James Charles is delusional in saying Netflix "stole" his beauty documentary idea. It's ridiculous to think ideas that haven't been publicly disclosed can be stolen -- and beyond that, filmmakers can come at the same topic in many ways. Tagging Netflix to try to ruin Marlena's opportunity was the height of immaturity. If Netflix had wanted to work with James Charles, it would have contacted him.

How does he even know what ideas they are using. Just saying "I was going to do a documentary about "beauty"" is dumb because imagine if only one person could do a documentary on ANYTHING. Oh, you got dibs on WWII? My bad. Guess we'll have to toss out hundreds of WWII documentaries.

How can JC lay claim on a beauty docu when it was Shane Dawson and Jeffree Star's idea a whole year ago. He is always taking others ideas and trying to pass them as his own. Plus he has only came out with one pallet and that was a collab so really why would anyone go to him for a docu when he really wouldn't know anything about it, except picking colors and names.

Tati's video was about her personal life, so the mentions of her product could come off as forced. But Marlena's video IS about companies and the whole business aspect of the industry. Personally it didn't feel out of place for her to talk about her company as it was directly connected and relevant to the topic of the video.

Well but James did embarrass her by promoting Sugar Bear instead of Halo. I’ve watched her support him like crazy and I never liked him since I first saw him in her in her condo, just got a bad vibe from him. I don’t even remember her mentioning Halo in that video because I was just so happy she finally saw him as his true self. That he insulted Marlena with the Netflix thing I was beyond shocked at how fucked up his view of himself was.

I started watching beauty videos in 2008, I was 17. I watched all of the creators many people missed out on. It was so much fun back then. The people behind the camera were sooo passionate about makeup. The ideas were fresh and new. They weren't trying to sell anything, just sharing their passion and creativity. They had nothing to gain from the brands or products they used. The excitement when a brand sent them a product for the first time was pure and genuine, and now its expected. There was no photoshop or facetune and you couldn't trick your audience into buying products to achieve an unattainable look that took hours of enhancing an editing, what you saw is what you got. They didn't edit much if at all and it was honestly so fun, informative, and realistic. Intentions have changed and greed has stepped in. I don't care if you're Jesus, demanding such a high price to talk about something you're supposed to love and have a passion for is disappointing and has honestly permanently ruined a majority of this community.

Girl I agree. Also, I have a law degree and I took an optional consumer law class. Here's my academic opinion, not a legal one, please don't rely upon it for legal advice; any such reliance does not create an attorney-client relationship between myself and antone. Accepting an automatic refund doesn't necessarily negate a legal claim. Products liability is an intersection between contract law, torts law, and administrative law (includes consumer law). If a websites TOS state that accepting a refund constitutes a waiver of your right to sue, then yes, you can forfeit your right to sue. Her TOS do not say that. Inyerestingly, they do limit liability to personal use of the lipsticks-- so MUAs who purchase these have no recourse with the company for harm to their clients or loss of income, etc. An automatic refund also probably does not create a contract because the consumer had no choice; thecrefund was announced and there was no option to click "accept" or to opt out, it just is. In order to firm a contract there must be a bargaining-- an all or nothing choice is no choice at all. However, here's the rub: in order to sue you have to have a "quantifiable harm." Basically it means you must have a financial loss, a physical hurt, or a mental/emotional hurt. The refund would probably negate the financial loss for the people who had no side effects from use or chose not to use the contaminated product. Which definitely is where most people seem to be categorized. It also sort of hits any implied warranty claims-- there is in consumer law an implied warranty that products you buy should be fit for their intended use (the lipsticks were not). Going back, if there was a hurt that caused additional financial loss, those people could probably still sue. For example, the girls who cut their lip open/ had swelling/ hospitalization/ etc could sue for their provable medical costs. So, in a way Kevin was right-- giving refunds automatically reduces the pool of potential claimants. However, she did not recall the products whic brings us down to the admin law part. The FDA is the regulatory body. The FDA's legal term for contaminated product is "adulterated." If adulterated products are put in the stream of commerce (aka put out to the public for sale across state lines) and some is harmed-- the company is liable period. It's called strict liability. This is why a company wouldn't want to have a recall-- especially if they know people were hurt by their product. If a lawsuit arises they will lose even if they went above & beyond normal measures to ensure safety. Because strict liability is about the results not the process. It also opens the door to tort negligence suits if the company knew or should've known that proper safety measures were disregarded. This is often hard for consumers to know or prove but easier for the FDA. Law is very rarely black and white. Also, once a recall is issued the FDA monitors the company for a period of time, which often means additional costs for that company. I think, failing to recall was a mistake for many reasons, including legally. But I can see why a company would not want to do it. PS- my specialty is IP law but lawyers get a broad base education and it's pretty easy to look these things up, however it does not make me an expert by any means. A lawyer has 2 jobs-- (1) to read and interpret the laws and case histories; and (2) to assess the risks involved in how a law might actually be applied. Here's a good example-- fan art/ fan fiction. These things are technically illegal derivative works (it's not a fair use unless specifically stated in the law as an exception- like education- or, a judge says it is after weighing 4 factors). But an author/ creator is not likely to sue a fan because they would look very bad and people would probably not want to buy their products. Food for thought. My final thoughts about the legal side: my consumer law book gave some facts about products liability. ISBN9780314161529 p.769+ talks about consumer disputes and companies and how they try to resolve things privately. To sum up some of the more interesting facts-- consumers typically do not speak up about roughly 2/3 of product defects. They just don't repeat bu, leaving the problem unaddressed. When people do speak up complaint are more likely to be about simple problems involving expensive items, because rich people are more able to seek help from 3rd parties like lawyers. Of those complaints about half are resolved satisfactorily from the view point of the buyer. So if we extrapolate to lipstickgate-- complaints are louder because it involves luxury goods, but probably about 2/3 of buyers won't complain about receiving faulty product. Food for thought. Anyway, I agree with what you said about MS. I think part of the reason why her brand was on the low the last couple years was because she was trying to recoup some of the losses from the failed collab with JH and that lab. That's a ton of money that was sunk into R&D and products that never went anywhere. That's also why I think the recent packaging change to that horrible, cheap stuff. I am willing to bet it was a money saving move that enabled them start building back up. Especially since they were at Target.

