If your medical records indicate that you have spinal stenosis in your spine, and you have symptoms such as pain, numbness, pins & needles sensation, and weakness, you most likely have a strong claim for Social Security disability.
As I discuss in this video, spinal stenosis means that there is an abnormal narrowing of your spinal canal. This can be caused by arthritis, bone spurs, injuries or just aging. Stenosis can also occur in the cervical (neck) spine, thoracic (mid-back) spine, or lumbar (low back) spine.
Often, surgery may be recommended, but, remember that Social Security cannot deny benefits to you if you choose not to undergo surgery, even if that surgery would likely correct the problem. This is because every back or neck surgery carries with it the risk of death or paralysis.
Often disability claimants who are not candidates for surgery or who are not willing to take the risk of back surgery end up in long term pain management, and generally disability judges will conclude that such a person could not reliably perform work because of the side effects of pain medications.

I was diagnosed with spinal stenosis about 7 years ago & in a wheel chair. I could not walk, stand or sit for more than a few minutes. The pain was in my buttocks & all the way down my legs. My son did some research on the condition & found that people who used an inversion table got good relief. I got one & started going on it twice a day. Within 3 months I was able to walk without the wheelchair. Now, I go on the table once a month for 10 minutes & it keeps the spinal stenosis under control. If you have spinal stenosis, get yourself an inversion table & use it every day until the pain goes away. I guarantee it.

The criteria that I have read states that you have to either use a wheelchair or walk with two crutches, in order to gain disability for spinal stenosis. When I was in the army, I was diagnosed with severe spinal stenosis as well as severe multi-level degenerative disc disease. I was 29 at the time, and the physicians told me degenerative disc disease is common in most people however, they told me that my case was pretty bad and that my degeneration represented the spine of an 80 year old. I am mainly curious about the stipulations about having to be in a wheelchair or on two crutches.

This was one of the diagnosis with my adult son after months of being admitted to a local hospital here on Guam from a visiting neurologist from Hawaii. Apparently when my son fell ill with severe back pains and comatose from bilateral pneumonia, he awoke a month later and was unable to move his extremities. He was finally diagnosed after me constantly pleading to his hospital doctor to find out why he can't move. Apparently, when my son complained about back pains they (the ER doctor) attributed this pain to bilateral pneumonia. He soon fell in a coma. His spinal cord became inflamed and impinged itself in his T6 because of spinal stenosis. My son had worked 14 years before this occurred. Unfortunately, the people here at Social Security says *he cannot receive Social Security Disability benefits because he lives on Guam* , even though, he has contributed to SS through his employments. I was taken aback by this info. Though he receives regular Social Security (because he is bedridden and paralyzed) this barely makes ends meet in as far as him living in his own home. I had him move in with me, I quit my job to be his full time caregiver and Mother. I'm disabled myself, with bone spurs, osteomyelitis, arthritis and recovering from suffered a recent stroke. Trying to care for my son and myself staying at home most of the time, especially with the COVID-19 pandemic. To say this is very hard, would be an understatement and yet we're not awarded Social Security Disability benefits all because we live on Guam. What are your thoughts on this?

Thank you for explaining in depth but simple enough to understand! This really helped me & actually made me tear up just watching it because I'm suffering & can relate.. I've dealt with Sciatica pain on & off for about 18 years now (I'm 36) & I've been able to manage. Today I just got an MRI today that shows " L4-L5 Disc Degeneration, Annular Degeneration with disc bulge resulting in mild central stenosis. Posterior midline annular tear. L5-S1 Annular Degeneration with paracentral left small disc protrusion with associated annular tear resulting in minimal lateral recess effacement." I was told in the past that this is mild & I'm too young that it couldn't be that bad. However, my pain has been very debilitating, especially after giving birth almost 3 years ago. I can tolerate a lot of pain but this is one of the worst I've experienced, and since I have a "mild" case, I don't look forward to when it gets worse. I feel bad for who suffer worse than I. I couldn't imagine it being any worse so this is just sitting on my heart dreadfully heavy.
@ssdattorney
@ssdattorney 2 жыл бұрын
I think sometimes there can be a disconnect between what appears on an MRI (mild stenosis, disc bulge) and the level of pain that you actually experience. I think that you are correct- at 36 you would have an uphill battle for SSD.
@bengt_axle

