It's a weird trend I seem to see, especially on Shark Tank US, where anytime someone comes in with a valuation of around or at a valuation of a million dollars, there business is usually worth at most, a 10th of that, whereas anytime someone comes in with a company worth a million, they usually manage to value it at 3-4 million.

Lori wants to sue for no reasons (the logos aren't similar), Kevin only wants to invest in already successful businesses and doesn't care about future prospects (Shark Tank is intended for startups, not big companies) and the other ones are rude and interrupt. When Lori said "confusion in the marketplace" she's referring to legal language concerning trademark infringement. They replied by talking about the product being different - its not about that, its about the trademark (logo) appearing to be similar enough to Lori's that the consumer will be confused or think its part of Lori's product. She will definitely have her lawyer contact them.

A few months go by and they’re at the store, they see the scrubbie and say “oh, that sounds just like the product they told me about! I’ll buy it!” The font and colors are close enough to cause confusion to a casual buyer. People don’t deep dive into the design of a logo when at the store casually browsing

The font and the name and the logo may be coincidental, but if we both look at their purposes for making the product, they probably copied off of Scrub Daddy. Plus its not a good idea to have a name+logo that looks similar to another product in the same market because it causes confusion.

I’m a graphic designer, they’re not the same at all minus the wording. NOT the same font, color pallet is wider than Lori’s and to be honest their logo is better than Scrub Daddy. That being said, this is a common situation with people who don’t study these things and I don’t blame them for not knowing it. However, I do take slight offense had I been in their situation and Lori said that to me. She doesn’t do branding and shouldn’t speak on the like-ness if she’s not 100% sure what that means as it’s an insult to the designer and ruins his/her reputation over something she was wrong about. It’s your exact response to this that shows the detriment it can have with miss understandings of design.

I still have an eye for design and while the Scrubbies logo was reminiscent of Scrub Daddy (could have just been the 'scrub' part), with the slanted wording, the yellow/blue color palette, and the slightly similar font, the logos weren't very similar at all. If this was taken to court and I was the judge, I'd have thrown the case out.

@@oknice8325 What you are forgetting is that Scrub Daddy is a well-respected brand with a preexisting customer base. This not only gives the product instant credibility but would also allow them to do a soft launch with their preexisting customers before scaling (this would mitigate their risk by proving the concept and if successful would have a big upside). Sure the product may not have had a crazy amount of sales when being pushed by 3 random guys that have no idea what they are doing but the concept is solid and once the Scrub Daddy team makes a couple of cosmetic modifications (to make it look less "industrial" and more appealing to consumers) the product could make a nice addition the products they are already selling.

You can watching it every week night on CNBC at 5 PM EST, and on weekends most of the time episodes run 11 hours from Noon EST to 11 PM. A great show!

They intentionally used that name and logo thinking Lori would want to add it in the Scrub Daddy business and offer them to work together or buy them out. That would be a good strategy if they had any sales, without sales they were basically asking to become millionaires by taking advantage of someone else's success.

So interesting fact about doing dishes: Most people own a dishwasher. Dishwasher detergent is specifically designed to utilize the enzymes that food particles leave on your dishes. You never go into a sales pitch without knowing your business inside and out. There was ZERO preparation or evidence of having business experience. They thought they could go in, put on a little skit and close the deal. It was embarrassing to watch. Shark: “What are your sales? “ ‘We had like 50 people come up to us and say you should be on shark tank?’ What!? 😂 Insane.

The audacity of these guys to come pitch a rip off of scrub daddy, a shark tank product Lori invested in. They are lucky they didn't rip off Mr. Wonderful investment/brand he would have torched them and sued them into oblivion, which actually would be kind of amusing.
