If the employee is bashing the company specifically then of course they can fire them, but if the employee is simply making educational videos about the workplace and ways to handle conflicts why can that company direct them to stop?

Yeah I think that was the point, which was why veronica was going to send the lawyer directly at the manager. It was a pretty clear intimidation attempt and honestly, until she hears from hr the only conclusion is its from the manager borrowing their scary name and title to try and threaten without directly doing so.

Yep. I worked for a VP in a public school like that. I immediately called my union and was represented at EVERY meeting she called--and she'd call one for 3:30 every Friday without giving the required 24 hours notice. The union put a stop to that.

At my last job my boss did/said a lot of unlawful things to me, creating a hostile and panic-provoking workplace. She demanded to know what was in my medical records after I returned to work from a hospitalization. She asked me about being gay and would say things like "I have a gay customer... Was this a gay thing?" She refused to let me take my vacation time. I wish I had seen your videos then. I suffered in silence and never reported her. Your vids would have helped me know my rights and empower me to stand up for myself. Thank you on behalf of all the people who were like me. You are doing an important public service as well as providing hilarious entertainment.

I had a Manager screw me over on time off. I kept my mouth shut (I was really mad though), did my job. Manager and HR were happy with me, He blamed HR and when I went to HR, asking what happened, they in turn said , I don't know what you are talking about, talk to your manager. He was trying to blame them for his screw up and didn't think I would go and ask. A month later he thanked me for being so gracious with that predicament. About a year later, there was an opportunity to make him look bad, to his face, in front of the new director. I took it, while looking him in the eyes, straight faced. He got fired in the 1st round of layoffs (company was sold to a new owner, "restructuring/streamlining"), I made it look like we didn't really need him, he was redundant, that our department was self-sufficient. I never had anyone mess with my PTO again.

@@Andrew-it7fb That's not how "right to work" laws function. Right to work simply means that Union membership is not mandatory. What you're describing is most likely at-will employment, where a company can fire you at any time for any LEGAL reason. In this case, firing an employee for speaking out against scummy corporate tactics (without mentioning the company) would be seen by a lawyer as wrongful termination and retaliation, meaning most likely a hefty lawsuit

If HR has an issue with anything dealing with an employee’s social media activity, HR needs to have the conversation with that person, directly. As a manager, I would not engage in this type of conversation with an employee. I would just let them know that HR will be reaching out and will provide the necessary details. This type of back-and-forth would never happen with me.

Back forth is pretty much child’s play. As said person is often trying and aiming to trigger whoever they’re targeting to behave in ways they either expect them to……or know that they will. If and when someone is poorly educated and lacks in valuable experience, they will continue to search for ways to push said persons buttons. What they do is on them…….as there’s no need for you to tit and that with them. Plus, even if you can *easily put them in their place by saying something ugly, it’s not even close to satisfying.

At a conference (at a meal attended by industry colleagues) I denigrated a company that our corporation has recently made "deals" with. This was overheard by a journalist and reported in their publication. Corporate came down hard saying I'd broken policy, that my position was at risk, etc. Unfortunately for them I'd been in the process of making those policies available online and I *knew* the policies. So I simply asked them if they could please let me know which paragraph of the policies I'd infringed. Silence. Never heard about it again. It was the start of a fairly long career of me knowing the rules better than HR. Then, thanks in no small part to that deal they made, they went bankrupt. But that's another story.

Unfortunately, most states harbor a right to hire / fire law(s). Which means, even though Veronica may be correct about almost anything in these videos, often times a company can release an employee for almost any reason and leave that employee with not much to do in terms of a defense to the lay off / firing.

If she talked to her boss like this, she could be written up for insubordination for constantly battling her managers.. or creating a hostile work environment by making every conversation transactional.. hell, they can get her for being late by 1 minute.. My point is that you do not want to talk like this to your bosses. Let them fuck up and either take it to hr or court. But don't fight them on the floor, or they'll show you how petty they can be.

@@thebatman6201 While that is in practice of course possible, it's a careful invisible dance around the employer wanting to get more and the employee wanting to give less. The employee has the risk of being fired, and the employer has the risk of a lawsuit or bad press if they fired the employee poorly. I do agree that what's shown in the video is hardly a great way to communicate for either party. All around escalation for no reason.

I just became pregnant with my third child and was moved to a new supervisor. When I told him I was pregnant he laughed and said “I hope you are coming back after”. I laughed it off because we did have a handful of people in the past that would say they were coming back and disappear. It was when he said “as long as it doesn’t affect your job performance”. Went straight to my manager…whom I had a great relationship with. He never apologized but did tip toe about the situation about sometimes saying things with one intention but it comes across as another. Oddly enough I never got much criticism from him after that despite his history of it with other employees…..so weird

No one learns anything or cares until laws are crafted that criminalize their behavior and carry serious jail time. Serious jail time (I'm not talking a couple months) like 5-10 years o more will modify behavior. Its the ONLY thing that modifies behavior, or things like canning where you are beaten so badly that you are crippled for life. When dealing with sociopaths, serious criminal consequences are all that matter, and the USA has basically none when it comes to employment law. Even discrimination only has civil penalties.

Had this happen to me, My company does some meeting stuff online but rather than using zoom or something they wanted us to link our personal facebook accounts to something so the company could see and access it. When I said No way, they tried to put pressure on me and say I wasn't a team player, I simply responded, "are you sure you want to go down this path?" They smugly said, if you don't do it, it's your job! I replied "Can i get that in writing?" they responded with .....Why do you need that in writing? Me "so I have clear intentions to show to my lawyer" They dropped it the next day.

Where I worked “introduced” a social media policy with no consultation from the workforce. It was so broad in how it was written that you could be bought up on disciplinary charges if you insulted the country that owned the company. Thats right. If I, at the time said “Ch… was responsible for the release of the c.v.d v.r.s “ I could have lost my job. We had one person get hauled over the coals as he had a sick day but the next day on his rostered day off he went surfing. He was questioned as to why he was surfing the day after a sick day. Needless to say he told them the gagf and what he did on his rostered days off was none of their business and he said if they wanted to continue he would give them his lawyers phone number as he will be suing for harassment. The hint is to have no one from work as a social media friend. Simple.

Take it from Gen Jones, kids: the answer is to document EVERYTHING. Keep a daily PAPER journal of your work tasks and of any conversations that make you go hmmm… (the tasks actually help remind you of your upskilling, for your CV/resumé) Archive every email that makes you go “hmmm”. When it was a message, a postit or a conversation, send your confirmation/recap by email. Take an hour once a month to review your Cv/resumé and consider what new skills or responsibilities you might add to it. The very fact that you keep it as an ongoing thing makes you much, much less susceptible to “might get fired” blackmail. Apply for a job every now and then with some other outfit. Especially some that you think are a bit grand for you. One more hour a month just looking at what's out there. If you ever get a job offer, even if you don’t want it, be sure to let your colleagues know. Then your boss knows.

I don't know why "Veronica" thinks she can't be fired because of her social media. The "Right to Free Speech" only applies to the government. Your employer can fire you if they don't like your socials, or personal posts, or for no reason at all.

It does, as she is exercising that right outside of work hours. Unless she signed an employment contract about her behavior negatively reflecting on the conpant, her activity outside of non-working hours is not their business.

I have been the target of this level of hostility at 2 of my previous jobs. I believe the reason this happened is because I intimidated my immediate supervisor and I also would not allow myself to be manipulated or bullied.

My new employer just had their Introduction with my department. One of the things they mentioned was this exact topic! Essentially it was 'Don't talk shit about the company.' I thought that sounds an awful lot like infringing on my first amendment rights.
