They should have given a course on this when you were in School, I can understand what you are explaining now, but had I known this 60 year’s ago, my life would have been different. Now I understand why there are so many old people on SSI.

Thanks. It always feels strange when getting a divorce is the next step to increase Social Security benefits...but it happens!

I was disabled for yrs. I was asked to come in for review for SSI then when speaking to the Representative he seemed surprised that I was looking at some back pay and I was really surprised that he said I was due for survivor benefits however we have to penalize you for 2 years because you didn't apply at 50 yrs old I was 54 at this time. I was told when carrying for my husband that I don't have to worry about nothing until around retirement. So how was i to know that I had to apply for anything why was I not sent a medicare card? They kept 23 Thousand and gave me around 11 thousand. I am 60 now What are my options now and why did they penalize me so much?

@@Dolphinfinancialgroupfl My wife is 45 and I am 60 years old. I plan to take my maximum benefit at age 70. My wife does not work and she’s a stay at home housewife. I want her to have the maximum benefit I believe she’ll have enough money and assets to wait till 67 is that the best strategy for her to get the maximum benefit from my Social Security? Or should she take it at the age of 60? My other question is if I took it at 70 and lived to be 71 I would’ve had a year of benefits. But when I die my wife will not get my benefit anymore until she’s at least 60 correct? So I told her to wait 67 to start drawing again would that be the right strategy?

@@robertlulek1634 Since you are waiting until 70 to claim yours, that will serve as the Survivor benefit for your wife after you pass away. As for when she should take hers, that's a decision best made after some math. 62 is the earliest she can take her own record, unless disabled. She’s in very good health and I think that you’ll live a long time so I think that would be a bit better choice. Also I mentioned she does not have a work record so it would be solely based upon my Social Security

@@robertlulek1634 If your wife doesn't have her own benefit, she can claim against your benefit as early as 62. She should consider doing so versus waiting until 67 or 70. The "best" scenario will depend on her life expectancy as well as your life expectancy. When you pass away, she can claim your much higher benefit and drop her own. She won't get both benefits, therefore her claiming strategy is highly dependent on your claiming strategy and life expectancy.

I have a question I was married for more then 10 years and then I got divorced. And then my ex husband died and a car accident. He died young an a car accident. But after hi got divorced from me. He married another women and he had two kids with her . At that time my son was 11 years old. And I never collect any money for son. Now my son is 43 years old. My question is can do something to get benefits from the social security for my son? . I think the second wife of my ex husband collect benefits for her kids. My income was higher than my late husband’s, he passed 5 years ago at the age of 79, I am 76 now, so I only get my benefits. His ex wife does .We were married for 39 years. It is just not fair, you still need that income to pay for your mortgage and expenses. Now I can’t afford to keep my house anymore . Changes should be made to correct that . At least have it prorated.

If your benefits were higher you would file under yours. His ex wife filing under his doesn’t have any affect on you whatsoever. You don’t get two benefits. Once deceased you get either your full amount or his full amount, whichever is higher.

I’m confused do you have to be married for 10 years or 9 months? What is the difference? Is it 9 months if your spouse dies? And 10 years if you divorce?

You have it correct. 10 years if you divorce and 9 months is if you are currently married and spouse dies. There are some exceptions to the 9 month rule such as death from an accident.

Unfortunately he took his own life after we were married for 2 years 5 months and 24 days. By the way, we remarried each other always lived together and had our 2nd daughter who was 15 when he passed. He passed in 2008

I'm paying back 1st marriage over payment mother and child he had run and spent the money and this could been dealt with so ssa told me there automatic taken it this is not fare to me cause I married another guy and wonderful and my ex was very abusive and took me out of state and dumped me but it's worth 12 months of he'll but they can't touch me again thanks for this program people need to know this

What if the wife is a teacher and when she retires she will get the teacher pension as well as social security that she earned when she worked 15 years paying into social security? Her teacher job was a second career later in life.

Can you clarify your question? In some states, teachers are ineligible to collect state pensions and Social Security.

Payments are administered by the Social Security Administration. They are the ones who would be paying you for your own benefit or your deceased husbands if you qualify. Start by contacting them for your answers: www.ssa.gov

Payments to existing Social Security beneficiaries were not impacted by past government shutdowns. However, new applicants or those needing government services around SS may find delays as some workers are furloughed.

The 10 year rule applies to ex-spouses, which would apply in your case. However, you are currently married so you'd qualify for the Survivor Benefit either way.

She needs to contact SSA and provide the details of her situation. SSA will determine what, if anything, she is entitled to. From your summary, it seems like she may be able to get a spousal benefit or a survivor benefit, depending on the status of her ex-spouse.