Between Tati and Marlena, I think Marlena came across more genuine in her videos, I feel the only reason she talked about her brand was to explain a lot of the rumors. It is hard to be a CEO and Influencer at the same time. I am sure tati feels the same way. I relate to Marlena so much because I genuinely care about people and a lot of people aren't that way. And you feel hurt, I think good things happen to good people and I hope people stop the hate train. So glad you posted your thoughts.

@Sai Priya Chodavarapu yeah, maybe Tati is being truthful, but everything seems more calculated. It could be that she is trying to stay professional.. Who knows... You can tell that she is a good person and is passionate about what she does.

I think Tati is calculated. She condemned James for coming after Marlena, but allowed him to drag Marlena on her channel. She could have edited it out, but chose not to. She wanted the views, while seemingly keeping her hands clean. Before all the drama with she and James, I wondered why she left that in her video if she didn’t agree with him. It’s fine that she’s not perfect, but she sure as hell acts like she is pure and does nothing wrong...ever.

@@nalaspocketyt omg that is so true. I hadn't considered that. I do agree that she acts as if she is pure and nothing is ever her fault. I find it quite annoying. But I feel that as long as people are her friends she is willing to over see a lot of wrong behavior... Until it works against her.. Like her vitamins

Exactly. I don’t think Tati is a bad person, but she seems unable to see her own flaws and motives, while quick to point out the faults of others. The Mother Theresa act just annoys me. You’re flawed and it’s ok. To act like part of the reason she called James out wasn’t due to hurt and anger is BS. What he did was wrong, period, but discuss it privately and end the friendship if you can’t work it out. Why title it “Bye Sister” if you aren’t looking for attention.

I think Marlena has opened our eyes to what’s really happening in the beauty community. Ive been on KZbin since the beginning when Jaclyn was doing videos in her kitchen because that was the best light for her. I respected her then but as she climb up the ladder she became very unlikable. So when people say we are just jealous, that’s a stupid and immature statement. We just remember when she was relatable and now she’s not. Marlena has always been who she is, she’s never changed even though her financial status has and we still love her so that “jealousy” statement doesn’t hold any weight and I wish uninformed immature brats would just shut up. I applaud Marlena for saying her piece and I wish her the best of luck. She’s always been transparent and honest with her followers. Thank you for your thoughts and insights as well. Thoughts by candlelight, I like it! Marlena said that everyone has a part of play in how the beauty community is today, and that's very true. She deserves a ton of respect. People have short memories. Marlena has been around a long time. Her intentions truly seem to be coming from a good place. I think it's sad that grown adults feel they have to respond to immature gossip and malice. If the beauty community was a company, 80% of the influencers would be fired for workplace harassment. Also re: the girl with the photograph beef, minimum wage where I'm from is almost $15/hr. So $100 is more than 6 hrs of work. Did it take that long to take the photograph? Then she got paid.

