A word of caution to potential applicants seeking legal advice from the human rights legal support center (HR LSC). Many of the cases that are accepted by them, it goes by "the legal team" at the HR LSC. What this really means is that, the attorney will "sell" the application...a quick Quiz of the applicant about their compatibility With the center's policies determines if you are a "good" fit-- In other words agreeable to accept low payments for general damages - usually $1000 to $1200 or less. Another part of this interview quiz is to ensure an applicant doesn't fight the process - just take what you get a move on. Don't ask For too much. This is unacceptable, but novice applicants don't know that, and they are glad for what they do get. Some of them will take The problems to them like dogs rather than risk having no Lawyer representing their interests was the worse day empty-handed because they don't know how to navigate the process at mediation. This usually needs the respondent can run all over them. This usually happens when deciding on the final release. By offering them little to no real reward, especially enough to seek therapy for racial trauma, Many applicants will just walk away more traumatized. But here is the real kicker, at the interview, the HR LSC attorney will quickly want to know a client's expectations. This includes What do they hope to achieve in terms of money? Not all cases are about money, but if their injuries resulting from racism require therapy and they always do, asking for general damages is not unreasonable, especially from endowed establishments. these rich corporations and businesses and individuals have to be held responsible for discrimination Whether vicariously or directly. It's an applicant's right to be free from discrimination and breach of their dignity. When it's time to pay for this breach. Suddenly it's a game of you asking for too much. "managing expectations" is how the HR LSC attorney will either sell the case to the legal team for Representation or they simply don't. I don't believe your application is a good one For that reason alone. They steer whether an application is presented as meeting the criteria is representation on a limited retainer basis you only take the case to represent certain aspects whether it's for full hearing work or mediation, but they will not provide a blanket retainer from the start to finish because some cases can be resolved through mediation without going to a full hearing. One of the issues. That's factored in this decision is a lack of support by the HR LSC attorney is the way in which an Application is presented after the attorney speaks with the applicant. The applicant must agree to accept the limited conditions under which the retainer is accepted. One of the biggest problems is that an applicant in a human rights mediation case will be encouraged to accept under $3000 as low as $1200 General damages. This is unacceptable! And if an applicant asked for more, The attorney will be quick to say they'll talk to the center If they should accept the case. I have been told that respondents will not pay over $1,200, but That has not been my experience in three cases. Why are HR LSC attorneys so apprehensive to seek larger general damages? I have my suspicions. It has less to do with litigation economics and more on personal reputation risk--losing at trial. What is the mediation contacts, attorney don't want to go against the status quo. I had to push back hard on the respondent who wants to provide a $500 gift certificateP.m. but quickly changed to when I would change an attorney at the center; suddenly, everything changed. It's always good to shop for an attorney to make sure they are a fit for you and that you are a fit for them. Don't be afraid to ask for another attorney whose values and views are different from your own. Don't be manipulated and intimidated into accepting some attorney who is not willing to go to bat for advancing your rights. And they come a dime a dozen. I had to challenge somebody's lawyers so I can argue for general damages exceeding $5000. So don't let those lawyers at the HR LSC tell you otherwise. They are afraid to push the boundaries. They are afraid of the respondent's response. But the question is why? There is self-interest takes precedence over clients' interests. Of course, you can take your $1200 and Don't have therapy to address your mental anguish from the racism. These lawyers only accept cases that they don't have to fight for. And, by asking for excess money. They think that it's too much work and they would say your case is not worth their time. But they're just trying to bolster their resume Until they can branch out there all while you suffer with the pain. $1200 in Toronto cannot pay for therapy. Anyone who will need therapy for discrimination and its impact on well-being and to address its effect such as anxiety will soon learn how expensive therapy is. And if not addressed will only get worse. Many respondents don't want to pay for therapy or anti-black racism training. As part of, but if the lawyer puts it in as a part of the settlement, it surely can happen because I have done it. Sure, every case is different. But if you have a good lawyer from the center, There are a few of them. Many others are just going along with the status quo. I don't want social justice and anti-black racism by calling out anyone. Many of the lawyers at the HR LSC Are not there to advance your rights. They will not advance yourCase advocate why they should represent you especially when you are asking in excess of $10,000. Surely, you won't get that at a trial. So mediation is the best chance of getting to pay for your therapy and to restore your dignity. That is all I have to say about this game played at the HR LSC.
