When the judge asked if there was any other family that could care for the kids, she said “No”. Obviously, that was a lie told in anticipation of the judge letting her go. When the kids were going to be taken by the state, all of a sudden there was an Aunt that could get them immediately. The defendant has been at this behavior for a long time.

Yea, she was obviously lying. But, on the other side of the coin, wouldn't you at-least _try_ to avoid it any way you could if you were facing going to jail immediately vs getting to go home? Whether it was for your own safety or out of concern for your children, I think any sane human would want to go back home if they had any choice on the matter... I don't care if you're the guiltiest criminal or the most innocent person in the world - jail isn't a desirable destination for anyone. Then to add to it, knowing how substances work & how long they can stay in your system - if you test positive for something like say, a Benzodiazepine (xanax, klonopine, ativan, valium) you're in there peeing for a stranger, who has to stand & watch you go, every day for at-least 2 weeks. Now, *_if_* (& that's a big _if)_ all she has in her system is meth, then she will probably test negative w/in 48 to 72 hours (depending on when she last used), but if she has anything else in her system that the court or office can't readily identify, or deems a violation of that bond or probation agreement, she's in that bitch at their whim, until it's no longer in her system, & some drugs take up to a month to leave your urine.

It’s sad since the judge should have taken the attys word as appropriate for her client not being under the influence. It was wrong of the state to even bring it up to the judge or should have taken it to the defense team first. She could be not on anything but the prescription medications.

So the judge did take her attorneys “word for it.” 😂 furthermore, if she’s in a period of relapse, her young children need to be kept safe until she gets herself back together. Should he have let an admitted meth addict who was going to fail the urinalysis leave court, drive herself home, and care for the children all while she’s actively using??? If you think so, then okay, but I hard disagree.

This is a very typical argument. Especially when they are trying to work magic, for their client, out of a big ol pile of ish. They dont got alot to work with. And children are always used as an excuse to stay out of jail in like every case. So I can see why she said that but unfortunately it really doesn't make much sense or make her look any better. But her client isn't giving her much to work with. Shes not going to be like we'll idk shes a mess your honor just lock her up. Let her sober up then put her in a program, and remove the children from her custody. That wpuld be a very bad defense representative. She's trying.

Perhaps it would help to try to think of losing your Mom to the illness of addiction which may have been caused by another illness such as depression or the effects of some past trauma. Some people are successful recovering from substance abuse, yet sadly, many are not. I'm sorry for your loss. It seems so unfair. Having police show up and take you away is so terrifying. It happened to me ad I remember the fear of police and laying on a cot. I was around 3 or 4. Shame on this mother for making her children go through that and whatever else she has put them through.

She didn't make them go through that... You should re-watch the video for that part. I, too, was taken away by the police and family services as a kid. It really isn't that traumatic when you're young. You were traumatized by something from when you were 3 years old? Do you even actually remember more than 10 minutes of that experience? I was old enough to remember ALL of it, and the court that followed. I am not traumatized in the least. The whole point is to put the kids in a better situation than they are found in.

@@mikecamden You CAN be traumatized by stuff you cannot remember. Kids and babies experience trauma too, it doesn't just go away, it stays with you and shapes the person you grow into. Good for you that YOUR personal experience didn't traumatize you. Theirs did. You cannot reasonably say someone else isn't or shouldn't be traumatized by their own experiences. Maybe your own experiences have shaped you into someone who tries to gatekeep experiences and trauma and argue with people on the internet about their personal experiences because that shouldn't be a common thing.

But my oldest, at any age, would have ptsd from something like this or me not coming home. All kids are different, react differently and you never know what would affect them or at what point of their life. Kinda rude to discredit someone that’s been thru the system (the OP)

Whether it is something you're comfortable with or not, everyone is entitled to their constitutional right of due process. Absolutely incorrect. The children are not the only ones as you yourself should know better! Everyone suffers from a situation like that especially the children , especially her, and you as well. I am coming up on 5 years clean from an over a million dollar addiction of nearly 30 years. Mainly heroin and cocaine but just about everything else. I was lucky/smart enough not just for that reason but in today's age it's hard to find a woman that is worthy of having a child with. But anyway everyone suffers. Also as much as I actually hate somr if the places the drugs have taken me and whatnot I hate this sham war on drugs even more. It does absolutely nothing good for society and those in society! The only ones who benefit from the war on drugs are those that profit from big prison business in one fashion or the other.

How scary would it be as a child and you get home from school, your Mother isn't home and the police show up and take you to a stranger's home (foster family's house)and you are required to stay without fully knowing what's taking place! I'm so glad that a maternal aunt was able to step in a take the children while the mother hopefully gets herself sober and her life back on track. Praying for her and her children!!

