I'm Aja Dang and in this video, we'll discuss whether or not you/I should sue your inspector. After being encouraged to looking into suing my inspector/seller I did some internet research and I'll share some of the basics of what you need to know.
Whether you're a first-time home owner or you've had issues with your home for months, this video is for you. We'll discuss the pros and cons of suing your inspector, and help you decide if it's the right step for you. As always, I am not an attorney, I also don't want this video to make you trigger happy in thinking that you can sue anyone when your new house has issues. It'd be overkill adding in a lawsuit to your situation. Buying your first home and moving to a different state is already such a huge undertaking. Anyone's mental load would be maxed out. You are juggling so much. I appreciate you sharing these real struggles with us. Keep holding on.

While a general home inspection is CRUCIAL, as a realtor I always encourage my clients to bring a licensed general contractor that they trust through the home as well. It’s like having your own mechanic look at a used car before you buy it even if the car has been inspected by the dealership and comes with their warranty etc. If a general inspector says there are issues with plumbing, the roof or HVAC, I always encourage my clients to have a tradesperson for that system or specific area come out to give their opinion as a SME. I’m sorry if you’re realtor didn’t encourage you all to do this. Next time I hope you have all the TRADESPEOPLE out during your inspection period 🙏 hang in there!

As tempting as it for people who want to sue I would really look into the inspection report and how it is reported. Inspectors often write up reports in a way that protects them they are only responsible for what they could see so with the wiring behind the walls they wouldn’t be responsible because the inspector was never able to see therefore not responsible. These reports are usually very long and vague for a reason if it was mentioned in the report even in a little way they could be covered because they notified you of what they could. Although with your situation it could be they were just seriously incompetent.

This is so crazy to me! I’m going through something similar to Aja and it’s like…what do you mean you didn’t have to inspect it if you “didn’t see it”? For example, there was a shelf in the way of a sub panel in my garage of the house I just bought, and the inspector didn’t think to push the shelf (on wheels) out of the way to inspect the panel? And I can’t sue?

I think your window to dispute claims is before you sign off on the inspection. Especially if you do the walkthrough with them it doesn't help your case since you could have pointed things out.

100% agree with this. We went through a similar situation but after talking with lawyers I was told if I don’t have a millions of dollars to spend, its not worth it. I know that the inspector intentionally did not point out a specific issue that cost us $10,000 and wrote up a report that would basically protect him. They ultimately told us it would be hard to prove negligence on the sellers part even though they DIY’d this issue. I feel your pain Aja and I’m telling you that your not alone. I remember crying almost every day for 6 months about the issue we had and it happened 3 months after we moved in and it was also our first home.

A lawyer will help determine if a lawsuit is worthwhile. Or straight up refuse a case if it’s not winnable. I will say this, in some states, there ARE some laws that protect buyers from sellers who do construction improperly. Unfortunately that’s not true everywhere. I’ll bet most states don’t have such protection laws. :( If a car dealership can’t sell us a lemon, I feel like a homeowner can’t sell a shoddy home unless we sign a waiver. After all, some people DO buy shoddy homes that need to be demolished. But I imagine there would be some kind of waiver.

My coworker told me when I was searching for a home to always get a second opinion, but the inspector I hired luckily did his job Thoroughly and was able to find things that the seller didn't specify on the listing. Ultimately this inspection made me pass on the house. I almost fell for it because they remodeled the whole place. They were focused on making it look good that the house itself was essentially falling apart and I'm glad I finally woke up and realized this because lord knows what would've happened to me financially if I didn't pull out.

Aja 😥 I know how you feel. The first home we bought had huge issues. All of which were covered up and slapped together by previous homeowners. We will make no money on the sale. We got the home inspected, but inspectors cannot tell you whether or not to buy the house. And if the homeowners covered anything up? for example, if they covered up a cracked drywall because of a sagging foundation? well, technically the inspector has no way of knowing if the home has that issue. There are plenty of people who thought they were buying their dream home only to realize that it's a money pit. I am sure there are people in the comments who can share similar stories. You are not alone and I wish this was talked about more.

Not a lawyer, but for anyone thinking of suing....Don't forget about potential legal fees you'd if you decide to sue. Also, if you are going to sue, there is the potential that the inspector will not pay..... You shouldn't regret this if you can help it. I know that's easier said than done. You are putting the love into this home, that you and your potential future family deserves. Maybe make daily positive affirmations towards the house, and frankly to yourself "I love this house" "I can't believe we get to put this much love into our home so soon". It might be easier after you start putting the finishing touches on your house though! I'm not an ooey gooey person. I sometimes have to stop myself from saying something negative when people start to say how great my home is. There are so many great things about it, and that's what you, I we should focus on.

