Why would the driver be charged for "doing the job he was given and the vehicle the Company provided" that was unsafe... unless the driver actually did something unsafe to cause that person to fall out... but the doors should have been secure... the Park should be held responsible for not providing safe transport...

I’m sure six flags will argue that the driver was driving too quickly… They were going uphill and around a left hand curve when she fell out, and I’d be willing to bet my paycheque that the speed would’ve been perfectly safe if the doors had held, and even more so if the company provided proper vehicles *with seats* to transport its staff

when you're driving a car you're responsible for everyone in it. that's why you get a ticket if your passenger isn't wearing a seat belt. i agree the person was just doing the job they were told but they were driving the van with multiple people not restrained and as the driver, they are responsible.

and they are wrong for that, and it should have been reported before. the fact of the matter is is that when you are driving a vehicle, you are responsible for everyone in it. that's why when your grown adult passenger doesn't wear a seatbelt and you get pulled over or if you have 4 people in the 3 seat back seat, you- the driver, get a ticket for it. yes the minimum wage employee was just doing what they were told but that's why employees NEED to know their rights. if the employee would have said no the vehicle isn't safe enough for me to take this many people and then got fired for it, that would have been wrongful termination and they would have won that case. it's a terrible situation but the fact of the matter is is when you're driving, you're responsible for passengers being properly secured.

As high up in the organization a prosecutor can build a case it should be done. Involuntary manslaughter or negligent homicide should be applicable. Unfortunately, the likely result will be a minimal fine paid by the corporation with no admission of wrongdoing. Managers will continue to work to cut costs for corporations rather than care about worker safety because our government grants immunity to these criminal acts.

i agree but that's when you need to know when to tell your employer no and know your rights. when you're driving a car, you're responsible for everyone in it. if you get fired for saying you will not be responsible for people's lives in a car that wasn't made for that many people, that's wrongful termination and you will win that case. *i do agree this is more so on six flags since they didn't provide safe transportation but the fact of the matter is is that the driver of a car is responsible for what happens when they're driving.

Six Flags Fright Fest employee here. Theres some fact and fiction being spread around. Yes, the driver was going too fast for the area that we are transported around, but the door of the Ford Econoliner van was also broken. It got stuck often, and many times the entertainment department does not get provided with enough golf carts to actually get all the actors to their spots before fright fest begins. Max I’ve seen running is probably three golf carts or two carts and the van? So sure, driver is under some liability, but six flags also scares the hell out of us about providing for the customers while doing absolutely nothing to keep us employees safe. The entire place is run for profit and customer satisfaction. For me, as an employee, I’m terrified but they’re the only place that pays well enough to keep me on my feet right now. And thats the sad part. If other places could pay half as well, I doubt Fright Fest would be running for the rest of the season.

My daughter was a freight fest actor last year. It is not unusual that they are rushing to get the actors on set. However this driver has a history of driving wrecklessly and according to my daughters friends that were ther, the backdoor was broken on the van and driver was being wreckless. Its nice of sixflags to keep thoses details out though

Typical. Six Flags has its staff transported in cargo vans because that’s what the company thinks of them - just cargo, not valuable enough for them to be properly transported in a passenger van. Some reports I’ve read said that there was a problem with the back doors, which was why they sell open, allowing the passenger to tumble out. Some people are blaming the driver for taking an uphill corner too quickly given that the passengers didn’t have seats. I think it’s pretty clear that if the passengers did have seats - you know, if they were being transported in a proper passenger vehicle - the speed would not have been an issue. Even if the back doors latched properly, it wouldn’t have been an issue. Six Flags is undoubtably going to get hit hard with fines and a lawsuit, but I don’t think that will make any difference in their operating philosophy

This is the first time I've seen where there was a tragic fatal accident at an amusement park that no one died on an amusement park ride usually it's a horrible accident on a rollercoaster but this time no rides were involved in this tragic fatal accident.
