This is actually termed “innocent passage” any warship in the world can do it. As long as they aren’t detaining ships or “operating” in the waters it is perfectly legal. The Gibraltar squadron simply shadows and doesn’t have the legal authority to intercept.

It's definitely a cause of high tension if you randomly unplanned warship approaching as you can never know the intention of the warship. I personally wouldn't call it an act of war unless they conducted a dangerous manoeuvre or could be seen aligning themselves for an attack or ignoring radio or other communication types.

The only legal basis for the UK's permanence in Gibraltar and the maintenance of that colony is the Treaty of Utrecht. And the Treaty says very clearly that the colony has no territorial waters beyond the port. You can repeat a lie many times, but it will not become the truth.

@@BigBazz-Clips The settlers who currently live in Gibraltar are not legal subjects in this matter, and the Treaty is very clear (too) in this point (not forgetting that the real Gibraltarians live in San Roque). Nobody in Spain wants to give a Spanish passport to the llanitos, they can have whatever nationality they want, since the controversy is about the territory, not about the people.