This series is bringing me back to when I decided to buy an old home near downtown LA in 2019. With the budget that I had, I could have gotten a brand new condo with no outdoor space for my doggies or an older home that needed lots of love but with a huge outdoor space that my dogs deserve. Years later, after huge renovations that crept all the way into the pandemic, we’re finally done except for one old bathroom that needed to remain functional while we did all of our Reno. There’s still small things here and there that I’m not fully happy with but we have learned to live that and slowly fix things as we go while making this place a home.

OMG I can totally relate! Our first year was a financial disaster, with expensive repairs and upgrades. Homeownership is not for everyone. It sucks. It's mentally, physically, and financially draining. Buuuuttt, once you've gone through the other side and things start to settle in, I'd say it's pretty sweet. I love our home now.

Hi Aja, sending love as someone who bought a home recently can totally relate. I am not a lawyer or inspector but my real estate agent was very thorough and made sure we didn't get screwed over by anything. I agree with the comments about looking at the inspection report and most of the time, inspectors do visual inspections and if they see something off, they would recommend getting a professional person to review. I think once the contract is signed, both the inspector and seller are no longer liable. But I would consult an attorney to see what you can do. Otherwise, I think the remodeling job you are doing is great. It is hard to go through renos and pouring a lot of money into a fixer upper. I think you need to carefully read your contract with the inspector since it is impossible for them to check every crook and cranny of the house. Consult with an attorney to see if you even have a case. When you buy an "old house" you are basically buying as is and this means all the issues that come with an old house. Houses in the 40s were not built like they are now and back then there weren't so many restrictions. Before anything, check to see if you can even sue.

I am SO sorry you've experienced all these horrible things since you moved in. I honestly don't know what I would do in this situation, the electrical seems like something he should've caught if he went in the attic. However, something to keep in mind is that inspectors aren't experts in all household systems/appliances and like you said, they can only catch what they can see. There is no easy/good answer to the question of suing anyone. You've already been so stressed through this experience so it's totally understandable why you wouldn't pursue a lawsuit on top of it all. hi aja, i’m so sorry you and your husband have been dealing with all the home repair issues. i wanted to recommend that while you’re out of the house to schedule a mold inspection and test to find out if any other repairs are needed. that would be where i dear the line regarding sue/don’t sue. if the seller knowingly covered up any mold then they are legally liable even past the home sale. i hope you get some rest while in LA and that this heat subsides when you come back. i feel like the oppressive heat here in houston has compounded your home repair woes so maybe that will help some. all my best to you. ❤️

It's difficult to sue a home inspector as they usually have a clause in the contract that informs you that they do not guarantee that they will catch everything. You can however sue the seller if they did not fully disclose material facts that affect the value of the property on the Property Disclosure Statement. You may be having Buyers Remorse but it's not a curse Aja. One of the best investments you can make is real estate and that is exactly what you did. It may seen like it's a curse but eventually you will get out of this.

Having all the home repairs understandable it very frustrating. I had this happen to a family member as well when they bought a house (and they were homeowners before!). On the more "bad juju" side, have you thought about getting the house purified/protected through a religious body? I know it sounds really dumb, but it's helped out in my family (be it "actually" helping or just helping with the shift in mindset to deal with the problems). We've gone through Shinto priests and I think most religions have some kind of person who does this kind of cleansing. Good luck with the repairs! I really hope they sort out soon for you.

Our inspector gave us the wrong dates for our furnace and water heater so we had to replace the furnace when we moved in and realized it was so much older than he had said. We called and were able to get a refund but they made us sign a form to not write a public negative review.

You made some great progress w/the house and paid for some major repairs, you made it better for possibly the next homeowner, people buy homes and “flip” “repair” and put it right back on the market. Maybe it wouldn’t be a bad idea to put it back on the market, you probably will be able to sell it for more than you paid for it due to all the repairs and you can walk away with a profit and then maybe look for something else. On my 9th purchased house. Every house has problems that you cannot see. I never sell a house with problems or cover up. It is not the right thing to do but some do it. You get wiser to know what to look at in your future houses. Remember there is never a perfect house. Now that you fixed the problems only good energy and great memories to fill it! Don’t be sad. Once remediation is done, you can look forward to the fun stuff. There are plenty of houses that are well loved and taken care of, I hope it doest mar your intention of living in Houston. Also, I would highly recommend you have a family member oversee the re-piping of the house. Part of the reason why shoddy work gets done is because of non-present owners/clients. Contracts are more mindful when you are there. You just never know and it will save you $$ in the end.