I am 81 years old and I have my own Ss. I have been widowed twice. I was married 25 years and 5 years. I remarried when I was 16 days from being 60. I had no idea I was doing something that would penalize from sharing in their Ss. I was told I did not deserve any of their Ss because I am not a widow. They also said I could have the money when and if I would divorce him or when he dies. Is there anything I can do about this? Susie Darling.

@@susiedarling3350 you certainly will want to confirm with the SS office, however, my understanding is you can not switch to a widow benefit since you are currently married before age 60. If you got divorced then you could. Also keep in mind, if you did get a survivor's benefit you would lose your own benefit if it is lower...you don't get both.

It sounds like you may be able to claim a Survivor Benefit. It would be 100% of your ex's benefit, but that would make sense only if it is higher than your own benefit. You can't claim both your own and a deceased spouse's.

Can you explain more about Rail Road retirement. I was married 23 he worked on Union Pacific Road I was filing early because a accident at work. I look into Railroad and mine and took the RR however early I was given the wrong info and switch took my SSI I'm still on. At my retirement age I talked with RR would it increase it would stay the same.

The Railroad Retirement system is separate than Social Security. Benefits can be coordinated, but you'll have to contact each entity to get the information you need. It doesn't hurt to call and ask questions - you simply won't know what is best otherwise.

You might be able to switch to your own benefit. Now that you are full retirement age, you would get a higher percentage of your benefit and it may make financial sense. Keep in mind, you only get 50% of a spousal benefit. If your first ex passes, you might be eligible for more if that amount is higher than your current Survivor Benefit. You should call the SS Office to determine get the actual amounts.

You normally can claim a survivor benefit as early as age 60. However, in your case it may make sense to stay on your own benefit and switch to a survivor benefit at your full retirement age. You'll want to contact your local SS office to get some numbers on your potential survivor benefits before making a decision.

I am in a very different situation that was explained in this video. I lost my wife 2 weeks ago due to drug use over extended periods of time. She was 38 and I'm 43 so basically I don't have to worry about claiming any survivor's benefits for several more years until I'm at least the age of 60 correct?

Sorry to hear about your loss. Regarding Survivor Benefits, you can get them as early as age 50 if you are on Social Security Disability. Otherwise, age 60 is the earliest.

It certainly sounds like you are entitled to a full Survivor Benefit. You should contact the SSA and find out if it would be an increase to your current benefit.

My SS pension is only half of my husband’s SS pension. We both have Federal retirement pension but my federal pension is higher than his. We got divorced and we stayed married for 20 years, can I file a claim on his SS ? Also , my SS has been cut to almost half when I retired because I have federal pension although I contributed to SS for 23 years. I was a single parent then,with no child support.

It seems like you are already getting the spousal benefit and are also dealing with the Government Pension Offset. It will not hurt you to contact Social Security to see if you can get an increase based on Spousal Benefits, in case you aren't already.

You may be able to claim Survivor Benefits now and switch to your own benefit later. Or, you may be able to take your benefit at 62 and switch to your Survivor Benefit later. It's a complex decision. You may be able to add Social Security retirement benefits to your SSI at 62. SSI and traditional SS benefits are different.

Guys, what abt this: I was married 24 years. I am a teacher and have STRS and have 5 more years to teach. He always made much more than me. He is turning 62 this year and filing. Can I start collecting my 1/2 of his when he turns 62 this year? He took everything but the kids (who he dumped too), and I really need this extra income. Also, if he dies does his current wife get it or do I?

When you can collect Social Security is based on your age. So if you are eligible for a spousal benefit based on an ex-spouse, now that he is 62 you can possibly claim. Keep in mind, you'd be claiming on your own and getting an increased amount based on a spouse. As for if your ex-spouse dies, you could claim a Survivor Benefit and so can his current spouse. You both can get a Survivor Benefit based on his record simultaneously.

Sorrry the reply wasn’t coming thru. I’m still not clear if I have to wait to claim until I turn 62 or if I can claim now that he is. Also, I have heard that if I will receive STRS I can’t collect his. That makes no sense to me. Is that correct?

You need to eligible for your own to get a spousal benefit. So it sounds like you need to be 62. As for STRS - I assume that it some sort of state pension...that depends on your pension rules. Look into GPO- Government Pension Offset.

Social Security is available at age 62 for most people. If you are disabled, you can apply for Social Security Disability. You'll need to contact Social Security to get the process started. If you have specific questions, you'll have to provide more detail.

@@ethelbutler9066 I am not certain on SSDI benefits as they do have some specific rules that are different. But, generally speaking, when you claim half of a spouse, it is only if that is more than your own. What happens is you get your own benefit, then an additional amount is added to "step-up" to what one half of your spouse's would be. So in your case your own record would need to be near or below $1,000/m for this to occur. Additionally, if your ex is still alive, you need to be 62 to claim against them, but can claim against a deceased ex-spouse at age 60. I do recommend you contact your local Social Security office to get the actual numbers and confirm the rules. Good luck!

