"Didn't know the law" is a BS excuse, it's a 27 year old law, there is no excuse for a business owner not knowing it these days.

Ignorance of the law is not a defense under the ADA or ADAAA in civil or criminal court. The ADA was passed and signed into law by Bush Sr. in 1990 and ADAAA by Bush Jr in 2013. Plus NYS has its own version of the law protecting Service Animals that offers additional and greater protection making Discrimination a Misdemeanor and civil rights tort.

These business owners do know the law is out there and they often choose to ignore it. It really should be mandatory to where each place of employment should be forced to learn that they are denied the right to deny service dogs.

I dont think the dog is fake but this woman is definitely misguided she is going to end up seriously hurting her dog. The dog is only 13 months old! Dogs should not be doing any sort of mobility work until atleast 2 and fully cleared with OFAs from a licensed veterinarian! Even then mobility should only be done with a proper harness designed for mobility.
@ohana8535 Жыл бұрын
Does it hurt to pick up a puppy? She put no downward pressure on that handle, and that is just fine. You only need OFA's if you use downward pressure. Using the dog for counterbalance is fine at that age. They don't have to be two. There is also nothing wrong with that harness for counterbalance either. I guess you don't know as much as you think you do.

service dogs usually take 2 years to train....smart dog to graduate before 15 months...i sure hope the jouranlist verified this was in fact a SD before making a case of it. I have used a dog for balance and momentum, but she was not trained, i just held the leash in a way that it helped me. I never brought her to any no pets places.

i never heard that. There is a required EEOC notice for employees, but I have never seen a notice for 'public accommodation' other than my state law poster. And I don't think the EEOC poster specifically mentions SDs

If you’re gonna run a business, then you should allow service animals into your store, because it’s a whole difference when you allow a service dog handler to bring their dog into the business, also you should train your staff on how to handle service dogs. The two questions you’re employees are allowed to ask are -Is that a service animal? And -What task has this animal been trained to perform? Get yourself knowledged on the ADA law, state and federal laws requiring you to run a business.

this isn't a store. This is a restaurant. You think people want dog fur flying around while they're trying to eat their food? What about the people who are allergic to dogs? Now people aren't going to be able to go out and eat because now dogs are allowed everywhere?

Your Service Dog ID card will have your Registration ID listed so that a third party may verify your registration at any time, any place. Service Dog Certificates or ID cards can help service dog handlers signal to members of the public that their canine is a trained service animal. Just CARRY your card
@GoldRangerFanGirl35 Жыл бұрын
Here in the US that is not required

That is a choice for a Handler to make, not you. There is no documentation required for public access. If you feel some kind of card helps, you can choose to use it. I don't agree with using one because it teaches business they are required when they are not. You really need to be educated before you educate others.