We went through a nightmare of issues when we bought our first home. Worst case scenrio kind of issues. That was 6 years ago. It will get better. You'll learn so much through this process. All of that extra blood, sweat and tears will make your home so much more special to you.

I just finished suing the inspectors AND the contractors of the house I bought a couple years ago due to similar problems of things being not up to code and terrible work. It was successful, you need a lot of documentation of the work done and expert witnesses (your current contractors to testify the work would never be up to standard) you can also include the previous owners for not disclosing the conditions of the house

Sorry that this happened, Aja. Homeownership is such the American dream and I know so many people who also had this type of experience. Home purchase remorse is super common - the reality of homeownership gets swept under the rug with the ideas that they are great investments - which, to be fair, they can be. Also, totally understand the hesitancy to sue - it takes a lot of energy, time, and additional money to do. Fwiw, I think it could still be useful to report the inspector to the right overseeing agency. And unfortunately, yeah, the seller likely won’t face any sort of repercussion unless it’s through litigation :/ good luck! I do think in several years this period of frustration and disappointment will die down and you’ll love your place (you might already bc you’re making it your own in all the ways you want it).

I bought a brand new condo. When I was looking at older but renovated condos, my realtor said she would insist on a full inspection if I really wanted to go with one of my alternative options, because she didn’t trust the renovation work. Plus, she previously helped another client buy a condo in the same building and encountered so many issues. Plus, a resident told us the landlord is trying to kick out residents to convert the units into condos. All in all, shady. My building and unit isn’t without problems but all of mine have been relatively minor. And, yes, even a brand new home can have issues, especially if the developer cuts corners. Welcome to homeownership! :( Sorry Aja for all that you’ve endured. I honestly would’ve been so depressed. I can barely manage the minor issues I’ve experienced. Also! Maybe look into new construction homes. That’s what we did for our first house and it’s been 10 years since then and absolutely no regrets! I know house prices are much higher now than they were 10 years ago, especially here in California, but if it’s an option maybe look into it?

Well, it's been a NIGHTMARE, so suffice to say, we are having a new house built and will be selling this one. It's just not worth the money that needs to go into it (we're talking 50-80k easily). Sorry to hear that! We have a form called, Property Disclosure that sellers need to fill out in Oregon. If seller and/or seller's agent have knowledge of any material facts that affect value of the home negatively, they should disclose that. If they didn't, buyer may bring it up to get compensated (I'm not an attorney, so not a legal advice). I'd suspect that you might have a similar disclosure rules in your state. I'd check with your agent and a real estate attorney.

What a headache. To expect home buying to be this blissful moment in your life and turn out to be a big burden (for the time being) is stressful to say the least! I think all you can do at this point is see the big picture. This is YOUR home and no longer the previous owners or anybody else! This is for you and your future family I think what you’re dealing with right now are growing pains. You can get through it if you got through 200k of debt. Lol like cmon girl! We looked into with our house and we had so many problems but in the contracts they specifically say you can’t because they can’t catch everything. I just wish I had maybe gotten a better referral and not the one recommended from our realtor.

Granted I haven't watched all the videos about your house, but the ones I've watched I don't think I've heard you mention your real estate agent. A good agent is a crucial part of the home buying process. When I bought my first home I relied on my agent to give me honest opinions and he asked sellers, inspectors, and every person I encountered questions I would have never thought to ask. Many people assume an agent is there to show you houses and do the paperwork, but find yourself an agent who will be following the inspector around the house and pointing out places they should look at and asking questions about this or that. And if I had any of the problems you've had, my agent be my first call. Their job isn't done once they've sold you the house.

I am so sorry. We moved from Oregon to Spring, Texas, which is North of Houston. We bought a lipstick on a pig house like you did. Everything needed replacing, we discovered we did not like Houston, and honestly, it is the #1 worst driving place in the USA! Most crashes, most deaths. You are expected to get into car crashes there. It is America's armpit. Downtown Houston is a very dirty and scary place. We moved back to Oregon after 2 years there.

Not sure if you already have done so, but possibly send a report to the company that did the inspection to advocate that moving forward that they look out for the big issues you've dealt with so that hopefully it make sure folks who use their services in the future won't have have to go through the problems as well.

