Can't be giving new trials to every convict who gets one person to sign an affidavit of an uncorroborated account. Imagine it. Suspect A goes to prison for murdering your sister. All the evidence points to him. 15 years later someone comes out and says "Oh ya know what, I saw (alternate suspect B) pushing your sisters car after the fact". This person could be paid, wrong, or just plain delusional. Without corroboration they never will and should never get a new trial.

Not really. Bobby Dassey was an actual witness who took the stand at trial, so already that means it was entered as evidence and holds more weight than any affidavit after the fact. Next, Bobby's account can be corroborated because even Avery states Teresa arrived and was there around that time. Meanwhile, no one can corroborate Sowinski's as no one else saw anyone pushing any SUV let alone the RAV onto the property on an early morning before the 5th.

Thought he was just denied the hearing? Which could trigger a new trial if the evidence is deemed sufficient. It’s very difficult to get a new trial no matter who you are.

I think that Kathleen Zellner is not doing that good of a job, at least 7-8 years on this case, and all her motions have been denied so far. The prosecution puts up lousy and unsatisfactory arguments, and are still able to win all the time. It seems that the corruption has reached the judges on the appellate courts, and they are never going to give him a chance. Nothing that Zellner says is enough to convince any of the judges.

You’d think the court would find there would be a reasonable possibility of a different outcome if this were known during trial. They got the search warrant for the property as a result of finding the RAV, iirc. Everything else would presumably be “fruit of the poisonous tree,” and be inadmissible as evidence, *if* Bobby did push it on. That would align perfectly with the defence theory at trial. I haven’t read the opinion yet, though, just listened to people reading it. If that’s what they’re saying, then it’s a nonsense.

The Defense Diaries did a video yesterday reading through the entire thing and it was really good to hear it broken down in a way that non lawyers could understand what it all means. What Bobby said is considered factual because it’s on the record testimony. The “facts” of the case are what were elicited during the trial. Whether truthful, inaccurate, or lies, they’re “facts” before the courts.

We have Sowinski attesting to seeing Bobby pushing ‘the’ RAV, plus multiple other affidavits-claiming Bobby driving it hours before Sowinski observation, it leaving ASY on Oct31 & seen at turnaround Oct31-Nov3. Do truth deniers really believe all these people are lying & form part of a huge conspiracy? Any fair minded person with both a simple grasp of the case & Wi. law, knows that an evidentiary hearing must occur to allow this mountain of evidence implicating Bobby to be tested.

Creeper Kratz paid bobby and scott for the testimony. And other dude didnt come into play until later. Personally, i think zellner sucks. She has been at this since 2016 and in every single motion she has ever filed, every single one looks as if its written by an amateur. They are ridden with mistakes and amateur writings. For the courts to ALWAYS come back and state that she is mussing this or didnt prove that is insane for someone of her caliber. And this happens on EVERY FILING since 2016. I said it then and ill say it now. Zellner sucks in this case and she is obviously not writing her own motions.

I can help explain exactly what and why Zellner took the case for. 2013: Sandy attempts to write Zellner's office and get her to take Avery's case. Her attempts are ignored. 2014: Sandy *again* attempts to write and her attempts are once again completely ignored. 2015: MaM airs at the end of the year in December, inciting one of the largest public outcries in the history of true crime. 2016: Not two weeks later, early January, Zellner contacts Avery to take the case with dollar signs in her eyes. Oops that last part gave away what I was trying to have you infer.
