To be too fair to him, his claims of ignorance would more accurately be described as disagreements with the premises underpinning the questions posed. e.g. "do you understand that not using an attorney may well decrease your chance of obtaining a favourable judgement in your trial?". "No, I have won every case ever when I represemted myself (no you didn't. Don't lie) and lost every case when an attorney represented me (that's more likely but besides the point)". Come to think of it, the judge could well interpret that statement to be so delusional that an attorney will be forced upon him. Hmmm

Pro se defendants should be held to the same standards as licensed attorneys for contempt. If they are competent enough to represent themselves they should be familiar with court procedures.
@luxonlex44533 жыл бұрын
I half way agree with that. Each court has their own rules for discovery, pleadings, motions, sanctions, responses, et.al. that are all based upon time. 15 days to file this, 10 days to file a response, 26 days to file something else. All of which are described in the court rules. Then there is the application of law to fact and jury instructions if the matter goes to trial. There are many nuances to properly defending an act or occurrence that the layperson may be unaware of and thus jeopardize their own case. This is why a judge will strenuously suggest obtaining some type of representation from a licensed attorney. So, if someone is foolish enough to attempt to self represent, I do not think it would be wrong for the court to help them a little along the way. Statring first, with the mental evaluation of the defendant, not as a joke, moreover to see if they are mentally cognizant of the repercussions of their In Pro Per / Per Se appearance and representation. Every attorney knows better than to challenge the courts jurisdiction and authority over a matter being heard. However, this Private Attorney General, is completely unaware of the Cringe Level he is producing by asking if the judge has an oath on file. That is why the judge allowed the question and responded. However, thereafter the defendant was basically asking the judge to "Represent" him and his civil interests. Another Fo Paw, yet it was answered by indicating that he would do his best to ensure his civil rights. So, yes the judge could have stated that if he wants to play with the big kids, he is going to be held to the exact same BAR level standards. Instead, the judge humored the defendant and chose mercy regarding court dictum, over showing the defendant the gallows. Very well done on the part of His Honor. The court does have a "Heart" if we choose to look for it.

A lot has been said (and rightly so) about the business sovcits give the auto glass industry. What about notaries? "So, you have 36 pages of nonsense and you want me to sign each one? $25 a pop... let's do it!"
@firebird65223 жыл бұрын
Most banks will offer notary public services for free to their customers. But, of course, I'm sure these sovcits don't trust banks, figuring they report all transactions to the federal government for taxes. So yeah, these dopes probably pay full price! LOL!
@lance37483 жыл бұрын
A notary is essentially someone who witnesses you sign a document then they put their seal on it. - They are NOT responsible for the content, accuracy of the content, possible effects of the document, etc. I had my martian birth certificate notarized but for some reason the judge still thinks I'm an earthling.

the case he was being extradited on he got convicted in Georgia, sentenced to 6 years, and another 15 years in a grand theft case, and after that he gets to do 20 in the federal system for "fraudulently obtaining" 230k from 112 victims (he ran a "mortgage debt reduction scheme to distressed homeowners, who were mostly non-native English speakers" to quote the prosecutor).

I love when they try the person argument, like "I am separating myself from my person." In this guy's case somehow this entity in Hawaii is not the same as the entity in Georgia. Does the entity in Hawaii have fingerprints that are essentially identical to the entity in Georgia? If so isn't it likely both entities represent the same body? I don't know if Georgia cares about his person and/or entity but I'm sure they want to lock up his body. If his entity can get back to Hawaii while his body stays in a Georgia prison I don't think anyone will care.

When I enlisted in the Army, I raised my hand and swore an oath to uphold and defend the Constitution. After that, I was never asked by my leadership if I was under my oath for any particular day. Why? Because it was painfully obvious that I was ALWAYS under my oath and such an asinine question did not need to be asked! Likewise, any law enforcement officer, judge, or court official, who swore an oath, is ALWAYS under that oath. Yes, you can assume that the judge is under his oath that day, just he was yesterday and will be tomorrow! It is always valid to assume that the judge is under his oath The same goes for jurisdiction.
