This video presents new footage from the arrest of Chase Mina, the adult son of Orange County Sheriff John Mina. Chase, a CDL holder, has pleaded not guilty to one count of driving under the influence, a second-degree misdemeanor. The next hearing in his criminal traffic case is scheduled for December 5, 2022.
From the report of Officer Sean Peter Lefere, lightly edited for clarity and brevity: On August 14, 2022, at approximately 2339 hours, I responded to the area of South Dillard Street and East Story Road in Winter Garden, Florida, in reference to a possible disabled vehicle. On arrival, I located a white 2000 Ford F-250 in the straight lane facing westbound, with its engine running and lights on. As I approached the vehicle, I found a white male, later identified as Chase Mina, slumped over and asleep behind the steering wheel of the truck. Chase was the sole occupant in the truck and there were two open beer containers in the front two cup holders.
Contact was made with Chase, who had to be awakened by another officer. Chase was instructed to exit the vehicle and was asked where he was coming from. Chase advised that he was coming from "the ride home." Chase was asked again where he was coming from and continued to say he was coming from "the ride home." Chase was asked for his driver's license, and began searching for it in his pockets. Chase pulled out some cash from his pocket looking for his license.
While he was looking for his license through his cash, Chase dropped a single dollar bill onto the ground. Chase then began to go back to his truck to look for his ID. Chase was instructed not to go back to his truck, but he continued to place his cash in his truck and search his truck for his ID. Chase was again instructed not to go into his truck.
I asked Chase whether he had had anything to drink tonight, and he replied, "a little." Chase was asked if his ID was in his truck and he said yes. Chase spoke with slurred speech, had bloodshot eyes, had difficulty standing up, and had a very strong odor of an alcoholic beverage coming from his breath. Chase was escorted to the side of the road and into a parking lot. While escorting Chase to the parking lot, he was stumbling and was unable to walk straight. Chase was instructed to lean on the hood of my patrol vehicle, and was then offered two opportunities to participate in field sobriety exercises. Chase refused to participate in field sobriety exercises and declined to answer any more questions.
Chase was placed under arrest for suspicion of operating a motor vehicle while under the influence based on the following observations of Chase: Chase was slumped over and asleep behind the steering wheel of the truck in the driver seat, had a strong odor of an alcoholic beverage coming from his breath, had slurred speech when he spoke, had bloodshot eyes, could not stand up straight, stumbled as he walked, and admitted that he had been drinking.
Chase was secured into handcuffs which was checked for proper fit and double locked. - searched Chase's person prior to placing Chase into the back seat of my patrol vehicle. While searching Chase's person, I located Chase's driver's license inside of his shirt pocket.
I transported Chase to the Orange County DUI Testing Center, where he first agreed, and subsequently refused to provide a sample of his breath.

I've gotta give him credit for not once ever mentioning that he's the sheriff's son. Considering when LEO's get pulled over for DUI, usually one of the very first things that they say is that "I'm a cop."

@@denniswhite166 Totally, for this reason I am glad the video evidence is present. I am very supportive of public safety officers, but any covering up crimes should have their ability to ever work in such a capacity removed permanently.

I got rear-ended by a drunk driver in Pensacola Florida who was the son of a retired Deputy sheriff. His car flipped over mine and both of our cars were totaled and my passenger and I were injured. The guy wasn't even charged and was released into custody of his father. He was 28 years old. He had prior arrests for cocaine distribution. Not all cops are bad, nor are all cops good. Oh, and he claimed he wasn't driving, even though he was the only one in the car.

I got hit by a drunk driver who told the cops: “My dad made White Diamonds…. the perfume with Elizabeth Taylor in the commercial…” I had to laugh. He REALLY thought it mattered. Also, this was in 2015, not 1991! Unfortunately, no one believed or cared and he was hauled away.

Gotta give it to him though. He never once pulled the my dad is the chief card. People make mistakes. The only real problem I saw was the supervisor who clearly tried to keep this from happening simply because he knew who the guys father was. That guy should be fired.

I was thinking of that as I watched the video. I was, sadly enough, surprised that he never once pulled the "do you know who my father is" card and I am so glad that they didn't back peddle when they were told that it was the Chief's son.

