Here in Florida Governor Ron DeSantis has signed a law that any squatters caught squatting in anyone’s home all the home owner has to do is call the Sheriffs office and they’ll throw the squatters out immediately and they go to jail for trespassing . It’s the law here.

My neighbor has a rental property just south of mine and across the street from her home. Two and a half years ago she was out in the yard and someone (NGO?) stopped and wanted to know about the "abandoned" place across the street. She informed them that it was her rental property and it was not abandoned. They were pretty adamant that if it wasn't rented it must be abandoned. She again informed them that it was her property. They went away but we kept a close eye and she's now rented it.

Get a locked mail box. Squatters try to get mail delivered to a house before they even break in. That way, they show the police that they live there because they receive their mail at the address. Also, make sure the home looks occupied by using timers on lights, hire someone to maintain the yard and make sure neighbors know that no one should be in the house.

These vacant homes are primarily owned by banks. If they sold them shortly after taking ownership this problem can be solved. I had one in my neighborhood that is still vacant, owned by wells fargo, been vacant for over 2yrs! Legislation makes it easier for a squatter than for a buyer.

When it happens to the corpos, they just hire security to throw all their stuff out on the street and change the locks. Corpos have lawyers on retainer for these things and make the "tenant" fight them on their time and dime if they want back in. Meanwhile some mom and pop type found squaters in her rental property in nyc and they murdered her when she went to do some renos on the property.

There’s also rental scams. A scammer pretends to be the home owner, has the person sign a fake lease, pay first/last month’s rent and then move in. This person appears to be a squatter showing their lease, but could actually be a scamming victim. If police quickly remove this person, they’d be homeless - adding insult to injury. So, instead of quickly removing them, I think giving them notice to leave would be better, in case this is a scamming victim who needs some time to find a new home.

I don’t like squatters but I cannot help to think that we live in a country where they make it difficult to get even an apartment. I live in California and here you need to have at least 600 credit score and above, make 3 times the rent (including first and last months rent and deposit to move in), and background checks too. So how in the world can someone get all of that, with Covid, inflation, and the constant Electricity issues here. No it’s not just Enron, still with PG&E now we had so many issues with electricity. How can anyone live with all these conditions?

And you say offhandedly that most squatters are ‘career squatters’-is that a claim backed by research, or just opinion/impression? If the former, does that mean that new squatters are also becoming ‘career’? Is there a relationship between career squatting, unemployment/underemployment, wages-relative-inflation, wages-relative-to-housing, and the housing market? The original laws trace back to a time where information is hard to get. property could stay abandoned for years to even decades. And most of the country was undeveloped wildland where especially in the rush eras people would just vanish without a trace. As a traveller you may endup having to abandon your journey or your jsut move into an area and there is nowhere you can purchase except there is a old farmhouse that clearly hasnt been lived in for a decade at least. so you move it. Most people who pass by dont question it, eventually you build up the lot. Then sometime years later a surveyor comes in to audit and finds out that the property your not on is not under any documentation. You can fight that and by right and proof of what you have done clearly show that the property was unowned and you already invested years into it. So since the previous owner either is dead, left, or just forgot about it for years You are the new owner of it.

But the issue is the New versions of the law were revised to mear 30 days in New York a case 30 days is not abandoned it's not even that long and could be a simple case of the owner left on vacation, was deployed by the Military, or is literally being set for sale by the previous or inherited owner. And shame on you, owner, for having business that left you unable to occupy or visit the location in that month. The law was shortened due to bleeding hearts as a signal of virtue and the obvious abuse is now happeneing

About Tricon, what sort of penalties were they given? I would expect a homeowner victimized by these scams to be eligible for potentially treble damages. The damages would include ALL related costs even court fees, attorney fees and costs even money spent on transportation to a court house whether it be bus fare or cost of their own personal transportation and ALL parking fees and fines that may have been accrued during parking or driving since some cities are a huge pain to park in

I was wondering if the squatting lately was being driven by the large investor groups. Just wait for the owner to give up and sell and swoop in. Kind of like what owners of buildings in some cities did decades ago to drive out tenants so they could then sell the units as condos. Just annoy the heck out of them until they leave. I have been watching someone like mentioned, who goes in and squats on the squatters. Reclaims the house for the owner by doing to the squatters, what they did to the owner. Love it!!