I remember watching beauty videos back in high school (2008-2009) and it was a totally different space, just people who loved makeup getting together. I remember when Lauren Luke (panacea81) got a deal doing a palette and it was a huge thing, because it was the online and real world in makeup crossing for the first time. It didn’t seem like there were as many trolls back then. I think the brands getting involved really screwed up everything, like you said. They had to make rules for these situations because none existed. A lot of these OG gurus have moved to other things and are basically out of the space they built. It’s crazy to think about.

New fans come along everyone/some are so loyal so no matter what the case, as long as consumers are buying the influencers (sketchy or not) and brands will make money! At the end of the day, no matter how nice and genuine an influencer is, the consumerism takes precedence because this is a cosmetic industry where people are trying to make money! Because she is so nice people see her as weak and the truth is "that woman " is SO STRONG! Look at everything she went through personally and professionally... Her relationship with abusive ex, a miscarriage and all the issues with her MUG releases, she is so professional she didn't whine to everyone over the last few years the way others do, and I feel because she is so open hearted people see her as weak when really they should be bending the knee and kissing the ring... I like Marlena. I feel like you’re right about her being honest to a fault and very empathetic. I watched her entire video and I just feel for her ❤️ I think she might be a bit to trusting, bordering on naive. And while that in and of itself is a quality I find totally beautiful 😍 ( and a personality trait I share with her ) it tends to attract people that just walk all over you sometimes. I hope everything will go well for her in the future, that she will accomplish all she has set out to do, and most of all I wish for her to be really really happy.

Hey Hannah, i can’t know for sure, but I saw the refund email floating around and I thought it said that they noticed the lipsticks weren’t up to their standards and that’s why they are automatically refunding everyone and will do better. The email went out to everyone who purchased a lipstick. Not negating your point that a recall would be better but I thought it was worth it to mention that at least even the people that don’t have social media are being notified about the quality issues and are being refunded. Thank you for your video!

I've been watching beauty gurus since around 2009. I sort of stopped watching for a while and then a few years ago I got really back into youtube again. It has changed SO much. I can't even watch these big 'influencers.' I just want to watch hauls and what's in my bag videos and makeup tutorials lol. This is why I'm subscribed to girls like you, Lacie, Hannah Poston etc because there is a genuine honesty to the videos and they take me back to the old OLD days of youtube in a way. I think anyone who watched back then is probably a bit nostalgic for it. But even the old youtubers I used to love in that community got a bit swept up by the 'influencer' vibe, like Juicystar07 (Blair Fowler) for example. I still love her and am subscribed to her but youtube seemed to blow up a few years ago to me and that's where all the channels seemed to change and really grow into crazy amounts of subscribers. I can't explain it but back then no one saw youtube as a 'job.' And don't get me wrong, it's awesome that it IS a job for so many people now. But that aspect of it can really deter people from making high quality and FUN content that feels genuine. This is all so obvious lol but I basically I miss the old days!

I've only starting watching beauty videos in the last year so it was interesting to hear from her perspective how some of this stuff started to where it is today. James keeps trying to advocate for influencers to be treated like other celebs and making youtube more like mainstream media. When he gets called out for the money he makes he attacks. Why is it I can look up the amount of money almost any celeb makes in a role but influencers get to keep everything secret? If influencers and celebs are equal like James tries to advocate for then the should be equal in pay transparency. I don't have a problem with influencers making money, everyone needs to make a living. Just be honest about it. Say something like "yes this is a lot of money and I'm grateful" instead of attacking other people. That attitude really rubs me the wrong way. Sorry for the long comment. Thanks to anyone who reads it

I started watching beauty videos around the begging, they truly were the good old days! I recommend watching old beauty vids, they’re so sweet and pure (and it’s just interesting seeing how things changed).

I watched the entire video as soon as she uploaded it. I honestly was a little saddened. It makes me sad that some of my favorites are stepping away from the platform. I guess it's not the end of the world. I'm just a creature of habit and I like the connections that I've made. It's that end of summer camp feeling. You'll never be able to recreate that summer. Those memories last in your gut for a lifetime. And even if you all come back next summer, it won't be the same. 😔

I loved her video, I appreciate her transparency! I can see how some people will still misread her (for the reasons you mentioned) but I've never gotten a bad vibe from Marlena or that I couldn't trust her. I always factor in a margin of error and the possibility for her to be lying, but she is a voice that I think is genuine. I'm just strapping in, because I see the potential for drama. I can't foretell how, but she said too much for something not to go down, in my opinion.