IMO, I think the drunk thought he was dropping $100 bills on the ground and seat for them but on this night he suddenly realized he only had singles. OOPS! Haha nobody's taking a $17 bribe.

Many many years ago I had a peeping tom after my father learned about this he set out to catch him, daddy caught the animal when the police got there it was the chiefs son daddy backed off but the chief said hell no told his officers to take him like they would do to anyone else and he left!! Not only was he a good officer he was a good father who taught his son he was no different than any other thug!!!

@mackdeen7021 you do realize that some kids are just fuc*ing weirdos or bad, right? I've seen a lot of people grow up in my day. A lot of people from great homes who's brothers and sister all flourished who came out just fuc&Ed up. I've also seen people come up in bad and good homes where everyone was a fuc* up but they succeeded. The environment you're raised in does not always determine what you become. Mental health, addiction and many other factors will play their part and effect a person's outcome.

I drink a lot more than I should. But I have never driven drunk in my life. At almost 40 years old I’ve had plenty of opportunities. If I can do it, so can anyone else. Buy yourself a 6 pack and go home and fall into a KZbin hole like I am now 😂. No cops, no accidents, no bar tab. Get to keep my license which is definitely a plus

As the family member of a young habitual DUI offender, I can tell you that it's horrible to know that he is in jail for 6 years. Harder still to know that his alcoholism has completely ruined his life. We are lucky that he didn't kill anyone. We all paid for many, many treatment facilities, and tried everything to help him. This young man may be the son of a Sheriff, but his habits and poor decisions were beyond the control of his father or anyone else in his life. So sad really. Perhaps one day we can ACTUALLY help alcoholics.

My dad was a police chief. Mom was a sargent . My best friend's dad was a minister. Whatever I did, my dad found out. Dad told me later in life. I was flabbergasted. He told the cops to do what they had to.

Many years ago a friend of mine lived on a farm where there was an abandoned car that was totally un road worthy, lying in the hedgerow. It was a car that had been left there for years. Chickens were using it as a shelter and to lay eggs in. The roof looked like it had been hit by a large meteorite and had a huge dent in it. In fact the car was totally battered and it only had front seats in it, none in the back. One day a group of 5 of us had been drinking and decided to see if it would start up. After a bit of work we managed to get it running and thought it would be a laugh to go for a spin in it. After driving a few miles down the road, we were stopped by the police, all 5 of us were drunk, including the driver. We were taken down to the local police station and questioned. After about 30 mins, we passengers were let go after refusing to answer questions, but the driver was kept in custody and breathalysed. He obviously failed but he too was let go shortly after. A couple of days later we were told that no further action was going to be taken on any of us. And why you may ask??? The driver was the son of the local "chief inspector". 😂😂😂

If you refuse to do any test and don't admit to anything, the only thing the state has is an officers opinion which won't go far in court since the burden of proof beyond a reasonable doubt is THEIR responsibility. So, sadly, yes, refusing gives you the best chance of getting away with it. I don't like that though because it gives those in the know an out. You should not be able to refuse, period. Especially if you're an officer, lawyer, DA Eric

Attorney’s always advise never ever take field sobriety tests and refuse all blood and breath alcohol assays. You can always fight and refute opinions but not scientific evidence.

It doesn’t always work like that. Police can get a search warrant for your blood if you refuse a breathe test and are suspected of dui.

@@jim9983 I have seen that. But sometimes delays in acquiring a warrant and other issues like calibration and of course time decay all work in your favor. I’m not a lawyer but I do think they all have the same stance on this: always refuse and don’t self-snitch.

You are giving out bad advice. In some states if you refuse, it's automatic license suspension, period. If someone wants to refuse all tests, they better know their state laws.

@@ericalexander5890 I don’t mean to advise…however, I believe ALL lawyers in ALL states say NEVER take a FST or Breath test. Yes, it’s an automatic suspension if you lose in court. But you have a better chance going to court with a refusal verses a failure. Check out a channeled called: The DUI Guy. He’s a lawyer that explains this much better and than I can. And I’d just like to say that I have never had a DUI/OWI. When I was younger, college age years, I drove drunk too many time to count. I look back in horror at what I did. I was so stupid. But there wasn’t as much awareness then as now…but I still thank god I never hurt anyone. I guess we all do dumb things as kids but I was dumber than most.