Hi Aja! I totally get your desire to file a lawsuit (going through similar feelings myself) and you deserve an advocate. Many law offices will offer a free 30 minute consultation (I know this is if you have a work EAP program, not as sure if you're self-employed) that could be helpful. I utilized one and while he could not give me individualized advice, he did point out of avenues for me to file my grievances. For example, businesses are regulated by different state consumer affairs agencies and we as consumers are entitled to certain protections depending on the state. I was able to file a report with the appropriate State Attorney's Generals office for free and they are assisting with mediation. Nothing is guaranteed of course but worth a shot with either a consult or state agency!

Aja I so relate to your video and the pain of being deceived in the home buying process. We bought our home hoping it would be turnkey and three years later are racking up so many costs associated with bad workmanship and failing systems. One thing I wish I knew was that our state has a statute of limitations for suing of three-four years from the point of sale depending on the nature of the issue. I was right there with you about not having the time and resources but I WISH we just did the free consultation with a lawyer to know if we had a case (because we do). We were both in grad school and working full time, but we would have more options if we started earlier. This was a super timely video because I’m not kidding we just had that meeting today with a lawyer where we found about the limits of what we can do. I definitely get the lack of energy and resources but I just wanted to share my regret in case it helps you or anyone reading not be in our same situation. We’re waiting to know the retainer fee but if we can swing the cost, we’re planning to pursue legal action against the seller and potentially the inspector because we likely still have some recourse (even after fixing things). For us we just kept having the same question bug us in the back of our mind: what if we can recoup some of these costs? But that’s what gives us peace of mind to have this closure of yes or no, that’s not what gives everyone peace of mind. Either way you are NOT alone and it royally sucks, thank you for shining a light on the reality for homebuyers. dont have any experience with homeownership but when i bought a car i didnt know i had to get each potential car inspected so i was on my 2nd one and i only had enough money to buy the car in cash which was a priority to me. the shop said they could give it a quick look without charging me since i was a loyal customer and said its good to go. one month after the purchase, check engine light is on and tires needed to be replaced etc. in the end i didnt pay for an inspection and my heart was sold from the first photo. 3 years later i have definitely spent more than what its worth but to me BECAUSE the car is in my name, its worth it to me. if the car wasnt, would actually kick and scream. so do what yall want with that. pretty much yes, being rich or well off however you want to word it is one thing when making these decisions but, as long as you keep making payments, everything that costs on top of the payment in a separate transaction (for example car insurance just to drive your car, oil changes, state inspection, emissions, car accessories etc.) is gonna be annoying as hell. so in the end, if you love it, itll even itself out. if you own this without any other reason then you thought this is what you were "supposed" to do, youre in the danger zone. dont do anything cause you feel like if you didnt somehow youre not a real person in society. youre alive youre just not on the cover of forbes. its not a big deal we just think it is. its not.

There are some things which cant be caught during an inspection without causing some damage as they are hidden from view or inspection. It would be hard to win a legal case unless you had somethng outright visible which was misreported. Done a number of renovations including rolling up my shirtsleeves for full rewiring and replumbing of my houses from the ground up.... its all part of the 'joys' of home ownership. If its fixable then fix it and improve it investing sweat over dollars wherever necessary.

Did you waive everything? In California, there are a lot of things that, if they break within the first year, the sellers are still responsible for it, regardless of what the inspector found.

There is something to be said about feng shui. If you’re not meant to be in the house it probably makes sense to cut your losses and either sell or rent out. Having such a negative energy from the beginning seems to be a direct sign that this is not where you should be. Just an observation but if you feel you can overcome this, then follow your instincts.

We have a close friend who had bought a new house to be built in a brand new community. He drove by the building site for his house because he knew the foundation had been poured with cement the day before. While he was watching workman at his foundation site a truck accidentally backed into his foundation cracking it. He went to the contractor and threatened to sue if he was not allowed to pick another house further down the block because he knew a patch job on the foundation could lead to water leakage in years to come. He picked another lot space for his house and he then made it his business to randomly and frequently check the house and work being done till completion. Some other poor person bought his original house and has no idea that his foundation was cracked. I know you don't want to hear this, but you really should be around to keep an eye on what the contractor is doing and that no corner's are being cut. I learned you never have complete trust in anyone and question everything. Will you be doing an update on the financial aspect of this and how you are paying for all the renovations?

How about small claims court? I only brought 2 properties in my life, a condo and then a house. Both new construction….the condo had zero issues. The house is a money pit but not to your extent.