@@nekea93 of course there are always exceptions, but to put things into perspective, the chances of being abused and or neglected, or even going missing, are far higher in foster care than in any other social category you could be in as a child, and the trauma of being removed and placed with strangers alone is profound, so the risk of abuse and neglect and trauma with relatives should be higher if that’s happening, which would mean apparent abuse or neglect is occurring or absolutely going to occur, such as the relative being a pedophile, having child abuse charges, being an active user, etc

In a majority of these cases, there are adults-parents, aunts & uncles, siblings, friends-who have to come behind these grown adolescents and clean up their mess. Care for their kids, post bail, provide financial assistance, etc. I was one of them for a while. It’s so painful to stand by and watch people destroy their own lives.

I do know several very intelligent, professional ladies I’ve worked with who awesome 🤩 single Moms. I’m nearly 63 y/o and was raised with my Mother & Father, and a brother one year older than myself. I never had children because I wasn’t married. I wanted the same for my potential children. Here’s a funny: I got married for the first time at the age of 50. I met my husband thru KZbin, he’s actually a musician who grew up about 30 minutes away from me😂I even frequented the same “clubs” where he and his bands performed. 🙋🏽♀️💕

That woman is a hot mess, plain and simple... The bottom line is that she has done drugs very recently and she has young children and she's driving and she showed up to court with drugs in her system. She's a danger to herself and those around her.

What's hot about it? All I see is a disaster. A human toilet degenerate who would rather hold her drugs at night, than her children. The kids shouldn't even go with the aunt in my opinion. What an easy way out. She gets to be a human toilet while someone else raises her kids and she still gets to visit? Being around children is a PRIVILEGE. She had the chance to be a parent and didn't want to do it so give a better family a chance to give those kids a full, loving, engaging life in a thriving home.

Considering the circumstances, I feel that this judge was EXTREMELY lenient with this woman. I am VERY pleased that he is looking out for the minor children, but I personally feel that the children should have been removed from her custody until she is able to establish more of a long-term sobriety. Obviously, the children are NOT safe in her custody while she continues to use drugs. She clearly has a history of using drugs and getting behind the wheel of her car. My guess, is that she transports her children while using drugs and therefore, she endangers their lives. For the sake of her children and herself, I hope and pray 🙏🏻 that this woman gets sober and addresses the emotions and behaviors that lead her to use drugs in the first place. Drug abuse is ONLY a symptom of a MUCH larger issue. If she is to attain any length of sobriety, she MUST address the pain/s and make peace with the issues that caused her to seek out and numb that pain. Although, I NEVER like the idea of ANY child having to enter the foster care system, being raised by a practicing drug addict, can often be more devastating to a child, in addition, it increases the chances that those children will grow up and become drug abusers themselves. Sending much love 💕 light ✨ prayers 🙏 and an abundance of beautiful🌹healing blessings to ALL of the precious babies and children who are forced live in these unhealthy and unstable environments.

I've talked about my DV experiences before on this channel, but my ex was a drug addict. I didn't know it at the time, but in retrospect it was obvious. We fought often and she was often violent. Well I tried to leave her and take my son because I had started to suspect. Money was going missing, bills which I had personally placed funds for were going unpaid, and she would be up all night long for days at a time and then she would sleep for days afterwards. I tried to tell the police this when they surrounded my mothers house (where I went) and told me on the megaphone to come out and bring my son. They didn't care just reunited him with that evil woman. I tried to gain custody for almost 2 years after that. I went to court several times, but the court would always take her side. She got picked up on a drug charge, the details of which are horrific, so I won't go into them here, but suffice it to say she put my son in great jeopardy. Even then she still regained custody. She was given 6 months to go to an outpatient treatment center and test clean. She constantly failed and never went to the treatment. She was given chance after chance, but finally the judge had enough and she lost parental rights temporarily. She had 6 months to comply with the courts and she would regain custody. I held on to my son and prayed she would screw up. That sounds terrible, but I knew it was just a matter of time. She never complied and I raised my son on my own.

I can feel ya BitwiseMobile. Family court is almost beyond repair. My ex suffers from schizoeffective disorder that didn’t present early in our dating but increased over 27 years. She insisted on divorce, but I was able to salvage a separation instead. She agreed to our children staying with me. It’s been 4 years now, but I’m not giving up. I’m hoping she gets the treatment she needs because our children avoid her and visits. It breaks my heart knowing the real her is still in there. 💔

