@shakennotstirred32 the lower standard was mentioned as a point how CDL drivers are held to a higher standard. The violation the judge referred to was having alcohol, (beer) in the back of the car. We didnt see or hear the original violation, so we are left to assume. Having unopened containers is not a violation in your own car, open containers of alcohol is. He could have been out with friends, driving or parked and was contacted by law enforcement, Was he drinking? But not enough to go above .04? Who knows? The judge made it clear that he suspends the license of anyone who appears before him with that charge. The issue here is that for most people, it is an inconvenience, for someone who holds a cdl you lose income, you cannot work, your employer may fire you.

It doesn’t say anything about any prohibition when you’re off duty and buying and transporting alcohol in your private vehicle. Your own family car is NOT a CMV, thus CMV rules don’t apply! If this was a case of a >.004 DUI or an open container, then that’s illegal regardless if you’ve got a CDL or just a regular DL.

In Minnesota the driver can not be in arms length of the alcohol. So it has to be in the trunk or the the back seat. What gets me is they hold us CDL holders to a higher stranded, even in our personal vehicle but law enforcement are not held to that same standard .

Every time someone says "you're a professional driver" I hear "I expect you to have infallible judgment and be able to predict the future" no lie, in cdl school my instructor told me a story (i wish i had pressed him for details) about a driver who was assigned fault in an accident for speeding DAYS before that accident on the logic that if he'd been going the speed limit, he wouldn't have been in that place at that time and the accident would not have occurred. He also had another one about a friend of his who didn't get over for a merging car. The law is very clear that the freeway doesn't yield, it's on the vehicle merging. Well, the lady in that car got angry at him, sped around him and cut him off, clipping his bumper, which caused her car to flip, and she died. He was blamed. If i recall correctly, they said him failing to move over constituted aggressive driving. He didn't go to jail, but his company had to pay some ridiculous settlement, even though from both a legal standpoint (if he'd been just a regular class d) and a common sense standpoint, he did NOTHING WRONG

They don't even care that they're ruining someone's career and life over a legal technicality because of that "higher standard". They just see another potential 40 million verdict and want a piece of it. I'm not saying truckers shouldn't be held to a higher standard, after all, a truck can be extremely deadly, but it's open to abuse.

I started driving in the late 80's when there was a massive push to stop drunk driving and was always told to put the booze in the trunk because the police had zero tolerance if it was within reach in the front seat or back seat. My license was my money maker so I never put it in jeopardy. Back then we were also made aware a drunk diving conviction could prevent us from entering other countries. Feel bad for the guy, that's a brutally hard lesson to learn.

When I was a nurse I worked well over 70 hours, when I was a Corpsman in the Navy I worked well over 70 hours. well if that's the case then this is all good. we were all just concerned that the judge wasn't being Draconian or unreasonable. now that you have explained it thank you. it's a fair chastisement now that I know the facts. as a CDL driver all we ask for is fairness and not to be singled out or discriminated against. but according to what you have said, this is fair.

I just retired months ago. 24years otr coast to coast border to border first chance i got went to motor vehicles office and got rid of my c.d.l. this is the reason I did it down graded to regular license 😂😅 every violation is way more costly...they can stick my c.d.l where the sun don't shine😅😅😅

Hold me to high standards on the road, but also extend those expectations to all other non-CDL drivers out there. Respect goes both ways: no cutting in front, no brake-checking, and please give trucks room when we’re switching lanes. Brokers, taxes, rising fuel, and insurance prices are already squeezing small companies and owner-operators hard these days. Mutual respect on the road can help us all stay safe and keep things moving smoothly.

I’m currently disputing a violation with the FMCSA because I failed a random breathalyzer test because I gargled with Listerine prior to the test that morning and blew a .06 and was fired! I don’t even drink. Now I have to complete the SAP program and no one will hire me. CDL down the drain

I just received a letter in the mail saying if I’m not back to Return Duty Status by next week my license is getting downgraded. Man they fukked me with no lube!

I was warned by dot for having listerine in the cab years back. It was alcohol free and I had to show him, otherwise he was going to breathalyzer me on the spot. Easy fine for them. Even if you fight it, the courts still getting your fees no matter what.

I've been on quite a few military posts with multiple weapons and many many DOT inspections with unopened alcohol in my fridge. In my CMV. Only ever consumed it during my first 10 hours of my resets amd never had any issues from authorities but I can imagine how closely we were watched.

Absolutely true. Most people get caught up in the excitement of getting the CDL and many run around with their noses in the air like they high and mighty LOL. When I went out for my first job, over the road, in orientation they said that having cough syrup with alcohol in it will get you a DUI. So I gave it to my dorm mate LOL....