Work on your flexibility, especially hamstrings, quads, lower back. If you don't have good flexibility and core strength, your symptoms will only get worse, leading to a series of surgeries at a young age. I was in a very similar situation at your age, got some surgeries and the one thing I would have done differently is put more emphasis on flexibility and stress reduction and putting off surgery. Also, for a diagnosis of what your problem is, it should be made based on a physical exam. Imaging is to confirm the diagnosis. If the clinician is not doing an exam and only looking at the image report to find annular tears etc. find someone else. Images showing degenerative changes don't mean much if they are not corroborated with motor, reflex and sensory evaluation.

I’ve had that and just had my 2nd fusion. It’s been months and I still can’t stand too long , walk too far, or drive too far. I’m limited with sitting for 20-30 minutes before I need to lay down. I need to find a job as a bed tester. I’ll be 62 in 5 months, I’ve been out of work for 12 months. Goodness, I made great money as a physician assistant for 24 years, I blew through my savings with the 30 PT appointments, the copays for surgeon, pain management, COBRA, etc.. I ended up with an ulcer and gastritis taking NSAIDS for pain. I don’t wish this pain on anybody.

Is foraminal stenosis considered spinal stenosis under ssa listing 1.04. I have been unable to find case law where this distinction has been made. My bilateral foraminal stenosis and radiculopathy is directly attributed to DDD and DDD IS under ssa 1.04. with stenosis being secondary to DDD. The foraminal encroachment has completely pinched the associated nerve. Is this considered compromise of a nerve root considering that the encroachment is not in the central canal or the cauda equina?

The last 2 (Sacrum and Coccyx don't really count as they are mostly fused bones around the pelvic bones). You have the same as I (Cervical Spinal Stenosis). This is a very informative video. I just had an MRI completed, and I was diagnosed with spinal stenosis. It maybe the worst pain I have ever had in my life. I cannot walk for more than 10 minutes, I cannot sit for more than 10 minutes, I cannot sleep throughout the night, I get numbness in my left leg, numbness in my fingers on my left hand, numbness from my right hand all the way to my forearm, I also developed excruciating pain on both my bottom feet from the sciatica pain, and my left glute has the deepest joint muscle and nerve pain I have ever had in my life. I am considering applying for disability because there is no way in heck I can work anywhere with this pain. I have been dealing with this pain for roughly 12 years. I always thought it was my hamstring causing my back issues until one day I was helping my wife with chores around the house and my back completely went out. I fell to the floor, and I had to have help getting up. We went to the emergency room, and they gave me an injection along with a prescription for pain. I am at a complete loss because I want to work, but who the heck will hire me if I need frequent breaks to accommodate the pain from my nerves, legs, and spine.

@@ssdattorney I am 45, and I have more medical testing to get done this summer. My doctor referred me to a rheumatologist, and a dermatologist. I was completely fine dealing with my arthritic hip and pain in my back for years. But since my MRI, my spinal stenosis worsened the arthritis in my hip and leg. I have a very rare autoimmune disease which has led to several health issues, and the dermatologist will test for psoriatic arthritis. Basically the Dr's are testing for osteoarthritis and psoriatic arthritis, either way the pain and swelling is in my joints from my hands, elbows, back, knees, shoulders, and legs. At the most, I can handle 15 minute walks with my dog and my kids now and before it was 10 minutes of tolerance. I really don't see a company hiring me for 15 minutes of hard work just to allow me to take 30 minutes to ice and decompress my spine for pain relief. My wife is a registered nurse, and she has been a great person in my corner in helping me deal with doctors and coping with the pain. I am also in physical therapy, and it helps somewhat but maybe for 30 minutes to an hour of relief. Again, your videos have been very informative and thanks for the reply.

hello and thank you for this video. Have there been any recent changes for Spinal Stenosis? Any new videos. Please send me link. I am thinking of getting a lawyer in the Houston area for my condition. I've had Spinal Stenosis diagnosed since 2016. I had to operate my cervical since it was pinching my arm. Now I have a bone spur that really Hurts and my entire spine hurts. Sometimes it feels like it's on fire. Sometimes it's just a deep pain on my lower spine. I also have osteoarthritis. My Spine doctor says that operation will not help right now unless it's to try to remove the spur but that it is extremely dangerous.