Hi Aja, I don’t blame you to feel how you feel about the house in Houston, however, I don’t think it’s a curse, at the contrary, look how much you’re learning about home projects and you’re doing your best to fix it the proper way. Unfortunate, we have no control over other people as the previous owner being extremely irresponsible, careless and a cheater, but don’t forget “what goes around, comes around”… so he will get what he planted. Meanwhile, just focus on your cute little house and continue putting your touches. I think your realtor can help you in all of your questions especially if she/he recommended the inspector and I would call the inspector just to let him know, as if he did not have enough experience in doing his job, he may want to know what or where he missed so he can be more careful in the future. If you have decided not to sue the previous owner, just move on, continue fixing the house, now don’t forget that you bought a very old house too, so of course it’s going to need a lot of repairs. Just keep putting your touches and don’t forget this is an investment, so you’re putting money into it right now, but if you decide to sell it later on, you’re going to get more than what you’re putting in. So, we that said, move on, continue with the great job you’re doing, bless your house with Bible scriptures and don’t talk negative. Also, I would not let the plumbers do the work without your supervision so if I were you, I would be there at the house while they’re re doing the plumbing. Stay blessed, happy & peaceful🙏🙏🙏❤️❤️❤️

Some lawyer offices will listen to your case to see if you're able to sue. They will take your case and you don't need to pay anything until you win your case (I have won 2 cases in my life). I know you don't currently have the energy, but I would keep tabs/receipts and look into some kind of consultations so you'll get some money back from this whole experience.

I am a realtor in NC so I’m not sure what the real estate laws are in Houston. The inspection is only good for a day and they can only do so much. There are good and bad inspectors so it depends on who you got. I know homes in NC come with property disclosures and if there were so many repairs with this house your real estate agent should’ve negotiated those repairs for the seller to pay for or give a seller credit so you aren’t paying so much for it. And your agent should’ve went through the inspection report more and get other professionals to look at the areas of concern, like getting a structural engineer to see if there is something wrong with the bones of the home.

Inspectors perform visual inspections. If something is not easily visible because it is hidden behind a wall, covered by shingles, under insulation, the inspector is NOT going to see it. They'll open doors and move furniture and climb in the roof turn knobs and that's it. The inspectors don't come through knocking down walls with X-ray glasses. Plus, they're just some how schmo ex (or current) contractor with a lot of knowledge about houses. I am so sorry you are having these feelings of regret and remorse. I've definitely been through that. I am sorry that the weight of expectations of buying your first home is weighing so heavily on you. It gets better. You get more comfortable and it truly becomes your home, quirks and all. ❤️❤️

I think it’s why I want to buy an old/er house that has had nothing but maybe a new roof put on it. Obviously, I don’t intend to pay “new house per square foot price for it” either. An old/er house that hasn’t been touched is preferable to me, but it comes with work. But, at least I’d know it was updated properly.

I would recommend looking at the sellers disclosure to see if the seller disclosed these issues or lived in the house long enough to know about this. The inspector is not a specialist and should recommend you consult a professional if they saw anything concerning in any specific area.

I regret buying g my house last year, as a first time buyer. It has been nonstop issues. I too had a car accident and had to get a new car. I've learned from home buying that sellers will cover up/lie/do whatever they need to to get you to buy what they're selling. I don't blame my home inspector. I blame the seller who clearly covered up and did not disclose major defects.

A house is just a place to stay. It’s not an investment. Once you subtract taxes, interest, maintenance, repairs, and insurance it’s not really all that profitable for most people. It can be a money suck and more importantly so stressful. People feel they “need a home” as a symbol of success but I would rather have my peace and freedom.

When the previous owner handed me the keys and showed me around the house, he mentioned he’s the first owner of the house and it’s not haunted even though I didn’t ask. Moved in and whadya know started hearing knocks and sounds of things crashing for no apparent reason when no one else was home 😅 found out we have a female spirit in the garage. My mom had felt a hand on her shoulder and heard her friendly giggle. If we’re going to be roommates we might as well get along so we’re very respectful towards her and always greeting her when we enter the garage. So even though you feel its bad juju just remember at least you don’t have an evil entity taking up residence in your home. We are lucky she’s friendly 😅😅

In your case you have more success getting money from the home seller than inspector. It all depends on your state. Inspectors in my state are not allowed to remove walls only visually check and run all the faucets at the same time. For homebuyers you can look up the history of the house including insurance claims against the house, police reports and it all free. You just have to do the leg work. Do not depend on inspectors to tell you about diy wiring, hidden wood rot, bad plumbing and anything that can be covered up. I hired my own tree specialist to check if the roots from neighbor tree might impact my foundation. I also understood how old my furnace and ac unit was. Remember different states different rules. Know how they are different and understand the limits of home inspections. In fact this video might open up itself to lawsuit from original home owner or home inspector. Will they win probably not but the headache of going through with time and money lost is no fun.