I had a clp in 2014 and was about to attend trucking school. Got in a fender bender in Florida and my way back home to texas. Trooper gave me the ticket. Fast forward applying with swift this year and they didnt want me. It’s been ten years and this may still be haunting my record.

Everything I've seen from this judge has shown him to be an honest judge. This leads me to believe that the only reason he would do this was an open container. If that's true, anyone can have their license revoked for it.

Back in the 70's, a fellow driver was drunk at 5AM, ran into a moving train. He then drove home, and the Cops showed up and put him in jail. He called the Boss. He went down and bailed him out. He then clocked in and left for Warrenton, MO to pick up a load of Pepsi.

i live in Massachusetts. my uncle got his license(cdl) taken away FIRST time caught drinking and driving not on duty. they didnt even suspended his license like it says on the fmcsa for first violation. he had to go a whole year with no license and then take the cdl school all over again to get it back.

Don’t forget this little ditty also…anything you do in a CMV affects your car insurance. I was cited in a company truck for hitting a car at an intersection when I made a LH turn. The only thing that made contact with the car was the lift gate steps *behind* the trailer tires. The steps were pivoting away from his vehicle so he definitely pulled up, but the police believed the car driver who said he didn’t pull up. I still got cited and increased my personal vehicle insurance by 25% for 3 years. It goes both ways.

I attended a small family-owned CDL school, and on day one they started with "Your days of partying have ended." The first class session started with all of the responsibilities we would need to accept if we wanted to obtain the CDL. I guess they did it that way because some people, after finding out about the alcohol and drug testing requirements, would drop out and it's a whole lot easier on everyone if the people who are going to drop out do so earlier.

This happened to me, and then the cop lied & said I refused a test. The field sobriety test in CA said my lawyer. I offered my blood. I didn't refuse that test. I automatically lost my license for a year.

Yes accurate. I was in my personal light duty pickup truck will a small landscape trailer stopped at a red light. Traffic proceeded once it turns green as well as did I but the lady in front of me dropped her coffee Coke whatever on the floor and hit the brakes we were not doing but maybe 5 mph as we had just begun to move. I hit my brakes but ended up tapping her rear bumper and causing a paint scuff. Nothing more nothing rubbing compound in 5 minutes wouldn't take away. She called the police to get a report to give her insurance by the way would not pay for it because it didn't meet the $500 deductible. Bill called me two points and a following too closely ticket. I tried to explain the officer I wasn't following her as we weren't going anywhere. 5 miles an hour I don't think I would declare we were going yet. More like thinking about it maybe. Still got the ticket. Totally unrelated to anything CDL. An accident that did not even theoretically cause any monetary damage is you could have rubbed the dirt on there in that little scuff would have come off. Still that little ridiculous not even qualified fender bender (which didn't bend anything) was a pain in my tail for 3 years.

There is not a law stating truck drivers can't have alcohol in their possession while off duty in their personal vehicle. This needs to be appealed. The judge needs to be sued for attorney's fees and lost wages. He needs to be reported to the bar association.

There has absolutely got to be more to this story. I am a Canadian cross border long hauler myself and quit drinking 4 years ago. However, back when I still drank I had the following scenario play out three times in three different states (Florida - Love's, California -Flying J, Ohio -Flying J) with the exact same chain of events happen. I fuel and park my truck to do a reset, I go inside and grab a 6 or 12 pack and go back to my truck to enjoy the first night of my reset. A few hours and a few drinks later I see the flashing lights in front of my truck and that distinctive knock at my door. Hop up front, open window and get informed to get out of my truck. Upon doing so I get informed they received a "anonymous" call that a driver was drinking. I respond that ya I grabbed some drinks as I was just starting my reset and was enjoying them while gaming. They took my information, said it's all good but that they received a call so they are obligated to check, I respond ya all cool and I appreciate it as I don't want to share the road with people who are drunk either. I then am told I can go back to what I was doing and to enjoy my reset but to remember I need to be sober before I go back on the road. I hop back in truck and enjoy my reset while noting that they do a couple slow drive-byes through the next day but no further interactions. So something doesn't smell right if all he did was have a case of beer in the trunk of his car as that is where you are legally required to have it in a personal vehicle.

I had mine taken away and I had a designated driver. What did i do? No keys in ignition. No keys in my possession. Made officer aware of designated driver location. I was outside of my vehicle in a parking lot, yes I had been drinking. Five witness clamined to see me wearing all red clothing, witness were all intoxicated. Designated Driver had a red long sleeve shirt on, black pants, red shoes. I was wearing black t shirt, camo shorts, grey tennis shoes. All on body camera. Pled not guilty, found liable, cdl gone.

That judge or commissioner has no idea of the law. If he wasn’t drinking and driving this judgement isnt valid. You can purchase alcohol and drive it home. This case can be contested and overturned.