Nothing new. Listing 1.04 would apply - www.ssa.gov/disability/professionals/bluebook/1.00-Musculoskeletal-Adult.htm#1_04. Note that having a diagnosis of stenosis does not make you disabled - SSA will focus on specific issues regarding your functioning that arise from the stenosis. This can include pain that interferes with attention and concentration, numbness that impacts your use of a limb, weakness and loss of strength in your legs, etc.

I’m 71 was diagnosed last year 2022 with degenerative disk disease, two bulging disks and spinal stenosis. On pain meds for back and leg pain and started epidural shots. They help for about 3 months so that’s great. Being on social security already I’m told I can’t receive disability, to old. That I already receive my limit of what I can get monthly. Am I considered disabled and can I receive more for being disabled then what I’m currently receiving? Not in wheelchair but use walker and cane. Hope you can give me an answer so I can maybe find out more about my situation. 👍🏻

I could not sit, walk, stand straight, extreme pain, muscle spasms, sciatica, very difficult to turn in bed, only able to sleep 4 hours due to pain. After surgery, I still can't sit for more than 5 minutes, I can walk slowly with instability, I can fall if someone bumps me, I have hard time sleeping and turning. My legs and feet are numb 😭 I hope I can recover so I can walk and work without pain. I really don't want to be disabled and claim disability at age 34 😭😭😭 Please God help us all 🙏

Hello Mr. Ginsberg. I had an MRI done and the radiologist stated the following: Indication spinal stenosis pain radiculopathy. C5-6 demonstrates moderate diffuse hard disc/osteophyte complex moderatley encroaching upon thecal sac as well as both neural foramina. C6-7 demonstrates a clinically significant central and right sided acute herniation which obliterates the right neural foramen and moderately encroaches upon thecal sac. Carpel tunnel release in both hands but now have recurrent carpel tunnel. An 54. They are in medical review. There are over 600 pages of records including MRI and CT scans. I am expecting a denial just because it seems thats what they do. I cant sit still. Always have to shift because of the pain. I also have straightening on the normal lordosis. The pain is so horrible. Medication is not touching the pain. The numbness and tingling radiates continuously and the weakness is getting worse. I have difficulty with holding my head in certain positions and frequent headaches. What do you think my odds of approval are?

I just want you to know that you need to be under a doctor's care and doing whatever he suggests. You also must not give any indication that you can work. You must be disabled. I got mine with my first application. I had both cervical and lumbar issues along with knee issues and peripheral neuropathy in my right foot. I had current MRI's and had been under a doctor's care for many years and had gone to a pain clinic. I never even had a lawyer or appeared before a judge and I had my first check within 3 months. I had to get help throught the Dept. of Health & Social Services..my house burned down, I was living in a cheap motel with my son, no money, could not work, and I had broken my right foot in the fire. If you have a lot of current and ongoing medical documentation and you can not work then I think you will get SSDI. good luck..hope this helps.

I would read that report as documenting a mild level of spinal injury. If I saw a report like that I would want opinion evidence from the treating doctor which supports your allegations of severe pain. Generally speaking a judge would need to be convinced that this relatively minor level of impairment as shown on the MRI can result in disabling pain.

@Marley Every doctor I go to says I am wise to not have surgery on my back and neck. The only ones who want you to have surgery are the back doctors..that is their bread and butter.

Psoriatic arthritis, and osteo arthritis for at least 30 years and I worked extremely hard jobs through that pain Doctor notes and x-rays of all my joints showdegenerative disc, can't remember if it uses the word stenosis butt joint space narrowing and bone spurring in many of my joints, the nail in my coffin was my fourth compression fracture which happened bending over in bed as I kind of lunch to the floor to get my phone that I couldn't quite reach. I had to be wheelchaired into the hospital the next morning. 30 years of medical records over 2 in thick. Severe carpal tunnel, tendonitis, melanoma, near gangrenous gallbladder, suicide attempt once many years ago associated to severe back injury and loss of job, now shoulder pain with numbness going down my arm, likely because my neck is so bad.........I'm in the beginning stages and my info has been sent to the determination office...... And then shuffled off to another determination office in another state because of the back load........ I've worked three jobs 7 days a week in the past, I'm no stranger to continuous hard work, and it pisses me off that I just can't get anything done especially around my house and property......... If they deny me the first time then I'm going to know something's wrong with this system.....