@@Tread1775 I feel you to Tread. My ex was also later diagnosed with histrionic disorder, borderline syndrome, and bipolar disorder. Her mental disorders, which stemmed from childhood abuse both sexual and physical, were what drover her to the drugs and honestly keeps her there. Those are very difficult conditions to treat and they require a significant investment by the patient to treat. You can't medicate for those disorders. Of course, I didn't know all of this then, but once I read about HPD, BPD, and Bipolar I realized that her actions fit those symptoms to a 'T'. My son did suffer some trauma early on with her activities. She ran around with some unsavory folks and we are all convinced some bad stuff happened to him. I have had him in psychotherapy since he was 8 when he started showing signs in school of issues. He stopped going once he reached his 20s and we all agreed that it was probably for the best to get off the meds. He adjusted quite well. He's a well intentioned human being who would give you the shirt off his back if he felt you needed it. He has his issues, but who doesn't in this world really? I'm glad I got him out when I did though. Before any further damage could be done. I can't imagine how he would have turned out had he stayed with her. One thing I learned from that is you never marry crazy :D. Have fun with the crazy ones (but put a jimmy on), but don't marry them. They will only bring you to ruin.

@@BitwiseMobile Actually, antipsychotic or anti-manic medications are the mainstay of bipolar I disorder treatment. I have been on medication for over 20 years now, my life was a complete mess before that -- self medicated with alcohol. Somehow I managed to do my job teaching at a university and was told I did it well so it went under the radar for decades before finally coming to a boiling point in the late 90's.

@@mharris5047 It wasn't the bipolar that was the problem. If you read the entire thing what caused most issues was the Histrionic and Borderline. Bipolar I can deal with - as long as they stay medicated. Not all patients medicate though. I'm glad you are staying on your meds. Histrionic and Borderline are not medical conditions - there isn't a chemical imbalance to treat medically. They are personality disorders, and those usually can't be treated with medication. It takes group therapy and moderation in thinking in order to combat that. It takes a huge commitment by the patient. A much larger commitment than taking some medication once a day.

The judge said he wanted to talk to her first himself. Also, I was a foster parent in VA for many years. The court already tries to put kids with family first. Sometimes yeah, it’s the wrong decision.

My preference in this case would have been Auntie with CPS oversight. You have to be careful when it is family, because they will frequently enable the addict and put the children in harm's way.

@@alicelaybourne1620 Usually competent family is the best situation to put a kid in. However, one concern I would have if I were the judge is how the aunt will pay to care for the children. At least in Michigan it is difficult to get foster care money to take care of family members. They can get about $300-$400 per month and Medicaid from DHS as a welfare case but that isn't enough to care for 3-4 children, foster care money for three kids would be at least three times what DHS pays as a welfare case -- at least they will pay no matter what the adult's income and assets and it won't count toward the adult's 48 month lifetime cash welfare cap (assuming money isn't being paid for the adult directly) as the children aren't technically their responsibility.

I may not see eye to eye with my parents all that much anymore, but there aren't enough words in the English language that can express just how grateful I am they weren't junkies that cared more about being high than raising me. It's so difficult to see children robbed of their childhood and forced to be the mature adult of the household because their parents are degenerates.

But, you are a special kind of stupid when you believe that any person would chose to sacrifice their kids and everything of value to just "get high." @@whatifschrodingersboxwasacofin I think the original comment was about making sure the kids were out of that environment. Maybe I am wrong, but that's how I interpreted it. I think, though that lawyers aren't allowed to do anything that might make their client look bad so I think they can't report them to CPS without potentially losing their job and having sanctions against them. Licensed medical professionals and teachers who even suspect that a child or vulnerable adult may be in danger of abuse are required to report it to the appropriate protective agency who should then investigate to make sure everything is ok.

However I don't think anyone (of able minded adults) be should be punished for simply doing drugs. If someone's a tweaker and goes around stealing stuff then they should be in trouble for stealing stuff, not for being high. If someone's a tweaker and doesn't commit a crime then why punish them at all? Prohibition doesn't work, it only turns law obiding citizens into criminals. The whole reasoning, or lack ther of, behind it is just absurd to me.

@@CeanStrauss Thank you. Again I agree with part of your comment... its not illegal to use drugs - it's illegal to have drugs on your person, in your car or home. For some using isn't a problem. A tweaker can't take care of their children, they can't take care of themselves, they can't function in Society, it's all about getting the next fix... it's not the using, it's the addiction. Respectful, it's way more then I care to type but addicts can't just use and function. So for those who aren't addicts maybe but you never know when or if addiction will hit. I know people who have smoked weed for 30 years and it's never been a problem- I also know people who smoked weed for 3 weeks and then started using heroin and lost everything. It's definitely a double edge sword.

Lets face facts though: from what I understand she's already got at least a felony conviction (or plea or whatever) awaiting sentencing. Foster care while she's temporarily in jail to get clean is the least of those kids' problems. She's gonna be gone for a lot longer than that regardless. When your mom shows up high for sentencing, that's not your mom. That's just someone who's gonna drag you down the rest of your life.

