The plaintiff hired the defendant to fix her toilet. Unfortunately, the plaintiff claims the defendant flooded the bathroom and ruined the ceiling below, so she’s suing for a refund. The defendant insists he offered a rebate for the repairs, but the plaintiff refused and never provided him with an estimate.

@@stevenp25100 pretty much every licensed contractor of any kind hires workers to do the work under their license and training and its very common for licensed contractors to send their workers to do the actual work and its perfectly legal too so your comment shows that u dont know too much about how most contractors work .

Licensed plumber here… you DO have to have a license to pull a toilet, because pulling a toilet breaks a seal and exposes the place to toxic sewer gasses.

If your pipes are blocked 3 times in 4 years, do not call the same company again, get someone who's got a camera they can put down the pipe, identify if there's grease, a broken pipe, roots, whatever, and have it taken care of properly. It's so difficult to live in a home where your sewage lines back up yearly.

My line to the sewer has roots come through and every summer I have a company grind them out for under $300. To permanently fix the pipe is $16,000-$18,000. I have no idea how long Ill have this house but I think Ill let the next owner handle this one.

@@shabless81Hope you disclose that when sell it. If you do, it will probably be a concession to them anyway. If you don’t and they find evidence of the historical and undisclosed issue, you’ll probably end up paying for it. In other words, either way you probably pay for it in some manner.

This is the way the big name plumbing franchises work: a few licensed guys and some techs. Licensed guys sign off on the work the techs do. Perfectly legit. She should've fixed it right the first time instead of doing the same thing 3 times in 4 years and she'd have saved money.

Yet somehow I (luckily!) never see the real names in the comments, so it works. I guess it is mainly to prevent random people from looking them up and finding where they live, just for fun. Or on the other hand: prevent future employers to find them in a court case about who knows what, even decades later. And then again: how would I know why they choose that option? I’m just guessing and making assumptions….LOL.

This woman wants not only the supposed up-charge back, she wants the whole cost back. And she hasn't even mentioned the tile damage as a factor. So what part of what they did does she think they deserve to be paid for? Nothing, apparently. Isn't that what some people do in restaurants? Complain that they want their entire meal comped because the food was so bad they almost couldn't finish it?

She doesn't get it. She wasn't being told to pay them then not have the work done then pay someone else... the point, grumpy lady, is you approved the cost. BEFORE that was when you could've hired someone else. How do you make it to that age and not understand really, really simple things...

@@raizinboyz It’s as the judge said, the lady wants to pay them for the results she wanted. But if they performed the cheaper service (which who wouldn’t want the cheaper cost) and they are unable to reach the desired result, they still deserve to get paid for the service they provided. It’s not like they were just standing around doing nothing. They used tools, they spent time there, and she agreed to all of the work that was done. Her problem was that she did not want to pay them because they didn’t resolve the issue to how she desired it to be. Then to look for another company to charge her the same price or more, and all because she wanted the cheaper option rather than the middle cost to actually get a more desirable result. I hope this helps to clarify the situation.

Funny story. I had a plumbing company come out to unclog my drain line. It was an after-hour call and I can't stress enough the emergency of having the line cleared. It cost me $2K once everything was said and done. Then that company reaches out to me to inform me about a potential danger of that line failing. They ran a camera through it once it was done, and found a couple compromising spots in the pipe. They quoted me $9K to install a sleeve in the drain line. What this company was not aware of is that my day job is working in Building Maintenance in a highrise officer building. I contacted the company I used for work. They do new construction and they don't make after-hours calls. When I told my contact person the price he started laughing; he said and I quote. We can get a couple of guys to dig up the old pipe and replace it with a new one for half the price. And once I sent him the video of the pipe; he said to treat it twice a year with root killer and I'll be good. I don't trust plumbers and I do 80% of the plumbing issues at my homes (I also rent properties).

The judge made the best point that the plaintiff is choosing to hold the belief that what she paid for was a 'job to be completed' instead of from the plumber's perspective of 'work was done.' The plumbers are not clairvoyant and will not know the problem until they investigate. Until she changes her perspective, which she probably never will, she will be stuck in her narrow viewpoint. One thing's for sure, even the plaintiff's pipes became tired of her crap, and cleaning them out was long overdue.

My husband isn't a plumber. But he pulls our toilet. Lady you wanted it fixed it got fixed you just don't want to pay. They told you. You agreed. Next time don't make any call for a plumber. Fix it yourself. No extra charge. Lady at your age you should no by now life isn't fair all the time. And if she knew he wasn't a plumber . She should have sent him on his way. She was hoping for a freebie.

@@jennifermarlow. I get the feeling when you hear “snake” you’re thinking a little $2 drain snake? This was a sewage main potential 50-100+ feet down the pipes you’re talking a multiple thousand dollar machine to “snake” it.

@@jennifermarlow. I've done that twice. Bought a 50-foot snake & it works like a charm. But I know what the problem is---the plumbing pipes are in a narrow "T" under the house, and that "T" joint can get blocked. Thanks crappy builders! (Edit: It's funny, it only got blocked when teenagers were in the house lol)

This plaintiff is completely unreasonable. She knew exactly how much the job was going to cost. Also, she is saying the defendant is not licensed in her state. She should have researched that and never hired him to begin with if she was so concerned over it. The incompetence of some people.