Something IS wrong with the SSD system. However, to improve your chances at winning, I would suggest that you look at the musculoskeletal listings (www.ssa.gov/disability/professionals/bluebook/1.00-Musculoskeletal-Adult.htm) and point out to SSA which ones likely apply. Then ask your doctor to write a letter on your behalf explaining why you meet one or more listings.

That depends on whether you have medical impairments that prevent you from working. A surgical order is not the question - work limitations are.

Spinal stenosis..bulging discs...Damaged SIs.. S1 nerve damaged. Thoracic stenosis with multiple bulging discs and bone spurs. severe arthritis in the whole spine. Migraine headaches I take injections for. was diagnosed with severe Fibro and lupus. I get SI injections about every 6 months and injection to the neck areas. Also have been diagnosed with all and had my hearing February 1 and still waiting for a decision. Vocational Witness said at the end no jobs and judge thanked me for making to the hearing and then apologized it took so long to get to this point and hopes I find on going and better treatment to help me be comfortable and more happy. And ended the hearing. Don't know what to think...

Based on what you say, it sounds positive to me. You have objective medical problems (the discs) which is always a positive for judges. Hope it turns out well for you.

@Top Tv News طوب تيفي نيوز because I'm under 50 years old and the government only wants to help drug users. Judge also had a problem with me not being on pain pills. I don't do drugs.... And I also felt like I was in criminal court. Hard chairs and small room that smelled bad.. Disabled people shouldn't have to feel like a criminal... Now I'm 46 and have no help or income. I lost insurance and cant go to doctor anymore eaither.. Thanks America.. This is what I get for paying taxes... Wow

@@heymancollectables2286 Oh I am so sorry to read this. I am the exact opposite. I have been taking only pain pills for 15 years. I refuse everything they offer me..no epidurals or nerve ablation. I have done all I am going to do. You feel like they just want to offer something and it only works for a short time. Go to your State Dept. of health & social services with your medical records and a letter from your doctor saying you can not work. You can get medical insurance and temporary help. Go to a doctor and get a prescription for pain medication. If you do not take them well...your choice. I am not into suffering myself. Then you file again. You have to keep seeing a doctor. Are you back working at all>/?

man i was really hoping after seeing this video that you guys would take my case up with a federal appeal. you talk about representing people on a federal level, but when i called the woman said they dont take up federal appeals. then let me know the number wasnt even associated with your firm. why would you post this media and then not help folks like you claim to? :/ thought i had found a good lawyer that could help and i couldnt even make it to your office on the phone. can you guys not do streaming tv court or something for someone in north east arkansas? 10 minutes below mo and no far from the east border?

I have Lumbar stenosis with neurogenic claudication and Lumbar radiculopathy .And I am only 44 years old ? Can i get sociall security disability?, i just got my second epidural 1 week ago and it seem like it does not work . My pain management will send me back to my surgeon and I may. Have to get surgery. I have to use a walker to walk . Both leg weak and both arms weak , l4/L5 is narrow , C5/C6 is nerve pinch . So it the same issue . I did neck therapy nothing help , I did spine therapy nothing is help .

Your age will be a factor. If you were 56 I'd say you have a very strong argument. At 44 you are going to need very strong support from your doctor in the form of an explanation of the practical issues that arise from your condition.

I have three herniated discs from C3-C6, as well as borderline central stenosis in C6. Discs L1-S1 are all herniated. L3-L4 moderate central stenosis, L4-L5/L5-S1 have severe central stenosis. I'm only 25. Would my MRI findings make a good case? Or will my age play most of the factor in the outcome? Which would be completely unfair as I cannot stand or sit long. Bending and lifting also aggravate the situation. It's very debilitating, regardless of being young.
