I think I actually had a judge help me from the bench get a ticket dismissed for "jurisdiction". She noticed the cop forgot to fill in the County on the ticket. After the Crown got up and said their thing the judge said "I assume he's here to have this ticket dismissed due to material defect" and looked over and smiled at me. I laughed and said "Yep". I guess I'm a SovCit now.

I love that the judge decides to make him sit down and wait for all the other cases to plead before him. They shouldn’t have to be delayed by a jerk-off who is in love with the sound of his own voice. If my memory isn’t getting this mixed up with another case, I think a wonderful woman (from the prosecution side possibly) steps in to give him some sound advice and that he later entered a plea. He started all gangsta but ended up more whimpering child. He seemed genuinely surprised that his Perry Mason-style gotcha loophole didn’t work as well as in a Perry Mason episode. I suspect that the judge’s withering take-down of the big traffic ticket case as not measuring up to murders may well have deflated his supporters as well. Reality is something they hadn’t taken into account as they plotted his get-out-of-jail-free legal brilliance.

Exactly. He’s following the Mark Stevens script. Stevens doesn’t understand that the citation is prima facia proof of jurisdiction unless the defendant provides proof that jurisdiction does not exist during the trial. The onus is on the defendant, not the judge, not the prosecutor.

The defendant starts off being snide by asking, “was that a yes or no?” when the judge tells him his options. This is so typical of Sovs trying to control the climate and feel in the courtroom. The more they feel they control the atmosphere, the more justified they feel in their horseshit. I understand giving folks their day in court and entertaining their crap to some degree, but Sovs need to be steamrolled over to prevent them from deriving any sense of victory, thus continuing this garbage. Man, the judge just “kicks him in the nuts” from a legal standpoint. Beautifully done.

All of this for a traffic ticket! It was nice of the judge to provide him with the first year class of law school, and the information conveyed in the first hour of the trial practice class. The court address is located on the back of the citation. Therefor jurisdiction is established. He (The Defendant) answered his own question of jurisdiction, when he arrived at the correct courthouse, went to the appropriate judicial department that will hear his case, on the correct date, at the correct time. Jurisdiction Established!
