is almost normal, Snow my SD she knows that chemical smell. Then my blood sugar go up to 372 that chemical changes and she can smell the change with that. This gives her the signal to alert to my high blood sugar.

If it’s a service dog from certain veterans organizations they do give the recipients paperwork for the dog. That’s the only paperwork I would ever expect someone to show. Nonetheless it’s illegal to ask and it shouldn’t be done. But I do know that my brother friend received paperwork for his dog from veterans organization

Yeah programs do give paperwork of completion, however presenting that instead of educating employees/staff is a problem. Cause now they expect the next team to have it. when the majority of service dogs are owner trained, you can see where that sets teams up for failure after you.

I’m a little bit late but I hope I can be of assistance. If your anxiety is disabling (limiting one or more daily life functions, enough to the point you can’t do things for yourself) then legally you are. It would probably be best to ask your doctor (psychiatrist or therapist would be best though) if a service dog would assist you.

WolfLynxinar Probably shouldn't. The best thing to do is to ignore the dog and only speak to the owner if you must. Of course, compliments such as "I'm so happy to see such a well-trained dog" are always nice but don't distract the dog. (Distracting could be making kissy sounds, looking the dogs in the eye, tapping the ground, petting etc.)

Dcn Yes, I realize that but if you distract the dog you risk the dog missing an alert that could, seriously hurt or even kill the owner. Service dogs should never be distracted when in public, or at home if they are working.

I know this might sound unfair to many people, but with all the people that are taking advantage of the laws on service animals, I think there needs to be some way for stores to confirm that the animal is there for service. I see more and more places where people are bringing their animals (mostly dogs) into stores and the like where in the past they never would have been allowed. If the service animals aren't required by law to have vests identifying that they are legitimate service animals, and establishment people are not allowed to ask them whether their animal is a service animal, it certainly limits what they can do about animals that do not belong in the store. There is a woman from my church who was training service dogs for a while, and according to her, the identifying vests were required by law. Go figure (I looked it up and you are correct).
@enchantingsavant8741
@enchantingsavant8741 6 жыл бұрын
Nathan .Vanderslice It’s really not as hard as people make it out to be. Legally a business may ask two questions: 1) Is that a service dog trained to mitigate a disability? 2) What tasks has it been trained to perform? If a person does not or can not answer the questions, they can be denied access. If the dog is given access and later begins to misbehave (not listening to the handler, not being housebroken, and just generally causing a nuisance) then they can ask the dog to leave. A real service dog behaves well, fakes do not.
@84953
@84953 6 жыл бұрын
You are correct, however the problem is that there are people who are bringing so called "service animals" which are actually emotional support animals (ESA's), and in many cases they are not even that, it's just someone's way to get their pet on the plane without having to pay the fees, and not have them in the area of the plane (in kennels or travel crates) While you are correct on those two points, employers or businesses are not allowed to ask for paperwork to prove that the animal is a service animal.
@enchantingsavant8741
@enchantingsavant8741 6 жыл бұрын
Nathan .Vanderslice Planes are different. They fall under the ACAA (Air Carriers Access Act), and as a result have different rules. People with ESA’s have to provide paperwork, some service dogs don’t. (Psychiatric service dogs do)