I am a Substance Abuse Counselor,I see this all the time. Hopefully they get her into treatment and this time she finally follows through with the skills she squires as opposed to engaging in the manipulative behavior that addicts often engage in.

@@SagebrushRambles That is true. However, from what I have seen recovering addicts are more understanding of their patients and make better addiction counselors. Dr. Drew is an example of a non-addict counselor and physician, at the time of his rehab TV show he thought "just suck it up, screw everything else and do what I tell you", not understanding that his patients have other obligations like their children, court, probation, maintaining their housing so they have a place to go once treatment ends, etc.

I’m SO glad this woman’s attorney was dumb enough to tell the court that this woman who will test positive for meth is the caregiver of two small children. I don’t know how she thought that wouldn’t backfire for her client but I’m glad it did. Alternatively, she could have known it would but was worried about the children and tried to bring it to attention. Either way, thank goodness she said it.

To be that calm when CPS may be going to get your kids is unbelievable. The average mom would be sobbing and in a panic attack, though the average mother doesn't take these kinds of risk with their children's lives.

When you are an addict, and when you are high, you don't have normal human responses, emotions, or reactions. The drugs numb feelings, interfere with normal thinking, and cause behavior that is contrary to a normal person not on drugs and not an addict. The drugs becomes the sole focus- everything else is unimportant and tossed aside. It's sooooo sad, but when there are children involved or crimes are committed, authorities have to step in. I REALLY hope she gets the help she needs and gets her life together for the sake of those children!

Thank you for the great editing job! As her attorney is making disclaimers, the defendant passes a note that causes the atty to abruptly stop spinning a rosy storyline. Bad sign. After that, everything about the attorney's body language and comments changes to her client is stoned. "My client has had long periods of sobriety" = "she's sitting here high, and that statement I made I was sure she is not UI was totally wrong." Wow this went straight downhill real fast. Hour and a half drive, no one to watch the kids.

I am in recovery. 13 years sober. I feel for her. I truly do. But she needs this stuff to happen to get her life together. It seems cruel BUT she could hurt one of our loved ones. Or worst she could harm her children. I hate this for her BUT she needs help. I will pray for her.

I was raised in the county that this took place, about 5,000 residents in the whole county. Biggest businesses are the local hospitals.

@@lilyrose7082 Addiction does run in families but it doesn't mean that all family members are addicts. You can tell pretty quickly if someone is an addict most of the time, police officers would probably notice immediately if her aunt was an active addict.

She is being held in jail until she tests clean. Otherwise defense could say we told you so she may not have been clear on everything

First off, I think they needed to get CPS involved, she cannot be an effective guardian of children if she can't be sober even on the day of her sentencing. If they had contacted CPS, the same family member could be referred to them to take custody of the children but then CPS could be involved long-term to ensure they are properly cared for. The court missed a solid opportunity to help the children get into a safe, stable environment. That environment may very well be with the mother, but with supervision. I am not a big fan of the common over-reach of CPS, but this type of situation is exactly when CPS should get involved. ETA: Thanks again, OSG, for a great find!

I agree. CPS can also impose xyz conditions to keep her children, so if she fails that, the kids can be removed and be place with maybe the aunt. But it can also provide resources and counseling for the kids.

@@MichellesMobileMedia I agree in general, but you don't know the condition of the family wanting to take the children. CPS doesn't want to place the children outside of the family because you don't need to be fully foster certified to take in a relative but you do for non-family children. It is far more work and cost to place children with non-family. So, CPS will always try to place within the family. But, I do think that both the mother and the family taking the children need to be evaluated and this was the court's opportunity to ensure it happens. The judge missed a great opportunity to ensure the safety of those poor kids.

@@undecidedmiddleground5633 since the 1997 ASFA TITLE IV funding, our children have become a commodity. It has been my experience in researching these particular situations for the past 13 years, CPS does not have our children's best interest at heart. They used to be there to protect the children. There is money going to these agencies for foster adoption. And it's a lot of money. 3 billion dollars a year the taxpayers pay them to remove children from home. And they still can't get it right. They leave abused children and take children that are not abused because those children are easier to adopt out. I've seen it so many times. They're not going to do a damn thing for this lady's children. Because those kids are "damaged goods". I know it sounds terrible but I heard that statement come from a social worker. But in 1997 our children became the hottest commodity for the state. And I agree, the entire family needs to be investigated if they are to care for these children. I just think CPS is the wrong investigative entity to do it

I love this judge! he's been a successful judge for a long while! I have observed his court room sometime back for observation I was doing while in college for my career! I find him very fair and respected!:)

Time after time I see cases where parents are horrible to their kids, but the kids are shattered when separated because good or bad, the parents are familiar to them. I can't imagine anything more motivating to get clean than keeping your children.