Florida just passed a new law that made it harder imagined. It took like a few strokes of a pen to do that. They can change what they want to change in a matter of moments if they wanted to the government

FYI. Ohio Property Owner w/ clear title, no loan, here. Paperwork in hand and available online from the govt. Website. Attempted to kick in a barricaded entrance door to remove "squatter". Squatter called 911, I was arrested and jailed for "Aggravated Menacing". Squatter was left in residence.

I think the laws need to be much stricter on squatters - minimum 25 year prison sentencing with hard labor.

There are a lot of people talking about squatter's rights issues. Bear in mind that these rights can be habdy in certain circumstances, and they shouldn't be outright removed. They can protect people from sysyemic abuse coming from the asset holder's position. It is important to consider why such rights exist to begin with before allowing them to be dismantled.

I think its hilarious and should happen more. Here is why. RENTAL HOUSES / Airbnb RUIN neighborhoods! In my moms neighborhood there is an investment company owned house that was rented to a bunch of drug dealers and it ruined her neighborhood. They and then squatters moved into that one and keep trying to live in the drug house. It was such a nice neighborhood when it was OWNERS and not LLC's tryng to by mini land moguls. The only ones that could afford these houses in the last few years were companies because it would be a mortgage payment of $4200 per month which is not supported by the local economy. They flat out RUINED the neighborhood!!! Maybe if they have enough problems with squatting they will be inspired to sell at a discount. Companies should not own real estate only living men and women.

Yes! Let's call it out!!! I've never dealt with squatters, but I dealt with holdover tenants who would not leave. They were perfectly capable of going elsewhere and chose not to...and they were in rooms I had rented out in my personal home. The fact that they had rights like that in my PERSONAL home and the law said it's ok because they're tenants, absolutely not .

I think there should be a database where names of homeowners, tenants and leases are uploaded so the sheriff can do an easy peasy check. Nothing on file, then not a tenant. Legit lease on file, then shady landlord.

its been a while, but I thought the city would have a record of a liease being filed, bank records and that the house was actually advertised as being for rent? also, i think that builder at the end was hoping to 'grab' the land they actually want to wait her out

Squatters are providing a valuable service to society. The reason squatting laws exist is to prevent the ruling elite from buying up homes and then sitting on them. That is, not allowing anyone to live there. Squatters are essential in the battle against hedge fund dominace of home buying.

Some states, renters rights supersede landlord rights, so it is possible to lease the unit to your bully brother in-law who can go into the unit at anytime and clean house (check your state laws 1st)

I think with the growing homeless problem, we do need to make some housing available to the unemployed, those with spottier employment , poor rental history, bad credit, bankruptcy, charged off credit cards, those who Owe money to a previous landlord, those who have broken a lease, those with foreclosures or short sales, those unable to find a cosigner, those that are very poor, those who are self employed less than two years, those with criminal records, those with a prior eviction, etc I think part of the reason there are so many squatters and homeless is that many landlords exclude these populations from getting decent housing. They let all the developers build housing for the rich and upper middle class but very little the poorest people can afford nowadays. I think if society made more housing that was available to these populations excluded by most tenant screening databases, there would be less squatters.

Best solution: Share the addresses of the local government officials online. Share the local laws on "squatter rights" and then, the local laws will quickly be fixed.

All Real Estate housing in the U.S. should have to be Owner Occupied by law. Housing is just way too out of control to allow people to own more than 2. Sorry...................

The idea is adverse possession in most places you need to stay for 20 continuous years & your occupancy should be 'open, notorious (obvious) & hostile aka without permission). Check your state & local laws on this.