I don't think the company is unlicensed but they sent out an apprentice to go to the job- who was unlicensed. It was the employee that was unlicensed not the entire company.

The defendant said that he is a an apprentice and apprentices can do certain work that they themselves may not have the license to do with the oversight of a their licensed boss. Since his boss is a licensed master plumber, then the apprentice then the apprentice is allowed to do things he may not have the license to do yet.

I’m not licensed. I’ve changed my toilet twice. Just make sure you buy a seal or two and get the bolt holes to line up.

If she needed a plumber three times in four years she either needs to use less toilet paper or get the real reason for the blockage fixed, its clearly an ongoing issue, you shouldn't need a plumber that often to unblock a drain if its working properly.

9:10 He lost me here. A few weeks ago I had my toilet pulled and the line cabled. It cost me $450.00 total for the work. That's a scam $400.00 to pull a toilet are they kidding me. It takes 15 mins to pull a toilet and 15 mins to reinstall it, plus $5.00 for the wax ring. SMH!!! Just another scamming plumbing company!

Plumbers charge good money , by the hour , and don’t guarantee results . She agreed to hire and pay them - then you got to pay. $350 to take a toilet off - find a relative/ friend that is strongman , watch KZbin and pull the toilet off . You’ll have to buy a wax ring or similar putting it back . Cost $2 to $5 for the ring . For unclogging the drain, buy a power snake , or a snake that will hook up to a drill. Run the thing for many many minutes - and run it out long back and forth. Keep running it for a long time after the clog is cleared. As it spins the middle of the cable curves scraping the pipe walls . That will work better than jetting. Keep in mind, you’ll run into a t , one going to the roof vent, the other down. Try snaking at other locations, like the bottom up, or the roof. Another option is to look for and hire a fixed price drain cleaner - not a $$$$ plumber. I’ve seen advertisements - any drain $79 .

I will say, though, that seating a toilet is not easy. My hubby is VERY handy and does most everything around the house and with our cars. He has seated several toilets and struggles to get it right each time. It can be done, but certainly better with a professional.

The judge often misses this important point. True - a contract is a contract - but it is implied that the work will be done in a professional manner. It is imperative that a plumbing company have tools (and ladders) that can do the job. Any plumber that comes to a house with a 4 foot ladder, does not deserve to be paid.

That lady is such a pain and dishonest. I'm sure if the paid the $750 for all the work done she wouldn't care about any license. She should change all that old piping so she don't have that problem anymore or be careful what you flush.

The Plaintiff needs to look up the definition of the word "scope creep". I get this all the time...I estimate one price, then I end up having to do more work than originally anticipated, yet people still want to pay what the original estimate was. I bet these guys run into that problem all the time, this is why they have that form for people to sign off on.

I hear you. And you should be paid for what you do. As a consumer/customer though, it is hard to swallow an end price that is double or triple the quoted price. I think one way to help is to communicate clearly in writing and verbally. In writing spell out what I'm getting for the quoted price. And then as soon as you see it is going to go beyond that, write out what and why of the new price.

I have worked for people like this more times I can count as a plumber. I am sorry ma’am but the line in full of baby wipes and tampons that is why I have to quote you more. Then have the nerve to say I don’t flush any of those things down the toilet. The other great one is cooking grease and coffee grinds and as well.

As I have learned over the years of only a home that not all plumbers are created equal some or journeyman some our apprentice, and then even some journeyman plumbers are not very experienced. They simply have enough hours so when you hire a plumber, make sure you do your homework and see if they have any complaints, as with any contractor, you must look look at their reviews

I'm not a plumber, but I can't see how jetting down the toilet stack wouldn't cause the same problem in the bathtub that using a plunger in the toilet would.

Bullcrap. He could of run the cable up a ladder. Ive done it many times for a roof vent. They might not know how to to it. Hire a retired plumber.

The concept of your drain going from the basement all the way through the roof baffles most people. They think of it as only going down. Lets sewer gas out and keeps all the drains working properly… helps prevent gurgling and stuff like that.

I don’t get it. I would have run 50 ft snake down the toilet. If that didn’t work I would have run it both ways at the clean out. Google it like everyone else. Or pay the plumber🤷‍♀️

If she is blocking up the toilet 3 times in 4 years, she needs to stop throwing, whatever it is she is throwing, down the toilet, probably babywipes, cotton wool or kleenex, so she is lucky they were able to unblock her toilet at all...

5:00 I have issues at this point. The judge was right when she said the price goes up with every failed attempt made by that plumbing company. I had work done at my home that required jetting the line. For all of you that don't know jetting is a 3/4" hose with a special high-pressure head on it. It’s attracted to a pressure washer and fed into the drain line. The whole process normally takes less than an hour. Why they charge over $1000.00 for that service I will never know. I once had a toilet issue that I couldn't figure out why it was plugging up. It wasn't the drain line, it was the toilet. The plumber came out and remove the toilet and took every step I did to tell me I should replace the toilet. That was a $500.00 bill. I did replace the toilet. I took the old toilet and broke it to find the scale at the bottom of the S curve.
