There was *NO* special treatment. They could not arrest him without a warrant. That’s the law. In every single US state cops can’t arrest you without a warrant UNLESS (1) the cops actually witness the crime, or (2) it’s a felony, whether the cop witnessed it or not. Because all criminal law is governed by statute, these rules vary *slightly* from state to state (but not much… those are the baseline rules for warrantless arrests set by the US Supreme Court that every state has to follow. It comes from an interpretation of the 4th Amendment). Given the senator here committed a misdemeanor, and none of the cops actually saw/smelled/heard/sensed his misdemeanor directly, they literally could not arrest him without themselves violating the law. They would have had to go get a warrant and come back. States also add their own additional “exigent circumstances” language to statutes allowing warrantless arrests if they believe someone is going to flee, destroy evidence, hurt themself/someone else, etc. Again, none of these applied to the situation here.

I am INTENSELY curious how a police officer is allowed to turn off his BWC's microphone in the middle of an investigation! There is no such thing as "privileged communication" between 2 beat cops at a traffic stop unless one cop is the other cop's lawyer. Yep camera and microphones should be on at all times because you never know when something may happen or be said. On duty is not personal time. Police should be trained to keep personal time situations on personal time with the exception for personal emergencies. Also police camera information should be uploaded live to a computer at their headquarters and constantly monitored by personal at headquarters and finally the police should go back to the partner system. Two officers to one police cruiser. It is safer and more practical. I get so angry when the police chase a car and have to drive AND call out the action on the radio, that is distracted driving.

On most of the models tho I’m pretty sure audio and video are recorded separately and in fact the mute button is superficial in a way that there is a separate audio mic that is always running no matter what so you may be able to foia it after the case completes, but it’s kind of pointless as it’s pretty easy to guess that the muted conversation was just the cop relaying the censored guy’s testimony and any private details like his name and address or the encounter. If the politician is popular then you can understand why it would maybe cause trouble for the accuser to be identified so usually some info is withheld out of curtesy.

Another body camera video from Thursday night shows Police Major Todd Patalano knocking on Miller’s front door to tell him the victim wants to press charges. “Why would you key his car?” Patalano asks the senator. “He was already threatening me,” Miller said. “As soon as I opened my door, he said, ‘Hey Miller, what are you going to do?’” Miller said he took his keys out because he felt threatened. When Patalano asked again why Miller would key the man’s car, Miller said: “He was daring me to, basically.” Police charged him with a misdemeanor count of vandalism/malicious injury to property. This video reminded me about an important and serious issue and that is that every cop who ever MUTES or TURNS OFF his/her body camera WHILE ON SCENE INVESTIGATING A CRIME should be FIRED immediately and they should LOSE their police certification. Cops that do it obviously cannot be trusted TO RECORD ACCURATELY, creating a good public record for all to see and hear exactly what took place, how and why they came to certain conclusions and took certain actions. We the People have the RIGHT TO KNOW what our law enforcement officers are doing, why, how PROFESSIONAL they are being and how well they are SERVING the public.

@@kellyann1293, I was speaking in general about cops muting their body worn cameras, which they aren't supposed to do, but they do it often anyway. You will notice I did not say anything about THIS particular incident or THESE particular cops...the stopping or muting body cameras is simply something that NEEDS to be addressed via new, very strong department policies and new laws with serious consequences for doing so.

As a side note, it should be illegal for Police to mute or turn off their bodycams once they are activated...especially when huddled away from a suspect or someone being detained. It's corrupt and sus in and of itself.

The original isn’t muted. The video tape released to the public has portions “redacted” that are deemed confidential or related to officer safety. That’s just standard op. Procedure. There’s nothing weird going on here.