Body cams are the differentiator in most cases. Can’t tell you how many former officer DUIs I’ve seen where the arresting one mentions it not being like it use to be or flat out saying body camera

"Disqualified" is the word he was looking for and CDL operators cannot refuse a drug or alcohol test. They can, but with repercussions on their CDL.

Yep. Have a jury watch those bodycams and the jail video and come to the conclusion that he's not drunk, lol. If you take the breath test and are convicted of the DUI - it's 30 - 90 days on the suspension and you have the option of paying for an interlock (blow to start) device instead of the suspension. Refuse to take the tests and regardless of the charges being dropped, whatever - you still automatically lose your driver's license for 1 year - no interlock option. Doesn't matter if "a good lawyer could get him off" - he's still lost his job and is gonna be hoofin' it for a year.

@@trusttheprocess5618 Lol. Don't listen to KZbin lawyers - IT DOES NOT MATTER IF YOU GET THE CHARGES DROPPED - YOU STILL LOSE YOUR LICENSE FOR A YEAR FOR REFUSING THE TEST. This guy has a CDL, so, regardless of what happens in court, he has lost his job. The 1 year loss of license is punitive and administrative from the DMV, so there is no way around it. If you're found guilty of the DUI and took the tests, you lose your license for 30 - 90 Days and there is an option to pay for an interlock device instead of the suspension. No interlock option on the year suspension. They don't reward you for not 'fessing up to your responsibility. And unless the cops made some kind of procedural error, do you really think a jury is going to watch any of those videos, and then have 3 cops say they smelled booze, and find him innocent? lol. Good luck with that.

As a former dispatcher, I couldn’t help but notice the less-than-friendly curt 911 operator. She didn’t sound as if she wanted to be at her job that night. I hope she was just having a bad day and didn’t sound like this every day. You’re trying to get more information out of the public when they call in, not treating them in a way where they just want to get off the phone with you.

I know. I'm so glad someone else noticed too. The dispatcher put no effort whatsoever into at least trying to fake soundling polite and caring. Jesus. Then she should get a different job because being a 911 dispatcher, it is imperative and can be life saving to have a dispatcher who is caring and mature. I've heard even worse ones than her.

Some members of law enforcement officers who have children who feel they're "entitled" to behave as if the laws everyone else follows do not apply to them. Even if disciplinary measures are taken at age appropriate intervals, sometimes those lessons aren't learned or are ignored, and this is the result.

Are any lawyers in here? (If he wasn't a police kid.) What should Chase have done? Every test is evidence, but can the Police obtain a warrant for his blood regardless? If Chase cooperated and possibly negotiated with counsel after the charge, would the court show mercy? Which is the best route? Thank you in advance. (BTW, I completely disavow any inebriated drivers. I'm just curious about the laws and our justice system.)

DAs want slam dunk cases. By refusing they don't have any real evidence besides a cop's opinion. They might choose not to prosecute at all since they have no evidence. Most states say by refusing you automatically lose your license for a year but that's better than having a DUI on your record. $0.02

I didn't see it in this video but I have in others where the drunk driver is read his/her miranda rights at the time of arrest. I'm curious as to why you aren't allowed to ask a lawyer whether to take the breathalyzer or not. You would think this guy would know whether to or not considering who his dad is. I'm really surprised how many people don't use Uber or Lyft these days. It's a lot cheaper and less hassle than a DWI.

Florida’s Implied Consent Law. Which means that by accepting a driver's license, individuals are thereby consenting to submit to a breathalyzer when lawfully asked to do so.

Looks like our boy had stops in 2012, 2014, 2014, 2018,2019 and this one. paid fines and went to traffic school twice, a few others were paid fines and one where he had an attorney but if I read it correctly, it was dropped...due to "officer not showing up" lol I wonder why. Could someone's job have been at stake? maybe. Looks like this one is scheduled for hearing Jan. 10

Miranda deals with questioning someone. He absolutely has the right to an attorney before questioning but he does not have the right to an attorney before submitting to alcohol testing.