The 10 year rule is specific and strictly followed. Unless your marriage certificate and divorce decree show ten years, I think you are out of luck. Was your divorce formally documented?

For regular Social Security benefits, the government is concerned with how long you were legally married. If you didn't get divorced, then you should be all set. Please check with your local SS Office to confirm.

Spousal benefits start with your own claimed first, then an increase to up to 50% of your spouse's benefit. So, your own benefit needs to be less than half of your spouse's to get an increase.

Typically SSDI benefits change to regular social security benefits at your full retirement age. The benefits typically stay the same.

Since you are getting about 1/3rd of his benefits, you probably claimed spousal benefits at 62. At 68, you can't undo this decision and are locked into getting what you get. The next time you would see a change would be if your spouse dies and you claim Survivor Benefits.

What you get depends on when you claim and your age and your work history. Regarding benefits based on an ex-spouse, you could get half of the ex-spouse benefit if it is higher than your own.

When a spouse passes, you typically keep your own or get your spouse's survivor benefit- whichever is higher. If his benefit was smaller than yours, then it goes away. However, you may be able to take his and switch to your own later if you haven't claimed yet.

If your ex is deceased, then you could qualify for a survivor benefits. If you collect survivor benefits, you may be able to continue them if you remarry after you reach age 60. (Age 50 if disabled). Just be sure you report changes in marriage status to Social Security.

I don't understand your question. Please expand upon it. Generally speaking, you are able to claim your own benefit at age 62, but you'll take a reduction for claiming early. You may get an increase if half of your spouse's benefit is higher.

Maybe. Your own benefit isn't impacted by marriage. However, if you are getting a benefit based on a spouse (current, former, deceased), then your marriage situation may impact your benefit. Remarrying after 60 does allow you to maintain benefits from a previous spouse in certain instances.

The Social Security Office will help you if you are able to provide documentation such as a marriage certificate and divorce decree. They will tell you what info you can provide instead of the SS#.

Sorry for your loss, Lequita. Survivor benefits are either your own or your deceased spouse - whichever is higher. You don't get both. Since you were already receiving benefits based on your spouse, you generally do not need to file an application. It seems like your benefits were automatically recalculated at your husband's death.

SSDI has different rules when it comes to marriage. You will have to check with the SS Office. However, I believe there is a chance you will lose SSDI based on your father's benefits if you get married. You should consider that possibility and confirm before getting married.

...I would love to talk with you !.. My wife died ..age 36 Nov 2008.. at the time our only child was just months old. My own convicted felon (1988) mother intercepted and lied to the SS administration ...claimed she was caring for my daughter including me living with her resulting in her stealing ALL of the survivors funds from my deceased wife.Still to today's date she receives my now 12 year old daughter's portion. I have never recited with my mother passed age 19 and briefly after the Marine Corp release in 1996. My mother took me to corrupt family court to get guardianship and remove fathers rights ...my wife's name was forged for consent. I have so much proof from the banks claiming this. Could you point me in the right direction ? I would appreciate any help.

The ex-spouse needs to be eligible to collect in order for you to gain the spousal benefit. It's can be tough rule in some situations like yours. I know of people who are waiting for their ex-spouse to turn 62 before they can claim the spousal benefit based on their record. Sorry.

Yha the got me good i started. Get ssi in 2011 it was all good i got the maxs. I was married. The my wife filled for her ssa she got 900.00 the drop my ssi benefit to 257.11 that not right no one can. Pay my own bills i have medical meds i pay my rent on my land it 250.00 a mouth my check. Gone nothing left the my wife stuck pay everything. Else. It takes everything. She has all the house bills taxes on everything. Nothing lift to live on. If the say it a good American it not at all the think it 1950s pay for the mouth. Government. Need see how people. Can live on ssi if you married. That why i can't. Have max check. Ssi sucks ass i go back to work make more then that one day sense icome down bad copd i not worth anything. In out of the hospital year around

Okay, I was married 11 years to my 1st husband, divorced, married twice after that. Divorced both my 2nd & 3 husband, does that mean I can't collect from my 1st husband? How does this work? I have an SSI appt. today at 1:00 pm about this. I thought because I've been divorced and single since 2001, I was able to claim on my 1st husband. Now, sitting here confused. Thanks for the info!!!

Sounds like you would still qualify for benefits on your first spouse since it was over 10 years and you are not currently married.

She also told me that I could have been getting this since I turned 60. I say, better late then never! Thank-the Lord I'm getting it!! Thanks so much, I'm also going to share this video with all my social networks. I'll be back to hear you, love staying ABREST of things, hahaha....Right!!I could have been getting that at 60!! Hahaha! Have an awesome evening!!!!