Too many people are in the beauty community now to make money and not for the love of make up as they want the “celebrity” lifestyle with all the designer brands, big houses etc it’s that simple! There’s only a few I trust now and would take their advice whether to purchase a product or not................very sad but true 🤷🏼‍♀️

I watched this last night when she uploaded and I pretty much agree with all of your thoughts on this as well! To go off of what you were saying I have been watching KZbin since 2011 and the beauty community was nothing like it is now. One of the major “gurus” back then was Bethany Mota & then her downfall was after she partnered for a clothing line and she kind of stopped makeup. And then Meredith Foster who to my knowledge doesn’t even really do makeup videos anymore either. The people who have been on KZbin that long who are still on here do NOT get the recognition or following that they deserve who they truly worked hard for out of passion and not for a quick buck such as ItsJudyTime like Marlena mentioned and there’s so many more who are still in my subscription box. There’s some people who kind of paved the way who don’t even do KZbin anymore because they just didn’t like or understand how it ended up being how it is now and it is really sad that people like James is at the forefront & are a “voice” for the community when it is so much more than being a little 13 year old stan who will attack you if you speak against him. It genuinely was a good, happy, peaceful environment and the only “drama” there used to be was if 2 people reviewed a foundation and one liked it and one didn’t and people weren’t very educated on the fact that not everything works for everybody’s skin lol. But that’s all I had to say & I loved how you put this video!

Very well said and put together, thank you. Marlena seems to me from all I have seen from her over the years like a lovely, genuine, professional and a very passionate and creative woman full of empathy. She fell prey to a few narcissists along the way, JH and JC are quite the obvious ones, don't have a clue who the Nicole (?) person was or is. I'm in my 40s and have started walking YT with my first 3 channels Lisa Eldridge, Wayne Goss and Marlena Stell. All very professional, with integrity, creativity, greatly respected and passionate about make up and passing on their knowledge and skills. And also with very calming voices, hardworking adults. Marlena rose from the poop in the last 2 yrs of her life like a phoenix from the ashes, with class, grace, fire in her belly and honesty and transparency. Beauty community has some great people, yourself included, and I watch their videos, and a huge number of other ones are a bunch of narcs. Whenever and wherever there's a chance of money to be earned, the rotten stuff comes and settles in. It's the way if the world, I'm afraid. Always has been, and sadly, always will be. Money is a resource and resources are power. On another note, do you know what happened to MUG on BB (beauty bay)? There's only one product left there !?!😟 where are all them single eyeshadows gone?!?😭😭😭

👏If we were in church, I’d shout out a hearty “Amen” sis. In my opinion, Jaclyn knew her lipsticks were old, the house! 👏🍿🙌💄 Speaking of old, boy Marlena nailed James Charles. Young Mr. James is soo ageist-in his coming “back to YT” video he whined on that he worried he wasn’t relevant anymore *AT TWENTY* but ultimately decided he was cool and the exception. I think he has zero respect for Marlena or her experience because in his mind, people at her “advanced age” are irrelevant and he honestly thinks his opinion and brief experience only as an influencer & brand spokesperson for a cosmetics company is more valid than anything Marlena has done because she’s not on the pulse of the youth culture like James sees himself. It is unbelievable how disrespectful he was in using his clout and platform to bully Marlena in front of Netflix, and I hope he’s subjected to similar scrutiny with an important project he works on in the future because he deserves understanding how it feels. It seems it’s the only way he learns. I find him astonishingly gross, and I don’t like that so many young people see him as a role model-I’m surprised his big head fits into his Tesla. I gave up on him after his foul comments about Ebola and it’s been interesting to watch his penchant for keeping both feet in his mouth at every turn, and he’s appears to still be eaten alive with a severe hubris infestation and is a constant apologist. The poor dear...but this 47-year-old’s opinion is too irrelevant to matter because I’m sooo old, after all. 😂💀⚰️

This doesn't take away from your point at all, but I've heard this statement several times that "there are people who bought Jaclyn's lipsticks who aren't on social media." Where did this idea come from? The only way anyone could possibly know about this brand is through social media because it's not sold in stores, it's not on QVC... I feel like 99% of her customers heard about her brand through KZbin or Instagram. They might not be following drama channels or other influencers who are calling Jaclyn out, but they must be ON social media, right?

Miri _ She might mean that there are ppl who have followed JH on Instagram for years who don’t use Twitter or KZbin and ordered lipstick when she announced the launch on her Instagram. It’s kind of a world apart where drama in the comments can pretty easily be squelched by a moderator. Ppl who follow her on Instagram may never hear about this drama and a company might want to preserve that by not announcing a full recall.
