The plaintiff says she’s been renting a home from the defendants for 15 years. She claims they’ve been stealing her electricity by including a garage she has no access to, so she’s suing to be reimbursed. The defendants say the garage has no electricity and claim they owe nothing.

Not sure how $20 a month for 15 years is reasonable. First, $20 15 years ago is not the same as $20 today. And secondly, if the garage is only used occasionally it might cost $5 a month at the most. All that's being used is a light bulb. If they had a refrigerator in there it would be a different story. The ruling is the right way to deal with this.

Not kicked out, protected. Having your landlords steal money from you by making you pay for their use of electrical power isn't that trivial. It's a violation of a tenant's basic rights.

@@Tarotlynx Nah, it's probably $5 worth of electricity, if that, and yet they allowed the daughter to move in with the mother, when they didn't have to. That alone could have means a large increase in rent, because now the tenancy changed, but they didn't change anything, being nice. Hope they aren't nice in the future and will kick them out the first violation the plaintiffs have.

Because they weren't using it. Even during the four months of installation, they said it still wasn't using anything. However, in the event that the surveillance system finally got up and working.....it uses an extremely small amount of electricity. What would it have been, MAYBE $3 per month? The daughter was looking for a payout and is stressing her poor mother over absolutely ridiculous mess. If the system DOES get up and working, put 5-10 dollars on her bill and just call it a day. They were clearly in good standing with one another before the daughter came alone for the plaintiff to be a tenant for damn near 2 decades. Her daughter needs to be vigilant about other things, not pennies on the dollar for her mother.

I know everyone thinks the daughter was too much but I'll keep it a rack- if I moved in with my mom and even THOUGHT someone was taking advantage of her, I would turn tf up too in court and try to break someone's pocket- not because of money but because I don't tolerate people disrespecting my mom.

but it's not being taken advantaged of... this is something that was clearly just over looked by all parties until the daughter came into the picture. Also the garage isn't consistently being used. Also are you going to give a landlord a reason to look for chances to evict you over maybe 5 dollars a month. then your stuck having to find anew place that would cost way more (considering her rent has been controlled for x amount of years and rent prices have gone you drastically)

I agree with you... if they try to evict her after living their for that many years I would sue.. she has been paying full rent and if they are doing all that work for the shed then they been using the electric I would be upset and I don't care what anyone says that is wrong and they knew they was doing it. She paid her rent so she should be having to pay someone bill even if it's a dollar. That is the point plus she most likely on disability so she most likely don't have much money so every penny counts. They did them wrong.

There was no way defendants used $20.00 per month every month for fifteen years. My entire electric bill runs $70-$80 per month, and there's no way my garage accounts for 25% of that bill. Plaintiff was seeking a windfall.

My electric bill, including heat in the cold NJ winter, is never over $29...and that's because almost everything in the apartment is OFF at the circuit breaker except for some lights...hehehe. I live like the Amish.

FYI Comparison. I have an old pole barn in the back that became both a wood working shop and where I maintained our cars and motorcycles. I ran 220v to the shop to run a big air compressor plus had 110v all over the shop for planes, chop saws, routers, table saws, band saws and air sanders etc. Even with all that equip plus lighting being used everyday my electric only jumped about $30.00. Summer in Florida with central ac in house our bill was about 175 to a max of 200.

I have a separate garage bill and if NO electric is on for the entire month I still pay a little over 30 a month. I can show you on my bill that zero electric was used for the month I pay 30. If I just use just my light only it's over 50. I understand not everyone has a separate garage bill and u wouldn't know it still cost. I honestly think it's a rip off because u would think it wouldn't cost anything but it does.

I truly hope she doesn’t get evicted after this, it seems more like the daughter was either goading her or not putting her foot down. It would suck to find a place in her area. I hate moving, but it’s worse when you’re elderly I’d imagine.

You don't know what rent control is. It has to with tenant's rights laws. It is not Section 8. It means he cannot evict her with just a notice, among many other rules.

I agree. But I think the daughter put her up to it. That woman wouldn't have cared. Those people probably used a couple bucks a MONTH on that doggone thing- and that's assuming that they used it for the entire 15 years, which they didn't! During the installation they still had not even used anything. What was her silly headed daughter nagging her for? They could give her a $10 and be done. Her daughter is looking for a payout and made her mother look stupid. She outta be ashamed. I agree with you.....pure facepalm moment!! 🤦🏽‍♀️

Month to Month lease, I would throw them out, they don't need the drama, how did they come up with $20 a month for the electricity used. This old bag is causing problems for her mom, we use generators on jobsites. I don't see how the landlord has to prove a roofer used a generator, I have seen a lot of roofers use generators on roofs.

We rented a 2 room apt in a house & electric was included. Being only 19 years old, we never questioned it until a year later, the other tenant renting rest of house needed some wiring updated for a dryer. OOPS...no separate meter. Those ppl were NOT HAPPY.

If you're looking for a rental & you see "RUBS" then pass it up. Shared utility is legal; in some states and it's awful. You never know what your bill will be every month, & if your neighbor decides to l eave the heat cranked & go out all day you're paying for that garbage. I didn't find out about this until after I moved in. I used to own my house prior to this & this way of dealing with bills is ridiculous.

One of the ways to evict a rent stabilized tenant is to give them notice that you (the owner) will be moving into the property yourself. Out of spite, I would move it for 6 months to get her out.

Also, I am a bit surprised that the landlord permitted her daughter to move in after the fact. In NY, landlords are under no obligation to allow the original tenant to add people to the rent stabilized lease, even if it is a daughter. The only exception, as far as I know, is through marriage. Rent-stabilized tenant CAN legally request to have a spouse added upon marriage. Maybe things are different where they live-or, perhaps, the landlords did her a favor.

@@Tarotlynx You have to make a choice and you can't have it both ways; high rent or not. Now you have a screen with your landlord that will never go away. I'm with the judge, evict her. She was on Section 8, meaning her worker could help her to find her another place. I'd give her 60 days to move and open it up for someone else. She burned a bridge, now pack up and leave or don't ever expect so much as a greeting. She and daughter are trouble; IMO.
