Quick summary of story: SiOnyx and Hamamatsu signed 'mutual' NDA dated 2007, i.e. confidential info went both ways, of which included an expiry date of 7 years, but a year later (2008), Hamamatsu broke off agreement, SiOnyx didn't state to withdrawn any shared info. And later (2009) Hamamatsu further cited to Sionyx, what they cliam to be their a different kind of 'Black Silicon' processing/structure with intend to reveal on tradeshow, SiOnyx is thus vexed to see similarity to its own invention. Both party took to parallel development till 2014, it was made know to SiOnyx of a patent filed by Hamamatsu which infringes on their invention, so begin lawsuit for breach of contract, infringement, unjust enrichment (profitting from infringement), ending with jury verdict ruling for the Plaintiff (SiOnyx), awarding damages and said patents to Sionyx. Thereafter, herein appeal, Hamamatsu only held up statute of limitation against ruling... A good cautionary tale. To quote Ben Franklin, 'The wrong is always growing more wrong until there is no bearing at all, and the right however opposed, comes right at last.
